DECISION:
1. At a public hearing of the Nantucket Zoning Board of Appeals on
Thursday, November 13, 2008, at 1:00 P.M., at 2 Fairgrounds Road, Nantucket,
Massachusetts, the Board made the following Decision on the Application in
Zoning Board of Appeals File No. 055-08 of Bernard P. Cooney, III, 495 W.
Broadway 5N, New York, NY 10042.
2. Applicant is requesting Special Permit relief pursuant to Nantucket
Zoning Bylaw Section 139-33A(4) (altering pre-existing, nonconforming
structures and uses) in order to build vertically on the footprint of the existing
garage and to change the existing use from a garage to a studio. The existing
garage will be raised to about 16.6 feet from its existing height of about fourteen
(14) feet. The existing garage is located as close as three (3) feet from the side
yard setback in a zoning district that requires a five (5) foot side yard setback.
Additionally, the Applicant is requesting to modify his existing Special Permit to
validate the existing height of the dwelling to be no more than twenty-four (24)
feet.
The site is located 19 WEST YORK LANE, is shown on Nantucket Tax
Assessor's Map 55 as Parcel 335, is shown on Land Court Plan 13302-G, and is
recorded at the Nantucket County Registry of Deeds in Book 911, Page 23.
3. Our Decision is based upon the Application and accompanying
materials, representations and testimony received at our public hearing. The
Planning Board made no recommendation finding that the Application did not
present any issues of planning concern. Abutter comment was received against
the garage having any habitable space.
4. Applicant, through representation, stated that there were two
issues involved in this application. The first of which is that the Applicant is
requesting to modify the existing Special Permit in ZBA File No. 063-04 to
validate the height of the structure. The language in ZBA File No. 063-04 stated
that the height of the structure shall be about 22 feet. Presently, the average
mean building height is 22.9 feet.
Further, the Applicant is requesting to increase the height of his
non-conforming garage to about sixteen (16) feet and to change the use from a
garage to a studio. After listening to some of the comments from his abutters,
the Applicant agreed to the condition that there shall be no habitable space
present in the new studio.
5. The Board finds that such a change and alteration of the pre-
existing, nonconforming structure is not substantially more detrimental than the
existing nonconforming use to the neighborhood, provided that there shall be no
habitable space in the studio structure. Further, the Board finds that modifying
the existing Special Permit to allow an average mean height of 22.9 feet for the
dwelling structure is in harmony with the general purpose and intent of the
Zoning By-law.
8. Accordingly, by a motion made and duly seconded to GRANT the
requested relief by SPECIAL PERMIT pursuant to Nantucket Zoning Bylaw
Section 139-33A(4) to build vertically on the footprint of the existing garage, to
change the existing use from a garage to a studio, and to modify the Special
Permit in ZBA File No. 063-04 to validate the existing height of the dwelling to be
no more than twenty-four (24) feet. There were four votes in favor and one
opposed (Cross). Subsequently, relief was granted with the following conditions:
(a) The height of the structure shall remain in substantial compliance
with the plan labeled "Building Height Determination Plan,"
Prepared by Bracken Engineering, dated October 28, 2008, attached
herewith as "Exhibit A."
(b) There shall be no habitable space in the studio structure.
(c) There shall be no exterior work between May 15th and Labor Day,
of any year.
(d) All work shall be done in accordance with the plans approved by
Nantucket Historic District Commission Certificate of Approval
No. 52905, as may be amended from time to time.
