NANTUCKET ZONING BOARD OF APPEALS 37 Washington Street Nantucket, Massachusetts 02554 Assessor's Map 56, Parcel 297 44 Meadow View Drive Residential-2 Land Court Plan 14830-Q Lot 63 Certificate of Title No. 18441 DECISION: 1 r At a public hearing of the Nantucket Zoning Board of Appeals, on Friday, May 11, at 1:00 P.M., in the Conference Room, in the Town Annex Building, 37 Washington Street, Nantucket, Massachusetts, the Board made the following decision on the application of RONALD C. CURRAN and JOAN P. CURRAN, c/o Redde, Gullicksen, Hanley & Gifford, LLP, Post Office Box 2669, Nantucket, Massachusetts 02584, File No. 038-01: 2. The applicants are seeking a SPECIAL PERMIT under Nantucket Zoning By-law ~139-16.C(1), to reduce side yard setback from ten feet to five feet. The applicants propose to construct an addition to the southeasterly side of their existing single- family dwelling. The subj ect property (the "Locus") is conforming with all zoning requirements and the proposed addition would conform in all other respects. The proposed addition is said to be situated in the only location where it could be placed with regard to the required separation of 50 feet from the boundaries of wetlands resource areas under the Wetlands Protection Regulations adopted by the Nantucket Conservation Commission. The Locus is situated at 44 MEADOW VIEW DRIVE, Assessor's Map 56, Parcel 297, is shown on Land Court Plan 14830- Q as Lot 63" and is situated in a Residential-2 zoning district. 3. Our decision is based upon the application and accompanying materials, and representations and testimony received at our public hearing. There .was no Planning Board recommendation, on the basis that the application was not of planning concern. There was no support nor opposition presented at the public hearing. 4. As shown upon the plan presented by the applicants titled Z.B.A. Site Plan, as prepared by Nantucket Surveyors, Inc. dated March 3, 2001, a reduced copy of which is attached hereto as Exhibit A, the area of the Locus which may be built upon in the light of present wetlands and health regulations is extremely limited. The wetlands regulations promulgated by the Nantucket Conservation Commission prohibit building within 50 feet from a wetlands boundary, and the health regulations under Massachusetts Title 5 and the corresponding local provisions require separation of new construction by 20 feet from an existing leach pit. This leaves a small area at the southeasterly corner of the existing ., dwelling. The applicants informed the Board of Appeals at the public hearing that they desire to build a modest single-story addition to their small existing dwelling, which has ground cover of only about 882 square feet, in order to provide additional living space for their family use. Expansion into the 10-foot side yard setback on the southeasterly side of the dwelling would assist in providing more space for this addition. The Locus would continue to meet all other dimensional zoning requirements. 5. In the Residential-2 zoning district, required side yard setback is ten feet; however, Zoning By-law ~139-16.C(1) expressly provides that this may be reduced to five feet by Special Permit by the Board of Appeals, as special permit granting authority. In this case, the abutter toward whose property line the intrusion is proposed has not objected, and1the dwelling on the abutting property is nearly seventy feet from the nearest point of the proposed addition. The Nantucket Historic District Commission ("HDC") has already issued Certificate of Appropriateness No. 37425 approving the proposed addition, and the Nantucket Conservation commission has issued an Order of Conditions in DEP File No. SE48-1443 authorizing its construction. 6. Considering the factors set forth in Paragraph 5 of this Decision, and the small size of the dwelling and the proposed addition, the Board of Appeals, by UNANIMOUS vote, made the finding that the proposed addition would be in harmony with the general purpose and intent of the Zoning By-law, and accordingly GRANTED the requested SPECIAL PERMIT, reducing the required side yard setback from the southeasterly boundary line of the Locus from ten feet to five feet in order to permit the proposed addition, upon-the following conditions: (a) The proposed addition shall be constructed in substantial conformity with Exhibit A and the plans submitted in connection with Certificate of Appropriateness No. 37425 issued by the HDC, as may be amended from time to time; and (b) No further construction shall be permitted within the ten-foot side yard setback without further relief from the Board of Appeals.
