Addendum "A"
Applicant owns a lot with dwelling house and garage thereon at 82 Orange Street on the
corner of Coon Street. Applicant is in the process of renovating the main house with no
change in footprint. There is an existing garage in complete disrepair that is located
between .4 and .5 feet from the easterly property line and approximately 2.5 feet from the
rear of the main house. Applicant would like to demolish this garage, but the HDC will
not allow removal or demolition. Therefore, Applicant needs to raise it up, put it on a
foundation that meets code and re-build it. The garage currently sits 23.2 feet from Coon
Street and when applicant picks it up he would like to move it 7 feet closer to Coon Street
in order to have a usable back yard and to be able to get light and air into the kitchen of
the main house. The garage in the new location will still be between .4 and .5 feet from
the easterly sideline.
Applicant seeks a SPECIAL PERMIT pursuant to Chapter 139 Section 33A(4) and/or
(5).

At a Public Hearing of the ZONING BOARD OF APPEALS held at 12:00 P.M.,
Friday, October 10, 2008, in the garage area at the Town Building Annex, 2 Fairgrounds
Road, Nantucket, Massachusetts, on the Application of EIGHTY TWO ORANGE
NANTUCKET, LLC, c/o Glidden and Glidden, P.C., 37 Centre Street, Nantucket, MA 02554,
Board of Appeals File No. 060-08 the Board made the following Decision:
1. Applicant is requesting Special Permit relief pursuant to Nantucket Zoning Bylaw
Section 139-33A(4) and/or (5) (altering pre-existing, nonconforming structures) to raise the
garage on the locus, put a new foundation under the garage, and rebuild the garage. The
garage is presently located between 0.4 and 0.5 feet from the rear yard easterly property line,
2.5 feet from the rear of the main house, and 23.2 feet from Coon Street in a zoning district
that requires a five (5) foot rear yard setback. The Applicant proposes to relocate the garage
seven (7) feet closer to Coon Street. The garage in the new location will still be between 0.4
and 0.5 feet from the rear yard easterly property line. The site is located at 82 Orange Street,
is shown on Nantucket Tax Assessor's Map 55.1.4 as Parcel 23, and is recorded in the
Nantucket County Registry of Deeds in Book 1133, Page 210.
2. The Decision is based upon the Application and materials submitted therewith, and the
testimony and evidence introduced at the hearing. There was no recommendation from the
Planning Board as the Board determined that the matter was not a planning concern. There
were no letters on file.
3. Applicant's attorney presented the case for the applicant. He explained that the
property which was conforming as to the area and frontage requirements of the Nantucket
Zoning Bylaw contained two structures, a residence and a garage, both of which pre-dated
zoning. The applicant had obtained a building permit to renovate the residential structure and
had intended to demolish the garage which had no footings or foundation and was structurally
unsound. However, the Historical District Commission determined that the garage was a
"contributing structure" and could not be demolished. In order to renovate the garage it was
necessary to put it on a foundation. And since it was located in the rear yard setback, it was
necessary to obtain a special permit to do this work. Applicant obtained a height survey to
insure that when the proj ect was completed the renovated garage would be at the same height
as the pre-existing garage. When the renovations are completed there will also be no change
in the footprint of the structure.
4. Based on the foregoing, the Board finds that the proposed renovation to the pre-
existing garage, which will restore the structural integrity of the building, is in keeping with
the spirit and intent of the Zoning Bylaw, is consistent with the residential character of the
neighborhood, and will not be more detrimental than the pre-existing condition.
5. Accordingly, by a UNANIMOUS vote (5-0), the Board of Appeals decided to
GRANT the requested relief by SPECIAL PERMIT pursuant to Nantucket Zoning Bylaw
Section 139-33A(4) and/or (5) allowing the Applicant to put the garage on a structurally
sound footing and to renovate the building to restore it's structural integrity. Said relief is
conditioned as follows:
a. The renovated structure will be no closer to the sideline than the pre-existing garage
was located.
b. The height of the renovated structure will be substantially the same as the height as
the pre-existing garage.
c. No exterior work will be done between May 15th and October 15th of the year.
