as to be received within such TWENTY (20) days.

At a Public Hearing of the Nantucket Board of Appeals held at 1 :00 p.m., Friday,
December 14,2007 at 2 Fairgrounds Road, Nantucket, Massachusetts, on the Application
of NEIL MARTTILA and ANDREA RUSSELL, 48 Meadow View Drive, Nantucket,
MA (Board of Appeals File No. 105-07) the Board made the following Decision:
1. Applicant is seeking SPECIAL PERMIT relief under Nantucket Zoning By-Law
Section 139-16 (C) (1) (Special Permit to reduce the ten-foot side and rear lot setback
distance in Districts R-lO and R-2 from 10 feet to 5 feet). Applicant is seeking a Special
Permit to validate stairs on the northwesterly side of the structure, which, at its closest
point, is 9.0 feet from the property line in a zoning district that requires a 10.0 foot side
yard setback. In all other respects, the existing structure is conforming with an existing
ground cover of 4.7% in a zoning district that has an allowable ground cover of 12.5%.
The lot size is also conforming with an area of 20,050 square feet in a zoning district that
requires 20,000 square feet. The premises are located at 48 Meadow View Drive,
Assessors Map 56, Parcel 299. The property is zoned R-2.
2. This Decision is based upon the Application and materials submitted with it,
along with the testimony and evidence presented at the hearing. The Planning Board did
not make a recommendation, and there was no comment from the Zoning Board staff.
There was no opposition to this Application. There were also photographs submitted by
Applicant's counsel showing the existing structure, and the stairs.
3. Applicant, through counsel, represented that the existing structure was built in
1986, and, at that time, the owner applied for and received a Certificate of Occupancy
notwithstanding the fact that the as-built showed the stairs 4.5 feet from the property line.
The then owner removed a portion of the stairs that were in the setback, and it was not
learned until the recent sale to Applicant that there was still a one-foot setback violation.
Applicant is doing substantial interior work on the property, and is desirous of curing this
violation by obtaining relief to allow the stairs to remain in its present location
4. Therefore, based upon the foregoing, the Board finds that the proposal to allow
the existing stairs to remain in its present location is not detrimental to the neighborhood,
and is within the spirit and intent of this section of the Bylaw.
5. Accordingly, the Board voted to GRANT (5-0) the requested Special Permit relief
under Section 139-16 (C) 1.

Addendum
Applicant is seeking SPECIAL PERMIT relief under Nantucket Zoning By-Law
Section 139-16 C(1). (The Board may grant a Special Permit to reduce the ten-foot
