HomeMy WebLinkAbout2005-03-16 BOS Minutes March 16, 2005 Page 1 of3 BOARD OF SELECTMEN Minutes of the Meeting of 16 March 2005 at 7:00 PM. The meeting took place in the Court Room, Town and County Building, Nantucket, MA 02554. Members of the Board present were Bruce Watts, Douglas Bennett and Timothy Soverino. Michael Glowacki and Robert F. Murphy were absent. Chairman Soverino called the meeting to order at 7:22 PM, following a meeting of the Board of Health. PUBLIC COMMENT Nantucket resident Wendy McCrae presented a letter to the Board from the Shellfish Harbor and Advisory Board (SHAB) requesting that the Board allow commercial scallopers to increase the number of boxes permitted for their limit from five to six boxes for the remainder of the scallop season, which ends March 31,2005. After a brief discussion, Mr. Bennett moved to increase the limit from five to six boxes for the remainder of the season; seconded by Chairman Soverino. So voted. Mr. Watts abstained and did not participate in the discussion. SHAB member Douglas Smith noted that SHAB members are working with the Marine Department in moving seed, as well as adult scallops. Marine Superintendent Dave Fronzuto noted that approximately 26,500 bushels of scallops have been harvested this year bringing about 1.6 million dollars into the economy. Public Works Director Jeff Willett reported that work will begin next Monday on surveying for inflow/infiltration (1/1) in the Brant Point area. Mr. Bennett inquired as to how many gallons of 1/1 will be removed and Mr. Willett responded 300,000 gallons, ultimately. Approval of Minutes of 5 January 2005. Mr. Watts moved approval; seconded by Mr. Bennett. So voted. Approval of Payroll Warrant for Week Ending 13 March 2005. Mr. Watts moved approval; seconded by Mr. Bennett. So voted. Approval of Treasury Warrant and Pending Contracts for Week Ending 16 March 2005. Mr. Bennett moved approval; seconded by Mr. Watts. So voted. Chamber of Commerce: Public Hearing to Request Approval of Public Assembly Permits for the Following Events: Daffodil Festival/Antique Car Parade - April 23, 2005; Nantucket Island Pennant Game - June 25,2005; Sandcastle and Sculpture Contest - August 20,2005; Chowder Contest - October 15,2005; Tree Lighting and Community Sing - November 25, 2005; Annual Christmas Stroll - December 3, 2005; Holiday Red Ticket Drawing - December 24, 2005. Chairman Soverino opened the hearing and asked if any individual was present who wished to speak in favor of the applications. Chamber of Commerce executive director Tracy Bakalar spoke in favor. As no individual was present to speak in opposition, Chairman Soverino closed the hearing. Mr. Watts moved to approve public assembly permits for all of the events; seconded by Mr. Bennett. So voted. Marine Superintendent: Update on Recent Opening of Sesachacha Pond. Marine Superintendent Dave Fronzuto noted some community concern with regard to his decision to open Sesachacha Pond several weeks ago which resulted in the death of many fish. Mr. Fronzuto explained that the town has had the authority to open ponds since 1993 and Sesachacha is normally opened in April and October. Mr. Fronzuto continued that a property owner had requested the town open the pond due to the high level of water which was "up to the floor boards" in a property owner's house. Mr. Fronzuto added that he felt the high pond water was potentially going to undermine Polpis Road so he ordered the pond opened on February 16, 2005. Mr. Fronzuto stated that it was "unforeseen" that there would be fish deaths once the pond was opened and, although, the pond is once again reaching flood stage, opening the pond again in April will depend upon the salinity of the pond and levels of flooding. Mr. Fronzuto added that the fish stock is expected to recover. Citizen Request for Waiver of Sewer Connection Fee/Macys Lane. Macys Lane resident Bonnie Rizzo was present http://www.nantucket-ma.gov/departments/bos/minutes2005/BOS031605 .html 8/31/2006 BOS Minutes March 16, 2005 Page 2 of3 and explained that she helped finance the private extension of water and sewer lines down Macys Lane and would like a reduction of the sewer connection fee from her house from $2,000 to $500. Ms. Rizzo noted that she would be abandoning a septic system by connecting to the sewer. Public Works Director Jeff Willett stated that, typically, waivers are not granted to developers installing sewer pipes. Mr. Willett stated he has no objection to the waiver, if the septic system is being abandoned. After some discussion, Mr. Watts moved to refer the matter back to Mr. Willett and the