ADDENDUM "A"
The Applicant, Paula Driscoll ("Driscoll") is the contract purchaser of the mixed-use,
retail/residential property located at 15 Old South Road, Nantucket, Massachusetts 02554 shown
as Lot 3 on Plan 44-Q at the Nantucket Registry of Deeds and as Parcel 14.1 on Assessor's Map
67 ("Property"). The Property is owned by Raymond F. Ross and Lois K. Ross and is located in
the RC-2 Zoning District.
Driscoll seeks a Special Permit pursuant to Section 139-18B(2) of the By-Law to waive
three (3) off-street parking spaces in connection with the Applicant's conversion of the existing
retail outdoor furniture store on the Property (patio. Com) to a year round liquor store. Currently,
the Property includes a commercial structure with 1,462:t square feet of ground cover, a small
garage/apartment on the rear of the Property with 726:t square feet of ground cover, ten (10) ofT-
street parking spaces, and a loading zone. The Applicant proposes to construct an addition to the
commercial building with a ground cover of approximately 626:t square feet and to use the
basement ofthe building for storage. The current aggregate ground cover of the structures on the
Property is approximately 2,188:t square feet. The Property has an area of 12,196:t square feet.
The existing ground cover ratio is 17.94. The new proposed ground cover ratio will be 23.07%
(2,814:t square feet). The maximum ground cover allowed in this RC-2 Zoning District is 50%.
In addition, Driscoll requests Minor Site Plan Review Approval pursuant to Section 139-23F(I)
of the By-Law.

DECISION:
1. At a public hearing of the Nantucket Zoning Board of Appeals on
Friday, October 10, 2008, at 12:00 P.M., at 2 Fairgrounds Road, Nantucket,
Massachusetts, the Board made the following Decision on the Application in
Zoning Board of Appeals File No. 061-08 of Raymond F. Ross and Lois K. Ross
as Owner, Paula Driscoll as Applicant cj 0 Vaughan, Dale, Hunter, Stetina, and
Beaudette, P.C, Whaler's Lane, PO Box 659, Nantucket, MA 02554.
2. Applicant is requesting Special Permit relief pursuant to Nantucket
Zoning Bylaw Section 139-18B(2) (parking) to waive the three (3) off-street
parking spaces in connection with the Applicant's conversion of the existing use
to a year round liquor store. The Applicant also proposes to construct an
addition to the commercial building to use the basement of the building for
storage. The locus conforms to all intensity regulations. The Applicant also
requests minor site plan review approval pursuant to Nantucket Zoning Bylaw
Section 139-23F(1) (minor site plan review).
The site is located at 15 Old South Road, is shown on Nantucket Tax
Assessor's Map 67 as Parcel 14.1, is shown as Lot 3 on Plan 44-Q at the Nantucket
County Registry of Deeds, and is recorded in the Nantucket County Registry of
Deeds in Book 590, Page 17.
3. Our Decision is based upon the Application and accompanying
materials, representations and testimony received at our public hearing. The
Planning Board made no recommendation finding that the Application did not
present any issues of planning concern. No abutter comment was received either
in favor of or against the Application.
4. Applicant, through counsel, represented that the Applicant is
proposing to convert the existing retail outdoor furniture store on the property
(Patio.com) to a year round liquor store. Currently, the property includes a
commercial structure with about 1,462 square feet of ground cover, a small
garage/ apartment in the rear of the property with about 726 square feet of
ground cover, ten (10) off-street parking spaces, and a loading zone.
The Applicant proposes to construct an addition to the commercial
building with a ground cover of approximately 626 square feet and to use the
basement of the building for storage. The proposed total ground cover will be
about 2,188 square feet with a proposed ground cover ratio of 23.07%. The RC-2
zoning district allows 50% ground cover. The property conforms to all intensity
regulations of the Nantucket Zoning Bylaw.
5. The Board finds that there is ample parking on the locus and that
granting a waiver of three (3) off-street parking spaces is in harmony with the
general purposes and intent of the bylaw and that compliance with the parking
requirements of Nantucket Zoning Bylaw Section 139-18 would be physically
impossible for the Applicant to provide. Furthermore, the Board grants minor
site plan approval for the site with the finding that the proposed plan conforms
to the provisions of the Zoning Code of the Town of Nantucket and all applicable
provisions of the Massachusetts General Laws.
8. Accordingly, by a UNANIMOUS vote (5-0), the Board of Appeals
decided to GRANT the requested relief by SPECIAL PERMIT pursuant to
Nantucket Zoning Bylaw Section 139-18B(2) to waive three (3) off-street parking
spaces.
