ADDENDUM
Applicant is seeking a Modification of a Special Permit granted on December 3, 1986,
(Board of Appeals File No.126-86) and of a Special Permit granted on April 9, 1999 (Board of
Appeals File No. 019-99). Special Permit relief Was granted at the November 3, 1986 hearing
allowing the then Applicant to construct two small additions in order to bring the building into
compliance with the Massachusetts State Building Code. The building conta4J.ed five dwelling
": .
"r: units at the time of the hearing in 1986, and evidence was presented to.the, Board that remodeling
,(1' of the building took place in 1969 where a fourth and fifth unit were created prior to the
enactment of the Zoning By-law. The relief granted at the 1986 meeting was conditioned on
"the proposed additions will not create any additional dwelling units or living area upon the
w,premises". " At the March 12, 1999 meeting, additional relief was granted to the then Applicant
. <,to enclose an area in the top floor apartment, a portipn of which is more than the maximum
"permitted height of 30 feet above mean grade, Within the existing footprint and without
?, increasing the non-conforming height of the structure.
Locus is non-conforming as to elevation and use, containing five dwelling. units in one
building on a single lot, in a district where no more than two dwelling units are permitted and no
more than one dwelling unit (with an exception not material hereto) is permitted in a single
structure and as to frontage and side yard setback, having total frontage of 40.84 feet on Gardner
Court, with 50 feet being the minimum required in this zoning district, and side yard setback,
having setback of 4.20 feet from the southerly side yard lot line, with five feet being the
minimum required in this zoning district.
Applicant is seeking to divide an existing unit into two smaller units, with the number of
bedrooms remaining the same at two (2), and th<; numb~r of bathrooms remaining the same at
two and a half (2 ~). A kitchen will be added to the JleYf-~Y ~reated'second unit. There will be nO
increase in floor space, and no changes to the eXterior' :of'ihe building. A Conforming parking
space will be provided.

Gardner Court Condominium under Master Deed dated November 10, 1986 and
registered December 30, 1986 as Document No. 38564 at ,the Nantucket
Registry District, as amended by instrument dated September 15, 1988 and
registered February 2, 1989 as Document No. 46492, and fu!1her amended by
instrument dated November 17, 2004 and registered December 1, 2004 as
Document No. 109888, hereby consent to the filing and presentation before the
Nantucket Board of Appeals of the application by Jeremy L. David and Patricia A.
David,' being the owners of Unit NO.2 and potential contract purchasers of Unit
No.3, for the application to divide the exi~ting Unit No. 3 into two smaller,

submitted by you on behalf of Jeremy and Patricia David.

My husband, Jim, and I own two condominium units in 1 Gardner Court. We lIve in one
of the units for approximately 6 months of the year and use the other unit as a guest
apartmen~.
We have owned the units for over 18 years and 16 years respectively and have known the
Davids since they moved in 15 years ago. I have owned (and still oWn) a retail business
in town for 19 years. I also served as President of our condominium association for over
10 years.
Our two units open onto the common i~terior ls~,ir :1~~kand entry hall which are also .
shared by the David's unit ahd tbe unit belonging tOMane Anne Werner. The Werner
unit is on two floors and has three doors onto the common stairwell and entry hall. (The
fifth urllt has been owned by H:.imson Fraker for 15 years:but he does not access the
common stair well.)

Jim and I have no objection to the proposill to divide Marie Anne Werner's apartment
into two units, so that tlie DavIds can purchase the smaller unit to use as a guest
~ ~artment for thei~ family and'friends. '