Town Administrator to ascertain whether it falls under the existing sewer policy that a fee is automatically reduced to $500 when a connection to the sewer line is made within five years of the sewer becoming available. Citizen Request for Appeal of Building Department Fine. Developer Jim Williams explained that he had applied for several building permits for 45A and 45B Vestal Street; inadvertently picked up a permit for one of the projects and not the other, and started to work on the project without the building permit. Mr. Williams explained that he was then fined for working without a permit. Some discussion followed and Mr. Watts commented that he felt the fine was quite high. Building Commissioner Bernard Bartlett explained that permits need to be posted and this is an enforcement issue. After a brief discussion, Mr. Bennett moved to uphold the Building Inspector but reduce the fine to two times the cost of the permit fee rather than four times the cost of the permit fee; seconded by Mr. Watts. So voted. Liquor Licensee: Request for Change of Manager/Offshore Beachside L TD d/b/a Beachside at Nantucket. Mr. Watts moved to approve a change of Manager for Offshore Beachside L TD d/b/a Beachside of Nantucket from Mary Malavase to Mary Louise Fletcher; seconded by Mr. Bennett. So voted. Liquor Licensee: Request for Change of Manager/Fantasies Uncooked, Inc. d/b/a 21 Federal. Mr. Watts moved to approve a change of Manager for Fantasies Uncooked, Inc. d/b/a 21 Federal from Robert Sarkisian to Christopher Canty; seconded by Mr. Bennett. So voted. Town Clerk: Request for Re-Appointment of Constables (2). Mr. Watts moved to re-appoint Robert Reardon, Jr. and James Grieder as Constables, as recommended, for terms to expire on March 31,2008; seconded by Mr. Bennett. So voted. Town Clerk: Request for Re-Appointment of Registrar of Voters (continued from February 23,2005). Mr. Bennett moved to re-appoint David Goodman as a Registrar of Voters for a term to expire on March 31,2008; seconded by Mr. Watts. So voted. Request for Acceptance of Donation for Skate Park. Mr. Watts moved to accept a donation from Allan Law, MD for $100 for the proposed Skate Park, given in memory of Bob Beuscher, who worked for the Park and Recreation Department, and to authorize the Chairman to send a letter of thanks to Dr. Law, on behalf of the Board; seconded by Mr. Bennett. So voted. Town Administration: Request to Schedule Special Town Meeting. as per Citizen Petition. Town Administrator Libby Gibson recommended that the Special Town Meeting (STM) be held within the Annual Town Meeting and presented a proposed calendar for the required hearings. Nantucket resident Bob Liddle presented an article, on behalf of Kent Murphy, to be included in the STM to provide a funding source (portion of the Land Bank tax) for the Comprehensive Wastewater Management Plan. Mr. Bennett moved to include the article; seconded by Mr. Watts. So voted. Mr. Watts moved to close the STM warrant; seconded by Mr. Bennett. So voted. Mr. Watts moved to hold the STM on April 12, 2005 at 7:00 PM; seconded by Mr. Bennett. So voted. Town Administration: Stabilization Fund Policy Revisions (tabled from March 9, 2005). Town Administrator Libby Gibson reported that, as yet, the Finance Committee has not endorsed the revised policy, as requested by the Board of Selectmen. Mr. Watts moved to adopt the revised policy; seconded by Mr. Bennett. It was generally agreed to continue this matter until March 30, 2005. Town Administration: Request for Amended Resolution Regarding Damage Award for 1 Norwood Street. Town Administrator Libby Gibson reported that the taking of 1 Norwood Street resulted in purported heirs coming forward to make a claim on the property. Ms. Gibson continued that an appraisal was conducted and funds appropriated for a potential damage award in 2004. Ms. Gibson stated that, per Town Counsel's opinion, the damage award must be amended from One Dollar to the appraisal amount of $250,000. Mr. Watts moved approval; seconded by Mr. Bennett. So voted. Town Administrator's Report. Town Administrator Libby Gibson summarized the betterment assessments for residents of Surfside who will be assessed for the road improvements in that area. Ms. Gibson reviewed the maps and draft letters to go to the abutters (approximately 200 properties) noting that the approximate betterment fee is $2,800 per property owner, which can be payable over five years. Selectmen's Reports/Comments. Mr. Bennett spoke on the landfill operation. There being no further business before the Board, the meeting was unanimously adjourned at 8:35 PM.
