ADDENDUM
The Applicant, AGS Nominee Trust, u/d/t dated March 12,2007, recorded in the
Nantucket Registry of Deeds in Book 1070, Page 138, requests a Special Permit pursuant to
Section 139-33A. (4) (a) (Finding) and (b) (Special Permit) and Section 139-33 E. (2) (a)
(Preexisting, nonconforming uses, structures and lots) of the Nantucket Zoning By-law.
Applicant is seeking relief to construct ground cover not to exceed the permitted ground cover
ratio in the Residential Old Historic Zoning District on a lot containing less than 5,000 square
feet. The property is located at 40 Orange Street ("hereinafter the Property"). The Premises is
shown in the Nantucket Assessors Book on Map 42.3.2 as Parcel 206.
The Property is located in the Residential Old Historic (ROH) Zoning District. The
Property is improved by a preexisting, nonconforming two story wood frame single family
dwelling. Locus is preexisting, nonconforming as to lot size being comprised of2,663 +/- square
feet in a zoning district with a minimum lot size requirement of 5,000 square feet; as to ground
cover ratio having an existing ground cover ratio of 36.5% in a zoning district having an
allowable ground cover ratio for a lot comprised of less than 5000 square feet of 30%; as to
frontage having frontage of 40.98 feet in a zoning district having a frontage requirement of 50';
and as to side zoning yard setbacks 1.54 +/. feet away from the north side yard bound and 4.37
+/- feet away from the south side yard bound at its closest points.
The Applicant is seeking relief to construct ground cover not to exceed the permitted
ground cover ratio in the Residential Old Historic Zoning District by enclosing and incorporating
into habitable living space an existing pergola located on the east side of the dwelling in its
backyard. The conversion of the existing pergola into habitable space will result in an increase in
ground cover ratio from 36.5% to 40.55%, still less than the 50% otherwise allowed in the ROH
Zoning District.
Applicant believes, based upon the request and Locus in the context of the immediately
surrounding neighborhood, that the Board of Appeals make a Finding that the Applicant's
requested alteration is not substantially more detrimental that the existing nonconforming
dwelling to the neighborhood. Applicant's request is meritorious and the relief requested may be
granted without derogating from the health, safety, convenience, morals and general welfare of
the inhabitants of neither the Town of Nantucket nor the Purpose of the By-Law.
Applicant respectfully requests that the Board grant it the requested Special Permit.
