1. Applicant is seeking SPECIAL PERMIT relief under Nantucket Zoning By-Law
Section 139-33A (pre-existing, nonconforming uses, structures and lots). Applicant
proposes to extend a previously constructed second floor deck on the easterly side of the
structure approximately 16 feet 6 inches to be flush with the easterly comer of the
existing house. Applicant also proposes to construct a first floor deck directly under the
proposed second floor deck. The extension of the second floor deck, and the building of
the first floor deck will not encroach further into the setback, and will not create any
additional nonconformities. The existing structure is nonconforming as to side yard
setback with the structure. The structure is located, at its closest point, 6.4 feet from the
property line in a zoning district that requires a minimum side yard setback of 10 feet.
The lot is nonconforming with an area of 10,309 square feet in a zoning district that
requires 20,000 square feet. The structure was built in 1965, which predates the zoning
by-law. In the alternative, Applicant seeks SPECIAL PERMIT relief under Section 139-
l6C(1) (The Board may grant a Special Permit to reduce the ten-foot side and rear lot
setback distance in Districts R-I0 and R-2 from 10 feet to 5 feet). The Premises is
located at 96 Baxter Road, Siasconset, Massachusetts, Assessor's Map 48, Parcel 44,
Land Court Plan No.12839B. The Property is zoned R-2.
2. This Decision is based upon the Application and materials submitted with it,
along with the testimony and evidence presented at the hearing, where testimony was
taken. The Planning Board did not make a recommendation, nor did the Zoning Board of
Appeals staff. There was no opposition to this application, and there were eight (8)
letters of support from abutters, including a letter from the abutter at 98 Baxter Road,
who is most affected by the expansion of the deck. There was also an affidavit entered
into the record stating that this structure, in its present configuration, is exactly the same
configuration as it was in the late 1960's prior to the enactment of the zoning by-law.
3. Applicant, through counsel, represented that the HDC has approved the plans for
the extension of the second floor deck and the construction of the first floor deck.
Applicant has also received an Order of Conditions from the Conservation Commission
for this project. There was no opposition at the meeting to the requested relief.
4. Therefore, based upon the foregoing, the Board finds that the proposed alteration
will not be substantially more detrimental to the neighborhood than the existing non-
conforming structure.
5. Accordingly, the Board voted to GRANT (4-1, Sevrens opposed) the requested
reliefby SPECIAL PERMIT under Section 139-33A.
