DECISION:
1. At a public hearing of the Nantucket Zoning Board of Appeals, on Friday,
September 14, 2007, at 1:00 P.M., in the Conference Room, in the former Electric Company
building, 2 Fairgrounds Road, Nantucket, Massachusetts, the Board made the following decision
on the application of ANTJE L. FARBER, c/o Reade, Gullicksen, Hanley & Gifford, LLP, Post
Office Box 2669, Nantucket, Massachusetts 02584, File No. 086-07:
2. The applicant is seeking a MODIFICA nON of the SPECIAL PERMIT relief
granted pursuant to Nantucket Zoning By-law Section 139-33.A in the Decision in Board of
Appeals File No. 028-83, which was modified in the Decision in File No. 028-92 and further
modified in the Decision in File No. 004-97, which also granted relief by VARIANCE. The
previous Decisions allowed the expansion and alteration of the existing single-family dwelling.
The applicant now proposes to expand the existing ground cover ratio of about 69.6% (about 846
square feet of ground cover) to about 71.0% (about 863 square feet) in a district in which the
maximum ground cover ratio for undersized lots of 30%. The new addition would come no
closer to the southerly rear lot line than the existing structure. The lot is also nonconforming as
to lot area, containing about 1,215 square feet, with the minimum lot size in this zoning district
being 5,000 square feet; as to frontage, with the lot having frontage of about 30 feet on Old North
Wharf, with the minimum in this zoning district being 40 feet; as to parking, with no parking
being provided on-site; and as to side and rear yard setbacks, with the dwelling being sited as
close as about 0.78 foot to the westerly side lot line, as close as about one foot to the easterly side
lot line, and as close as about one foot to the rear lot line, with the minimum side and rear yard
setback in this district being five feet. The locus is situated at 21 OLD NORTH WHARF,
Assessor's Map 42.3.1, Parcel 28, is shown upon plan recorded with Nantucket Deeds in Plan
File 41-J, and is situated in a Residential-Commercial zoning district.

3. Our decision is based upon the application and accompanying materials, and
representations and testimony received at our public hearing. There was no Planning Board
recommendation, on the basis that no matter of planning concern was presented. Except for the
presentation by counsel to the applicant, there was no support nor opposition presented at the
public hearing.
4. The applicant proposes to construct a second-floor addition to the existing dwelling
upon the locus, which has as noted above been altered in accordance with several Board of
Appeals decisions. This addition would involve construction within the southerly rear yard
setback area, with which as noted above the existing dwelling is nonconforming, being sited
within about three feet from the rear lot line. However, the addition would fill in an existing
portion of the dwelling and would not extend further toward the lot boundary. In addition,
ground cover would be increased by about 16.5 square feet, bringing the ground cover ratio from
the present 69.6:1:% to 71.0:1:%. The remainder of the addition will be over areas of the dwelling
now counted as ground cover.
5. Prior decisions, as cited above, recognized the unusual nature of the locus and the
constraints upon its siting. The dwelling is one of several cottages upon Old North Wharf which
are privately owned upon separate lots, and not part of the Old North Wharf Cooperative. The
proposed changes have been approved by the Nantucket Historic District Commission ("HDC"),
and no opposition to the project has been received.
6. Based upon the foregoing considerations, the Board of Appeals, by UNANIMOUS
vote, took the following actions:
(a) It made the finding that the proposed alterations and expansion would
intensify the existing nonconformities upon the locus;
(b) It made the finding that the proposed alterations and expansion would not
be substantially more detrimental to the neighborhood than the existing nonconformities; and
(c) Subject to the conditions set forth in Paragraph 7, it GRANTED relief by
MODIFICATION of the existing SPECIAL PERMITS affecting the locus, to permit construction
of the work as proposed.
7. The relief hereby granted is subject to the following conditions:
(a) All work shall be done in substantial conformity with the plans as
approved by the HDC under Certificate of Title No. 50792; and
(b) No exterior work shall be performed between May 15 and October 15 in
any year.

