The applicant is a nonprofit membership corporation operating
recreational facilities for its members, including tennis courts.
This use is allowed in all districts by special permit under
Nantucket Zoning By-law ~139-7. D (5) . The applicant's use pre-
exists the 1972 adoption of the Zoning By-law. It proposes to
remove a shed, which is used in connection with tennis operations,
and construct a new building to be used as an exercise and fitness
center, exclusively for its members. The new building will have
one story, with the main floor to be used for the exercise and
fitness center and a full basement to be used for storage; its
ground cover will be about 1,020 square feet. The area to be used
as the exercise and fitness center will contain about 800 square
feet. The new building will conform to all setback requirements,
and the total ground cover upon the locus will comply with
applicable requirements. No parking nor loading facilities exist
upon the locus, and none are proposed. Various tennis courts upon
the locus lie within setback areas; however, these nonconformities
pre-exist the adoption of the Zoning By-law and will not be
altered. Accordingly, the applicant requests Special Permit
relief, (a) for the proposed exercise and fitness center as a
recreational use under ~139-7.D(5), (b) for the alteration of the
pre-existing recreational use upon the locus under ~139-7.D(5) and
~139-33.A, (c) for the waiver of parking requirements under ~139-
18.B(2), and (d) for the waiver of off-street loading facilities
under ~139-20.C.

DECISION:
1. At a public hearing of the Nantucket Zoning Board of
Appeals, on Thursday, December 11, 2008, at 1:00 P.M., at 2
Fairgrounds Road, Nantucket, Massachusetts, the Board made the
following decision on the application of SIASCONSET CASINO
ASSOCIATION, c/o Reade, Gullicksen, Hanley & Gifford, LLP, Post
Office Box 2669, Nantucket, Massachusetts 02584, File No. 077-08:
2. The applicant requests relief by Special Permit pursuant
to Nantucket Zoning By-law ~139-7. D (5) (recreational facilities),
~139-33. A (alteration of pre-existing, nonconforming structures
and uses), ~139-18. B (parking waiver), and ~139-20. C (loading
zone waiver). The applicant proposes to remove a shed and
construct a new building to be used as an exercise and fitness
center. No parking or loading facilities exist upon the locus,
and none are proposed. Some tennis courts upon the locus lie
partly within setback areas; however, these nonconformities pre-
exist the 1972 adoption of the Nantucket Zoning By-law and will
not be altered. The new building will conform to all setback
requirements and the total ground cover upon the locus will
comply with the zoning requirements. The locus is situated at 10
NEW STREET, SIASCONSET, is shown on Assessor's Map 73.4.2 as
Parcel 16, is held by the applicant under various deeds of
record, commencing with Book 83, Page 120, and is situated in the
Sconset-Old Historic zoning district.
3. Our decision is based upon the application and
accompanying materials, and representations and testimony
received at our public hearing. There was no Planning Board
recommendation, on the basis that no matters of planning concern
were presented. Except for the presentation by the applicant's
representatives, there was no support nor opposition presented at
the public hearing.
4. The present uses and structures upon the locus are as
described in the Board of Appeals decision in File No. 048 -02,
including the work done pursuant thereto. However, the use as a
tennis club was described therein as a pre-existing,

nonconforming use. In fact, this recreational use is allowed by
Special Permit under By-law ~139-7. D (5) . Only insofar as this
use, which preceded the 1972 adoption of the By-law, has existed
without having received a Special Permit, does it constitute a
pre-existing, nonconforming use. The use implicitly became
conforming, by Special Permit, through the granting of the relief
in File No. 048-02.
5. As described by the applicant's representatives, the
proposal is to remove an existing shed used as ancillary to the
tennis activities upon the locus, and construct a new building to
be used as exercise and fitness center, for use exclusively by
the members of the applicant (limited in number to 500, pursuant
to the decision in File No. 048-02). The applicant informed the
Board that its membership is limited to persons having a
connection to Siasconset, and even though there is no on-site
parking or loading, and none is proposed, there has never been a
parking problem because members generally come to the Casino on
foot or by bicycle.
6. Based upon the foregoing presentation and facts, the
Board of Appeals made the finding, by unanimous vote, that the
applicant's use of the locus as a recreational facility as now
used, with the addition of the proposed exercise and fitness
building as shown upon the plan by Emack Surveying dated November
4, 2008, a copy of which is attached hereto as Exhibit A, would
be in harmony with the purpose and intent of the By-law and would
not be substantially more detrimental to the neighborhood or the
environment than the existing or permitted alternative uses, and
granted the requested relief by Special Permit under By-law ~139-
7.D(5), ~139-33.A, ~139-18.B, and ~139-20.C, subject to the
condition than no exterior construction work be performed between
June 15 and September 15 in any year.
