J 1. The applicant is proposing to construct a new structure and is seeking a variance pursuant to Zoning Bylaw section 139-32 to waive the maximum height requirement of thirty (30) feet pursuant to Zoning Bylaw section 139-17. The site is located at 2 Fairgrounds Road, is shown on Nantucket Tax Assessors Map 67 as Parcel 40, and is shown on Certificate of Title No. 21348. The Applicant is proposing to construct a new Municipal Safety Facility that will include the Nantucket Fire and Police Departments. The new facility will require the housing of all fire apparatus for the Town of Nantucket and the equipment requires sixteen (16) feet of door clearance. Additionally, the size of the doors and associated building size results in a roof pitch that will exceed HDC limits. The facility will also include fire fighting training space, a hose tower, firefighter quarters, and a communications area/antenna. Because of these proposed additions, the Applicant is seeking relief from the building height limitations to extend the height limit of thirty (30) feet to forty-five (45) feet for the maximum height to the top of the roof and to forty-eight (48) feet for the maximum height to the top of the cupola. 2. The Decision by the Nantucket Zoning Board of Appeals (hereinafter referred to as the "Board") is based upon the Application and accompanying materials submitted by the Applicants with said Application and the testimony and evidence presented by the Applicants at the hearing on November 16, 2007. 3. Applicants, for themselves, argued in front of the board that in order for the equipment to be properly stored in the new facility a height variance would be necessary. The Board found that in order for the new facility to properly house the equipment, the requested variance is appropriate. In addition, the applicants indicated that a multiple access driveway was required for safe traffic flow and emergency access at the site. Thus, due to the proposed conditions and design/shape of the structure, and the requirement for public safety access, the Board found that a literal enforcement of the zoning code would result in a substantial hardship to the appellant and a variance was the appropriate relief There was concern from an abutter that the location of the new facility would create a nuisance for her because the lights from the fire trucks would shine into her window. 1 Accordingly, at the hearing on November 16,2007, by a UNANIMOUS VOTE, the Board voted to GRANT the requested VARIANCE to allow for: 1) The forty-eight (48) foot maximum height for the cupola; 2) The forty-five (45) foot maximum height for the top ofthe roofline; and 3) The multiple driveway access limited to three (3) curb cuts for this proposed use on the site; all granted under Nantucket Zoning By-Law Section 139-32.
