BOARD OF SELECTMEN
Minutes of the Meeting of 11 May 2005 at 7:00 PM. The meeting took place in the Court Room, Town and County
Building, Nantucket, MA 02554. Members of the Board present were Douglas Bennett, Whiting Willauer, Michael
Glowacki and Brian Chadwick. Bruce Watts was absent. Chairman Glowacki called the meeting to order at 7:05
PM, following a meeting of the Board of Health.
Approval of Minutes of 20 April 2005 at 7:00 PM; 13 April 2005 at 7:00 PM; 11 April 2005 at 4:00 PM; 7 April 2005
at 4:00 PM; 6 April 2005 at 7:00 PM; 30 March 2005 at 7:00 PM; 29 March 2005 at 4:00 PM. The minutes were
approved by unanimous consent of the meeting.
Approval of Minutes of 23 March 2005 at 7:00 PM. The minutes of March 23, 2005 at 7:00 PM, as amended, were
approved by unanimous consent of the meeting.
Approval of Payroll Warrant for Week Ending 8 May 2005. The payroll warrant was approved by unanimous
consent of the meeting.
Approval of Treasury Warrant and Pending Contracts for Week Ending 11 May 2005. The treasury warrant and
pending contracts were approved by unanimous consent of the meeting.
Request for Approval of Preservation Restriction/89 Main Street. Sarah Alger, attorney for the grantor, explained
that the proposed preservation restriction will apply to a single-family residence located at 89 Main Street and the
grantors are Richard and Pamela Merriman. Ms. Alger explained the specifics of the restriction and noted that
Nantucket Preservation Trust, Inc. will be the holder of the restriction. Mr. Bennett moved to approve the
preservation restriction; seconded by Mr. Chadwick. So voted.
Liquor Licensee: Request to Operate Business on Sundays from May 28, 2005 - October 9, 2005/Hatch's Package
Store. Town Administrator Libby Gibson stated that it has been determined that liquor licensees no longer need
approval from the local licensing Board to conduct Sunday liquor sales, and this agenda item has been withdrawn.
Citizen Request for Appeal of Building Permit Fine. Lisa Botticelli, architect for property owners at 14 Lincoln Street,
Siasconset, explained that an "oversight" was made on the calculation of square footage for a basement renovation
and the building permit was not amended to show the basement work before the contractor proceeded with the
interior rough framing, wiring and plumbing. Ms. Botticellti stated that when the error was discovered, the building
permit application was amended
but a fine was imposed for work done without the proper permit. Building Commissioner Bernard Bartlett stated that
the permit allowed for an unfinished basement, but the inspection showed that part of the basement had already
been finished without the building permit. Mr. Bartlett continued that he has reviewed the matter and finds no
reason not to impose a late filing fee of four times the permit cost and asked that the Board support the Building
Department and uphold the fine. After a brief discussion, Mr. Chadwick moved to deny the appeal and uphold the
fine imposed on the property owner; seconded by Mr. Willauer. So voted unanimously.
Planning Board Alternate Resignation. Ms. Gibson noted that Planning Board alternate Joanne Holdgate is
resigning her position, effective May 27,2005. Mr. Chadwick moved to accept the resignation and authorize the
Chairman to send Ms. Holdgate a letter, on behalf of the Board, thanking her for her services; seconded by Mr.
Willauer. So voted.
Town Administrator's Report. Town Administrator Libby Gibson announced that the Steamship Authority will be
holding its monthly meeting on Nantucket tomorrow and noted the time and location. Ms. Gibson also announced
that within the next two weeks homeowners, serviced by the sewer system, will be receiving postcards announcing

forthcoming house inspections as part of the Town's Infiltration/Inflow (1/1) reduction program. Ms. Gibson noted the
inspections will take place during July and August and if customers have questions, they should contact the Public
Works Department. Ms. Gibson concluded by reporting she has received a letter from state Senator Robert O'Leary
who stated he has met with the Commissioner of the Division of Fisheries and Wildlife (DFW) to discuss the
concerns of many island residents about the February deer hunting week. Ms. Gibson noted that DFW plans to hold
a public hearing in the fall to discuss the possible elimination of the February hunt.
Selectmen's Reports/Comments.
1. Board of Selectmen Appointments to Work Groups/Committees. Mr. Bennett moved to appoint the following
Board members as representatives to various workgroups and committees: Mr. Bennett - Grant Review Committee,
Bulk Fuel Study Committee, Nantucket Housing Alliance and Pilgrim RC&D; Mr. Glowacki - Capital Program
Committee; Mr. Chadwick - Community Preservation Committee, Mid-Island Partnership, Sconset Planning
Committee, Our Island Home Strategic Planning Work Group and 2 Fairgrounds Reuse Work Group; Mr. Willauer-
Town Government Study Committee, Nantucket Housing Alliance and Madaket Harbor Watershed Work Group; Mr.
Watts - Mid-Island Partnership and Bulk Fuel Study Committee; seconded by Mr. Chadwick. So voted.
2. Presentation by Interim Planning Director of Potential Options to Address Growth. Interim Planning Director
Andrew Vorce gave a presentation that included a review of the present Nantucket Planning & Economic
Development Commission (NP&EDC), a brief history of the NP&EDC and Planning Board, and provided the Board
with an organizational chart for the NP&EDC. Mr. Vorce also spoke on the elements of Chapter 41-81 D (master
plan). Mr. Vorce addressed the challenges of writing zoning bylaw changes, noting the flaws that affected warrant
articles in the recent April Town Meeting. Mr. Vorce stated that growth-related questions would be mailed to citizens
this year as part of the Town Clerk's annual town census questions, and he hoped citizens would provide warrant
articles for the 2006 A TM early in the process so potential flaws can be worked out well in advance of Town
Meeting. Also speaking on this matter were Land Council executive director Cormac Collier, Nantucket residents
Rick and D. Anne Atherton, and Planning Board chairman Don Visco. Mr. Willauer questioned what authority the
selectmen have to control growth and some discussion followed concerning this issue. Chairman Glowacki thanked
Mr. Vorce for his presentation and stated that Mr. Vorce will return to the Board in approximately six weeks to
further discuss ways in which the town currently controls growth and options for change.
There being no further business before the Board, the meeting was unanimously adjourned at 8:15 PM.
