1. At a public hearing of the Nantucket Zoning Board of Appeals on Friday,
February 8,2008, at 1:00 P.M., at 2 Fairgrounds Road, Nantucket, Massachusetts, the
Board made the following Decision on the Application in Zoning Board of Appeals File
No. 117-07 of TERRY GRODEN, 18 Towaddy Lane, Nantucket, Massachusetts 02554.
2. The applicant is seeking Special Permit relief under Zoning Bylaw 139-
16(C) (reduce the ten-foot side and rear lot setback distance from ten feet to five feet) to
allow for the construction of a garage. The applicant wishes to enter said garage from the
access road behind his dwelling so to allow enough room so that garage does not
encroach upon the existing dwelling.
The site is located at 18 Towaddy Lane, is shown on Tax Assessor's Map 49.3.2
as Parcel 15, and is recorded in the Nantucket County Registry of Deeds in Book 790,
Page 112.
3. Our Decision is based upon the Application and accompanying materials,
representations and testimony received at our public hearing. The Planning Board made
no recommendation finding that the Application did not present any issues of planning
concern. No abutter comment was received either in favor of or against the application.
The staff recommended the Board review the siting of the proposed garage and consider
requiring the applicant to site it closer to the dwelling in order to eliminate the setback
intrusion.
4. Applicant represented that he is proposing to construct a garage that will
be sited in the setback. The proposed garage will be twenty (20) feet by sixteen (16) feet.
The garage is proposed to be sited twenty (20) feet from the rear lot line and 5.5 feet from
the side lot line in a district that requires ten (10) foot side and rear yard setbacks. The
Board centered their discussion on how this garage will impact the neighborhood and the
rationale behind constructing the garage in the setback. The Board found that the
construction would not be substantially more detrimental to the neighborhood and that the
reduction in rear and side yard setback in the R2 Zoning District is in harmony with the
general purpose and intent of the Nantucket Zoning Bylaw Section 139-16C(I).
5. Accordingly, by a vote of 4-1 (Sevrens opposed), the Board of Appeals
voted to GRANT the requested relief by SPECIAL PERMIT pursuant to Nantucket
Zoning Bylaw Section 139-16 (C) to reduce the southerly side yard setbacks from ten (10)
feet to 5.5 feet allowing the construction of the garage within the setback with the
following conditions:
a) The garage will be constructed no larger than sixteen (16) feet by
twenty (20) feet, which is a maximum ground cover of 320 square
feet. The maximum height shall be no higher than fourteen (14)
feet. Any increase of said dimensions shall require a modification
to the special permit;
b) There will be no parking in the access way along the rear of the lot;
and
c) All improvements shall be constructed in substantial compliance
with the site plan entitled "Plan for Proposed Garage in Nantucket,
MA" prepared by Joe Marcklinger and dated November 14,2007
and attached hereto as Exhibit A.
