At a public hearing of the Nantucket Zoning Board of Appeals, on Thursday, December 11, 2008, in the Garage Area of the former Electric Company building, 2 Fairgrounds Road, Nantucket, Massachusetts, the Board made the following decision on the application of NANCY S. OLIVER, Trustee of NANCY S. OLIVER TRUST, c/o Reade, Gullicksen, Hanley & Gifford, LLP, Post Office Box 2669, Nantucket, Massachusetts 02584, File No. 076-08: 2. The applicant is seeking relief by SPECIAL PERMIT under Nantucket Zoning By-law ~ 139-33.A (alteration or expansion of a pre-existing, nonconforming use or structure). The applicant proposes to construct two small additions, adding a total of about 300 square feet of ground cover, to an existing single- family dwelling upon the locus, which is nonconforming as to ground cover, and is situated upon a lot which is non-conforming as to lot size and frontage. The existing ground cover ratio is approximately 6.2% in a zoning district having a maximum ground cover ratio of 3%. The existing lot size is 34,370 square feet in a zoning district that requires a minimuim lot size of 120,000 square feet. The locus has 195 feet of frontage in a zoning district that requires 200 feet of frontage. The locus is si tuated at 16 Sesapana Road, Assessor's Map 68, Parcel 93, is shown upon Land Court Plan 14664C as Lot 12, and is in a Limited Use General-3 zoning district. 3. Our decision is based upon the application and accompanying materials, which included a petition in favor of the requested relief signed by ten of the applicant's neighbors, and 1 representations and testimony received at our public hearing by the applicant's attorney. The Planning Board recommendation was that this was not a matter of planning concern. There was no opposition to the application. 4. As presented by the applicant's attorney, there currently exists upon the site, a 2158~ square foot dwelling, as well as an 87~ square foot shed which is not required to be included in the ground cover calculation. In ZBA File No. 110- 92, a special permit was granted to allow for a small addition to the pre-existing nonconforming dwelling existing at that time, and to validate the construction of a green house attached to the dwelling, for which the previous building inspector had inadvertently not required any zoning relief. Presently, the applicant wishes to add two small first floor additions to the dwelling in order to enlarge the master bedroom and living room. Such work would result in a total ground cover ratio upon the locus of about 7.2%. 5. The applicant requests relief by special permit for the proposed additions, on the basis that the dwelling is already pre-existing, nonconforming as to ground cover, and that as a result of the special status of single and two-family dwellings under M.G.L., c. 40A, ~ 6, the nonconformity may be extended by special permit where the Board of Appeals, as special permit granting authority, finds that the extension will not be substantially more detrimental to the neighborhood than the existing nonconformity. The Board noted that the proposed additions are very modest, and that there is strong neighborhood support for the proposed work. 6. Based upon the foregoing, the Board of Appeals, by a UNANIMOUS 5-0 vote, made the finding that the proposed extension and alteration to the structures upon the locus would not be substantially more detrimental to the neighborhood than the existing nonconformities, and by the same vote, GRANTED the requested relief by SPECIAL PERMIT under Zoning By-law ~ 139- 33.A, subject to the following conditions: (a) Upon completion of the proposed additions, the ground cover ratio upon the site shall not exceed 7.2%.
