DECISION:
1. At a public hearing of the Nantucket Zoning Board of
Appeals, on Friday, October 19, 2007, at 1:00 P.M., in the
Conference Room, at 2 Fairgrounds Road, Nantucket, Massachusetts,
the Board made the following decision on the application of
DURVAN C. LEWIS and MARIA S. HENRY-LEWIS, c/o Patricia A.
Halsted, Attorney, Four North Water Street, Nantucket,
Massachusetts 02554, File No. 090-07:
2. The Applicant is proposing a commercial structure on
property located at 49 Nobadeer Farm Road, shown on Nantucket Tax
Assessors Map 69 as Parcel 101 and on Land Court Plan No. 16514-
31 as Lot 576. The Applicant is seeking SPECIAL PERMITS pursuant
to the following sections of the Zoning Bylaw: 139-9B(2) (a) for
light manufacturing; 139-B(2(b) for storage and warehousing,
including properly screened open storage of good and materials;
139-B (2) (c) for fabrication and assembly of component parts for
off-site construction or use; and 139-20 for a waiver of the
loading zone.
3. Our decision lS based upon the application and
accompanying materials, and representations and testimony
received at our public hearing. The Planning Board did not make
a recommendation. No one spoke in opposition to the application.
4. Applicant, through counsel, represented that he runs a
painting business and wishes to construct a building for
storage/warehousing shop space for the business. All parking
requirements would be satisfied. Deliveries to the Premises are
rare, except for the occasional door and window that need to be
painted. Applicant would install appropriate plantings to
satisfy the screening requirements.
5. The Board finds that granting the requested relief and
waiving the loading zoning requirement would not result In a
substantial detriment to the neighborhood. Several structures in
this zoning district have storage/warehousing shop space.
6. According, the Board of Appeals, by a UNANIMOUS vote,
GRANTS the requested SPECIAL PERMIT relief under Nantucket Zoning
Bylaw 139-9B(2) (a) for light manufacturing; SPECIAL PERMIT relief
under Nantucket Zoning Bylaw 139-9B(2) (b) for storage and
warehousing, including properly screened open storage of goods
and materials; SPECIAL PERMIT relief under Nantucket Zoning Bylaw
139-9B (2) (c) for fabrication and assembly of component parts for
off-site construction or use; and SPECIAL PERMIT relief under
Nantucket Zoning Bylaw 139-20 waiving the required loading zone
upon the following conditions:
a) No work will be performed after 6:00 PM and no work will
be performed on Sundays.
b) The special permits granted pursuant to Zoning Bylaw
139-9B(2)a,b,c shall be limited to the use of the
property as a Painting business as represented by the
applicant and other uses are prohibited without a
modification of this special permit.
c) The applicant shall install plantings for screening
purposes as shown on the site plan prepared by Brook
Meerbergen Drafting & Design, attached hereto as Exhibit
A.

fabrication and assembly of component parts for off-site
construction or use) in order to build a