The applicant requests a Modification of the Special Permit issued in File No.
028-83, as amended in Files Nos. 021-92 and 04-97, and a Special Permit under
Nantucket Zoning By-law ~ 139-33.A, for the alteration of a pre-existing,
nonconforming single-family dwelling, in order to construct an addition to the
existing dwelling which will involve work being done within the southerly rear
yard setback area of five feet, as close as about three feet to the rear lot
line. The work will also increase ground cover of the structure from about
846 square feet by about 16.5 square feet, for a total of about 863 square
feet of ground cover; the locus contains about 1,215 square feet of lot area,
with the minimum lot area being 5,000 square feet in the zoning district. The
ground cover ratio would thus be increased from about 69.6% to about 71.0%;
the maximum for an undersized lot of record in this zoning district is 30%.

DECISION:
1. At a public hearing of the Nantucket Zoning Board of
Appeals, on Friday, January 10, 1997, at 1:00 P.M., in the
Selectmen's Meeting Room, in the Town and County Building, Broad
Street, Nantucket, Massachusetts, the Board made the following
decision on the application of LEONARD L. FARBER AND ANTJE L.
FARBER, c/o Reade & Alger Professional Corporation, Post Office
Box 2669, Nantucket, Massachusetts 02584, File No. 04-97:
2. The Applicants request modification of the Special
Permit issued in Case 028-83, modified in Case No. 082-91, to
permit further alteration to the dwelling upon the locus, an
undersized lot containing 1,215 square feet in a district
requiring minimum lot area of 5,000 square feet, consisting of
upward alteration of the structure within the existing footprint,
not exceeding the maximum height of 30 feet, by up to three feet
in order to comply with flood hazard zone building requirements,
and construction of steps and ramps to the doors upon the
structure within the required side and rear yard setback areas
with which the building is nonconforming (being at the closest
point 3.15 feet from the northeasterly side lot line, 3.21 feet
from the southeasterly rear lot line, and 0.89 feet from the
southwesterly side lot line), the proposed steps and ramps to be
built with no setback from these lot lines. No alterations will
increase ground cover as defined in the By-law. In the
alternative, the Applicants request Variance relief from side and
rear setback requirements of five feet under By-law 5139-16.A, to
validate the existing structure and permit the proposed steps and
ramps to be built. In addition, to the extent required, on the
basis that the proposed alterations will constitute an
enlargement of the structure, the Applicants request a Special
Permit under By-law 5139-18.B(2), reducing the number of required
parking spaces from one to zero as allowed in the Core and
Resident Parking Permit Districts in which the Locus is situated.
No parking spaces are provided and none physically can be
provided.
The premises are located at 21 Old North Wharf, Assessor's Map
42.3.1, Parcel 28, Plan File 41-J. The property is zoned
Residential-Commercial.

4. The applicants propose to make renovations to the
building in order to bring the structure into compliance with
state and federal flood plain elevation requirements. To complete
such renovations and provide access to the building as elevated,
new landings and stairways must be constructed within side and
rear yard setback areas. The proposed renovations have been
approved by the Historic District Commission under Certificate of
Appropriateness No. 29718. As noted, there is presently no
parking provided upon the Locus, nor could any parking physically
be accommodated upon the Locus.
5. The Board found that expansion of the existing structure
within the footprint would not be substantially more detrimental
to the neighborhood than the existing, nonconformity, and was in
harmony with the general purpose and intent of the By-law. By
unanimous vote, the Board granted the modification of the Special
Permit in Case No. 028-83, as modified by Case No. 082-91.
6. The Board found that owing to circumstances relating to
the shape and topography of the land and buildings especially
affecting the Locus, namely, the coverage of almost the entire
lot by the non-conforming structure and not affecting generally
the zoning district in which the Locus is situated, a literal
enforcement of the provisions of the Zoning By-law would involve
substantial hardship to the Applicant, and that desirable relief
may be granted without substantial detriment to the public good
and without nullifying or substantially derogating from the
intent or purpose of the By-law, therefore, the Board, by
UNANIMOUS vote, granted relief by VARIANCE to validate the
existing structure and allow the construction of the renovations
as proposed.
7. The Board furth~r-finds in connection with the proposed
renovations,that compliance with off-street parking requirements
would be physically impossible for the applicant to provide and
would have a significant and adverse effect on the scenic and
historic integrity of the neighborhood, and that the granting of
a special permit would be in harmony with the general purposes
and intent of the zoning by-law. Accordingly, the Board voted
UNANIMOUSLY to grant the relief by Special Permit to waive the
requirement for providing one off-street parking space In
connection with the proposed renovation.

