Lindsey Perry, Theodore Tillotson, Michael Angelastro, Donald Purdy, Paul Bucknam, William Klein to discuss request of Mr. Perry for amending the existing rules and regulations which apply to the Madaket area, based upon a water resources study by Whitman and Howard. Town Counsel Goglia as also present. Mr. Perry, in an effort to avoid litigation, and referring to the upcoming court case of Mr. Angelastro, asked if amendment could be made to the Madaket regulati ns which would allow unbuildable land, such as roads, or gre,en belt, which he state is not useable under a 99-year restriction, to be taken into consideration in figuring the distances which would comply for set-backs or distances between wells and septic systems. He pointed out that this would not change the intent of the rules, but would eliminate the possibility of having to request perhaps 30 variances for lots which could not meet the requirements under present rules. He said this would reduce to perhaps three the number of lots which would need variances. Mr. Perry stated that most lots were purchased prior to the regulations and that lots sold since then have been made larger to comply with the 20,000 sq. ft. requirement, stating that most have 63~000 sq. ft., which is well in excess of what is needed. He further added that the density would not be affected if the amendment was allowed. Mr. BucKnam, of Whitman and Howard, told the Board that this proposal would meet the requirements as far as what Whitman and Howard had hoped to accomplish and he foresaw no problems in that regard. The main question had been of water resources and not of restricting building in the area and that the 63,000 sq. ft was far more than their suggested 20,000. Town Counsel Goglia discussed the pros and cons of a new amendment, with the Board having to decide if it wishes to have to consider possibly 30 variances, or if only 3 would be better. The matter was taken under advisement.
