The applicant is a nonprofit membership corporation operating
recreational facilities for its members, including tennis courts.
This use is allowed in all districts by special permit under
Nantucket Zoning By-law ~139-7.D(5). The three tennis courts now
existing upon the locus were authorized by the Special Permits
issued by the Board of Appeals in Files Nos. 019-88A and 019-88B.
After the applicant acquired additional parcels to comprise the
present locus, the Board of Appeals issued its modification of
these Special Permits, authorizing construction of an additional
tennis court and reconfiguration of parking, in File No. 049-05.
In File No. 010-08, the Board of Appeals further modified the
existing Special Permits, by clarifying that the parking area
reconfiguration need not be done unless and until the fourth
tennis court would be constructed. The applicant has not
constructed the fourth tennis court, and no longer desires to do
so. It now proposes to move to the locus a shed containing about
330 square feet in ground cover, alter it by adding about 74
square feet of additional ground cover, and convert it for use as
a tennis center for youth activities. In addition, the applicant
proposes the future construction of a new toilet facility
building, containing about 216 square feet in ground cover. It
proposes to construct a new parking area, with fourteen spaces,
and to replace the site plan approved in File No. 049-05 with the
site plan submitted herewith. Accordingly, the applicant requests
that the existing Special Permits be modified to provide for the
proposed youth tennis center as a recreational use under ~139-
7.D (5) and as an alteration of the pre-existing recreational use
upon the locus under ~139-7.D(5) and ~139-33.A. Other proposed
work, upon one of the two dwellings now existing upon the locus,
will not require zoning relief.

DECISION:
1. At a public hearing of the Nantucket Zoning Board of
Appeals, on Thursday, December 11, 2008, at 1:00 P.M., at 2
Fairgrounds Road, Nantucket, Massachusetts, the Board made the
following decision on the application of SIASCONSET CASINO
ASSOCIATION, clo Reade, Gullicksen, Hanley & Gifford, LLP, Post
Office Box 2669, Nantucket, Massachusetts 02584, File No. 078-08:
2. The applicant requests a Modification of the existing
Special Permit for the locus, in order to relocate a building to
the locus in order to provide a tennis center for youth
activities, as a recreational use pursuant to Nantucket Zoning
By-law ~139-7.D(5) (recreational facilities) and as an alteration
of the pre-existing recreational use upon the locus pursuant to
~139-7.D(5) and ~139-33.A (pre-existing nonconforming structures
and uses). In Board of Appeals File No. 010-08, the applicant
received a modification of the existing Special Permits to
clarify that the parking area reconfiguration need not be done
unless and until the fourth tennis court would be constructed.
Rather than create the fourth tennis court, the applicant now
proposes to move to the locus a shed containing about 350 square
feet of ground cover, alter it by adding about 74 square feet of
addi tional ground cover, and convert it for use as a tennis
center for youth activities. Further, the applicant proposes the
future construction of a new toilet facility building, containing
about 216 square feet of ground cover. The applicant also

proposes to construct a new parking area, with fourteen spaces.
The locus is situated at 11, 13 and 15 NEW STREET, Siasconset, is
shown on Assessor's Map 73.4.2 as Parcels 67, 68 and 69, consists
of (a) Land Court Plan 14696-D, Lot 3, (b) the land shown upon
plan recorded with Nantucket Deeds in Plan Book 11, Page 10, and
(c) Plan Book 17, Page 123, Lots 1 and 6, is held by the
applicant under Certificate of Title No. 21960 and deeds recorded
with Nantucket Deeds in Book 353, Page 214, Book 357, Page 285,
and Book 987, Page 148, and is situated in the Sconset-Old
Historic zoning district.
3. Our decision is based upon the application and
accompanying materials, and representations and testimony
received at our public hearing. There was no Planning Board
recommendation, on the basis that no matters of planning concern
were presented. Except for the presentation by the applicant's
representatives, there was no support nor opposition presented at
the public hearing.
4. The zoning history of the locus is extensively set forth
in the Board of Appeals decisions in Files Nos. 019-88A, 019-88B,
049-05 and 010-08. Use as a recreational facility is now allowed
as a use by Special Permit under By-law ~139-7.D(5), The
applicant now proposes to abandon the approval under File No.
049-05 for the construction of a fourth tennis court, and instead
move a structure now on its property at 10 New Street, primarily
for use by its staff in connection with the supervision of junior
activities and tennis lessons. It also proposes possible future
construction of a small building to contain restrooms, and the
reconfiguration of parking to provide fourteen spaces. A plan
showing the proposed layout of these features upon the locus,
prepared by Charles W. Hart and Associates, Inc., dated November
7, 2008, is attached hereto as Exhibit A.
5. The permission in File No. 049-05 for the construction
of a fourth tennis court was extended by the decision in File No.
010-08. File No. 049-05 required provision of at least ten
parking spaces upon the locus. The present proposal eliminates
the fourth tennis court and increases the number of parking
spaces that will be provided to fourteen. As presented by the
applicant's representatives, there will not be a significant
amount of change in the activity upon the locus, as the tennis
courts are already in use and teaching acti vi ties are taking
place; the new structures will facilitate, rather than intensify,
that use.
6. Based upon the foregoing presentation and facts, the
Board of Appeals made the finding, by unanimous vote, that the
proposed modification to the existing Special Permit and site
plan would be in harmony with the purpose and intent of the By-

law and would not be substantially more detrimental to the
neighborhood than the existing uses, and granted the requested
modification of the existing Special Permit to allow the
construction and uses in accordance with the Exhibit A plan,
subj ect to the condition than no exterior construction work be
performed between June 15 and September 15 in any year.
