There was no objection from Inspector of Health. SUBDIVISION - KALMAN Request of Michael Kalman for a subdivision at Somerset Road was approved. No objection from Inspector of Health. Minutes of the Meeting of October 13, 1976 Subdivision - Hamilton Heard, Jr. Approval was given for a subdivision at Tuckernuck, as requested by Hamilton Heard, Jr., there being no objection from Inspector of Health. ARLINE BARTLETT Board approved subdivision at Tuckernuck, as requested for Mrs. Arline Bartlett No objections from Inspector of Health or D.P.W. Supt. Mr. Purdy said he had not made the percolation tests himself, but they were done by and with a registered, professional engineer, Schofield, though MacAdam (1) actually did the work. ,VAlIANCE - MR. AND MRS. WILLIAM GRIEDER M:ty. Richard Glidden spoke in behalf of Mr. and Mrs. William Grieder, askiDg for a variance if two dwelliDgs are allowed on their Madaket lot for their children's use. The Grieders ask for one septic system for the two lots a. for two wells to be allowed on the same lot. Inspector of Health Purdy pointed out that it is the policy that each lot DUst have its own system if subdivided. When Selectman Gardner asked if the Grieders would be willing to sign a COftnan1 that the property would be kept in the family aDd not resold, they said they planned to do so, as it had been in the family since the 1930's. Also discussec was an easement which would be necessary, one for the water system and one for the sewer. Board suggested Mr. Glidden contact Mr. Purdy and give him the necessary papers and then Mr. Purdy could come back to the Board. Mr. Gardner said he felt there would be no problem with the Planning Board. Chairman Todd suggested, and it was agreed, obtaining advice of Town Counsel in the matter before proceediDg with any approval. January 26, 1977 - continuation of the Grieder variance. o Atty. Richard Glidden represented the Grieders, actiDg on an evaluation from Inspector of Health, Purdy, who said there is no problem with grantiDg a variance as the lot now stands, but it would not meet state compliance if the Grieders subdivided, as there must be a separate system for each dwelliDg. The Grieders were willing to have Atty. Glidden prepare the necessary papers to affirm they would not subdivide and that, in future years, if there ever was a subdivision, they understood there must be two systems. Under these circumstances the Board approved the request. Mr. Gardner discussed the vario\ll means by which the Grieders could give their children a lease, retaining the ownership in one person's name. Mr. Purdy said the reason for the law is so one person will be responsible for the system and that the new state law will read one system to a lot, instead of a dwelling. He said present state law, Article XI calls for each dwelling to have a separate system, but the Board could grant a variance.
