NANTUCKET ZONING BOARD OF APPEALS TWO FAIRGROUNDS ROAD NANTUCKET, MASSSACHUSETTS 02554 Assessors Map 55 Parcel 338 ROH 18 New Street Book 1067, Page 240 At a Public Hearing of the Nantucket Zoning Board of Appeals held on November 16, 2007, at 2 Fairgrounds Road, Nantucket, Massachusetts, on the Application ofILIY A SIMEONOV, of 18 New Street, Nantucket, Massachusetts, Board of Appeals File No. 093-07, the Board made the following Decision: 1. The applicant is seeking to validate the alteration of a pre-existing nonconforming use on the site so that the applicant may convert the existing duplex to a single family dwelling and then construct a second dwelling on the site and maintain the pre-existing nonconforming use status. The applicant is seeking a special permit pursuant to Zoning Bylaw section 139-33 for pre- existing, nonconforming uses, structures, and lots. The site is located at 18 New Street and is shown on Nantucket Tax Assessors Map 55 as Parcel 338 and in Nantucket Registry of Deeds Book 1067, Page 240. The subject Property is located in the Residential Old Historic (ROH) zoning district and is improved with a two family structure which pre-dates the 1972 enactment of the Nantucket Zoning Bylaw. The required minimum lot size in the ROH district pursuant to intensity regulations under Section 139-16 of the Bylaw is five thousand (5000) square feet. The Property is oversized, having a lot area of approximately 7,700 square feet. The maximum ground cover allowable for the Property pursuant to Section 139-16 is fifty (50%) percent of the lot size. The required side yard setback in the ROH district is five (5) feet. The Property is nonconforming with respect to use (two family duplex in ROH, as well as to side yard setbacks [0.0 feet from the Westerly boundary] as shown on an As-built Plot Plan prepared by Bennett Engineering dated February 16,2006. The applicant has produced an affidavit from Gail L. Po1chinski dated October 27,2006 which states that Ms. Po1chinski is personally familiar with the structure on the premises since prior to 1972, and the structure on the premises has always been used as a single two-family dwelling with two separate kitchens. The Applicant has obtained a Certificate of Appropriateness from the Nantucket Historic District Commission to renovate the existing structure on the Property and add a conforming addition; (See HDC Certificate of Appropriateness #50833 dated August 7, 2007). The existing structure with conforming additions will have a ground cover of 1,479 square feet. The Applicant intends to maintain the existing structure as a single family residence. The Applicant will also need HDC approval to construct a second, single family structure on the premises. The new structure will have a ground cover of 1,148 square feet as proposed. The applicant plans to build the second structure on the premises with a customary kitchen and seeks to move the apartment from the nonconforming duplex to the second structure. The secondary structure will conform to all intensity regulations set forth in the Bylaw. Accordingly, the Applicant is seeking to validate the alteration of the pre-existing nonconforming use pursuant to 139-33A to include Simeonov 1 the kitchen in the secondary structure while maintaining its pre-existing status. The Applicant then intends to convert the title to the Property to a condominium form of ownership based upon the pre-existing status of the two family units on the premises. Granting the proposed Special Permit will not be more detrimental to the neighborhood than the existing nonconforming duplex. The lot on which the applicant proposes the alteration in use is oversized containing approximately 7,700 square feet oflot area in a district which requires 5,000 square feet and all additions will conform to the Bylaw intensity regulations. In addition, many of the surrounding properties are undersized and some contain secondary dwellings both in common and separate ownership: (Lot area of 14 New Street measures approximately 2,200 square feet); (20 New Street measures approximately 3,000 square feet); (13 New Street is a 10,000 square foot lot containing 3 condominium units and a studio). Therefore, the relief requested is not substantially more detrimental to the neighborhood than the existing duplex and by granting the requested Special Permit, the Board will be acting in a manner consistent with the spirit and intent of the Zoning Bylaw. 2. The Decision by the Nantucket Zoning Board of Appeals (hereinafter referred to as the "Board") is based upon the Application and accompanying materials submitted by the Applicants with said Application and the testimony and evidence presented by the Applicants at the hearing on November 16,2007. 3. Applicants, through counsel, represented that the relief requested was similar to a previous decision by the Board in 2000 (25 Sankaty Avenue - ZBA File No. 033-00). Applicants proposed that because of the above-referenced decision, the demolition and reconstruction of the dwellings is similar enough to the prior decision to warrant the relief requested. The Zoning Enforcement Officer countered this by reminding the Board that upon demolition, the nonconforming status is thereby removed. Upon removal of the nonconforming structure, the lot and future structures would no longer receive the benefit of the nonconforming status. Therefore, the requested relief by the applicants is not appropriate and should not be granted by the Board. 4. Accordingly, at the hearing on November 16,2007, a motion to approve the requested relief was made based on the finding that the requested relief would not result in a situation that was more nonconforming nor detrimental to the neighborhood than the existing situation as outlined above. The Board voted none in favor and 5 opposed (0-5) and therefore the motion to approve failed resulting in the Board voting AGAINST the requested SPECIAL PERMIT, under Nantucket Zoning By-Law Section 139-33A.