Decision:
The Board of Appeals, at a public hearing held on Friday,

Nantucket, made the following decision upon the application of
ROBERT HAWKINS as Trustee of WHITE STAR PROPERTIES TRUST (082-9l)

l. This is an application for Modification under Nantucket
Zoning By-law Section l39-29A of the Special Permit granted in
Case No. 028-83 (see Certificate of Granting dated June 9, 1983,
recorded in Book 226, Page 335, at Nantucket Deeds), to allow for
an increase in ground cover of a pre-existing non-conforming
structure by 23 feet, to enable reconstruction of an interior
stairway in conformity with building code requirements. The
subject property (the "Locus") is located at 2l OLD NORTH WHARF
(Assessor's Parcel 42.3.1-028), Plan File 2l-l22, and is zoned
RESIDENTIAL-COMMERCIAL.
2. In Case No. 028-83, special permi t rel ief was granted
to allow for the combination of the then existing structures on
the Locus into one residential dwelling. Pursuant to that
relief, a building permit was secured by the then applicant, and
the structures were combined into one residential dwelling.
Construction under the building permit was completed in 1985, and
Certificate of Occupancy No. 3036-85 issued thereon.
3. Applicant now requests a modification of the relief
previously granted to allow for a 23 foot increase in the ground
cover of the existing structure upon the lot, in order to
reconstruct an interior stairway in conformi ty wi th the state
building code. Applicant informs us that the existing stairway
is narrow, changes direction sharply several times, and does not
have sufficient headroom to enable safe passage.
4. We have received several letters from neighboring
property owners in support of the application and the favorable
recommendation of the Planning Board. No opposi tion has been
made known to us.
5. We have no difficulty finding, and do find, that the
proposed increase in ground cover by 23 feet of the pre-existing
nonconforming structure is a minor modification of the relief

previously granted, and that such increase in the ground cover of
the structure will not be substantially more detrimental to the
neighborhood than the existing nonconforming structure.
6. Accordingly, for the reasons herein stated, this Board
grants a modification of Special Permit relief granted in Case
No. 028-33 to allow for a 23 foot increase in ground cover of the
existing structure, by unanimous vote.

the BOARD finds I

1. This is an application for a rehearing of application
No. 11-8:3 in accordance with SFJJTION 7H6 of tne Zoning By-Law.
The applicant sought previously a variance and special permit to
alter two cottages situate at Old North Wharf. On March 30, 198:3,
the BOARD denied the applicant's requested relief by unanimous
vote. The applicant has obtained unanimous consent for favorable
action on this application after due notice.
2. Based upon review of this application for rehearing,
revised plans, Planning Board recommendation, supporting documents
and testimony at Public Hearing, the BOARD finds that the applicant
has revised significantly his original plans and proposes not to
make the property less non-conforming by increasing side and rear
lot line set back distances. Further, the applicant plans no
increase in ground cover as he did ltln his prior application. These
revisions constitute specific and material changes in the conditions
upon which previous denial of zoning relief was based. Moreover,
the proposed alterations will lessen the intensity in the area since
two structures will be combined and the new construction will improve
safety conditions in the building.
3. For the reasons set forth, the BOARD hereby GRANTS the
applicant a SPFJJIAL PERMIT to alter his cottages in accordance with
