1. At a Public Hearing of the NANTUCKET ZONING BOARD OF APPEALS held at 1:00
p.m., Thursday, December 11, 2008, in the Garage Area, 2 Fairgrounds Road, Nantucket,
Massachusetts 02554 on the Application ofB-P Nantucket Ventures, LLC, 81 Somerset Road,
Nantucket, MA 02554, Board of Appeals File No. 079-08, the Board made the following
decision:
2. The Applicant is requesting Special Permit relief pursuant to Nantucket Zoning Bylaw
Section 139-16.C(l) (reduce the ten-foot side and rear lot setback from 10 feet to 5 feet). The
Applicant's structure is sited as close as 9.6 feet to the side yard lot line in a zoning district that
requires a ten (10) foot side yard setback.
The site is located at 9 Westmoor Farm Road, is shown on Nantucket Tax Assessor's
Map 41 as Parcel 829, is shown on Land court Plan 13328-M as Lot 30, and is recorded at the
Nantucket County Registry of Deeds as Certificate of Title No. 22737.
3. The Decision is based upon the Application and the material submitted with it and the
testimony and evidence presented at the Hearing. The Planning Board made no
recommendation, as the matter was not of planning concern. There was a letter on file from an
abutter expressing concern if the Board granted the Applicant the full relief of reducing the
setback to five (5) feet.
4. The Applicant represented that he is requesting to reduce the ten-foot side and rear lot
setbacks from ten (10) feet to five (5) feet pursuant to Nantucket Zoning Bylaw 139-16.C(l).
The Applicant's dwelling conforms to all setback requirements; but, the deck is 9.6 feet from the
side yard lot line in a zoning district that requires a ten (10) foot side yard setback. The
Applicant informally told Staff that the mistake was due to the contractor using outdated plans
showing the intensity regulations. Section 139-16.C(1) of the Zoning Bylaw allows Applicants
in the R-20 zoning district to reduce the side yard setback from ten (10) feet to five (5) feet upon
the issuance of a Special Permit by the Zoning Board of Appeals.
The Applicant requested that the Board validate the siting of the deck at approximately
9.6 feet, rather than granting him the five (5) foot setback. The Applicant believed this would
appease the abutter who had submitted a letter of opposition to the Board of Appeals.
5. Therefore, the Board specifically finds that reducing the side yard setback to 9.6 feet to
validate the location of the deck on the easterly side of the property would not be not be
substantially more detrimental to the neighborhood as this is a minor intrusion into the setback
and that this relief would be in harmony with the general purpose and intent of the Zoning
Bylaw.
6. Accordingly, by a UNANIMOUS VOTE, the Board grants the SPECIAL PERMIT under
Nantucket Zoning Bylaw Section 139-l6.C(l) to reduce the required ten (10) foot side yard
setback to no closer than 9.6 feet from the easterly side lot line in order to validate the siting of
the existing deck as shown on the plan entitled "Zoning Board of Appeals Site Plan," prepared
by Charles W. Hart and Associates, Inc., dated October 24,2008, and attached herewith as
"Exhibit A" with the condition that any further expansion into the setback will require relief
from the Board of Appeals.
