At a public hearing of the Nantucket Zoning Board of Appeals, on Friday, September 14, 2007, at 1:00 P.M., in the Conference Room, in the former Electric Company building, 2 Fairgrounds Road, Nantucket, Massachusetts, the Board made the following decision on the application of ANTJE L. FARBER, c/o Reade, Gullicksen, Hanley & Gifford, LLP, Post Office Box 2669, Nantucket, Massachusetts 02584, File No. 086-07: 2. The applicant is seeking a MODIFICA nON of the SPECIAL PERMIT relief granted pursuant to Nantucket Zoning By-law Section 139-33.A in the Decision in Board of Appeals File No. 028-83, which was modified in the Decision in File No. 028-92 and further modified in the Decision in File No. 004-97, which also granted relief by VARIANCE. The previous Decisions allowed the expansion and alteration of the existing single-family dwelling. The applicant now proposes to expand the existing ground cover ratio of about 69.6% (about 846 square feet of ground cover) to about 71.0% (about 863 square feet) in a district in which the maximum ground cover ratio for undersized lots of 30%. The new addition would come no closer to the southerly rear lot line than the existing structure. The lot is also nonconforming as to lot area, containing about 1,215 square feet, with the minimum lot size in this zoning district being 5,000 square feet; as to frontage, with the lot having frontage of about 30 feet on Old North Wharf, with the minimum in this zoning district being 40 feet; as to parking, with no parking being provided on-site; and as to side and rear yard setbacks, with the dwelling being sited as close as about 0.78 foot to the westerly side lot line, as close as about one foot to the easterly side lot line, and as close as about one foot to the rear lot line, with the minimum side and rear yard setback in this district being five feet. The locus is situated at 21 OLD NORTH WHARF, Assessor's Map 42.3.1, Parcel 28, is shown upon plan recorded with Nantucket Deeds in Plan File 41-J, and is situated in a Residential-Commercial zoning district. 1 3. Our decision is based upon the application and accompanying materials, and representations and testimony received at our public hearing. There was no Planning Board recommendation, on the basis that no matter of planning concern was presented. Except for the presentation by counsel to the applicant, there was no support nor opposition presented at the public hearing. 4. The applicant proposes to construct a second-floor addition to the existing dwelling upon the locus, which has as noted above been altered in accordance with several Board of Appeals decisions. This addition would involve construction within the southerly rear yard setback area, with which as noted above the existing dwelling is nonconforming, being sited within about three feet from the rear lot line. However, the addition would fill in an existing portion of the dwelling and would not extend further toward the lot boundary. In addition, ground cover would be increased by about 16.5 square feet, bringing the ground cover ratio from the present 69.6:1:% to 71.0:1:%. The remainder of the addition will be over areas of the dwelling now counted as ground cover. 5. Prior decisions, as cited above, recognized the unusual nature of the locus and the constraints upon its siting. The dwelling is one of several cottages upon Old North Wharf which are privately owned upon separate lots, and not part of the Old North Wharf Cooperative. The proposed changes have been approved by the Nantucket Historic District Commission ("HDC"), and no opposition to the project has been received. 6. Based upon the foregoing considerations, the Board of Appeals, by UNANIMOUS vote, took the following actions: (a) It made the finding that the proposed alterations and expansion would intensify the existing nonconformities upon the locus; (b) It made the finding that the proposed alterations and expansion would not be substantially more detrimental to the neighborhood than the existing nonconformities; and (c) Subject to the conditions set forth in Paragraph 7, it GRANTED relief by MODIFICATION of the existing SPECIAL PERMITS affecting the locus, to permit construction of the work as proposed. 7. The Applicants request modification of the Special Permit issued in Case 028-83, modified in Case No. 082-91, to permit further alteration to the dwelling upon the locus, an undersized lot containing 1,215 square feet in a district requiring minimum lot area of 5,000 square feet, consisting of upward alteration of the structure within the existing footprint, not exceeding the maximum height of 30 feet, by up to three feet in order to comply with flood hazard zone building requirements, and construction of steps and ramps to the doors upon the structure within the required side and rear yard setback areas with which the building is nonconforming (being at the closest point 3.15 feet from the northeasterly side lot line, 3.21 feet from the southeasterly rear lot line, and 0.89 feet from the southwesterly side lot line), the proposed steps and ramps to be built with no setback from these lot lines. No alterations will increase ground cover as defined in the By-law. In the alternative, the Applicants request Variance relief from side and rear setback requirements of five feet under By-law 5139-16.A, to validate the existing structure and permit the proposed steps and ramps to be built. In addition, to the extent required, on the basis that the proposed alterations will constitute an enlargement of the structure, the Applicants request a Special Permit under By-law 5139-18.B(2), reducing the number of required parking spaces from one to zero as allowed in the Core and Resident Parking Permit Districts in which the Locus is situated. No parking spaces are provided and none physically can be provided. The premises are located at 21 Old North Wharf, Assessor's Map 42.3.1, Parcel 28, Plan File 41-J. The property is zoned Residential-Commercial. 3 _ Our accompanying recei ved at decision is based upon the materials, and representations our public hearing. The application and and testimony Planning Board recommendation was favorable. at the public hearing. There was no opposition presented 4. The applicants propose to make renovations to the building in order to bring the structure into compliance with state and federal flood plain elevation requirements. To complete such renovations and provide access to the building as elevated, new landings and stairways must be constructed within side and rear yard setback areas. The proposed renovations have been approved by the Historic District Commission under Certificate of Appropriateness No. 29718. As noted, there is presently no parking provided upon the Locus, nor could any parking physically be accommodated upon the Locus. 5. The Board found that expansion of the existing structure within the footprint would not be substantially more detrimental to the neighborhood than the existing, nonconformity, and was in harmony with the general purpose and intent of the By-law. By unanimous vote, the Board granted the modification of the Special Permit in Case No. 028-83, as modified by Case No. 082-91. 6. The Board found that owing to circumstances relating to the shape and topography of the land and buildings especially affecting the Locus, namely, the coverage of almost the entire lot by the non-conforming structure and not affecting generally the zoning district in which the Locus is situated, a literal enforcement of the provisions of the Zoning By-law would involve substantial hardship to the Applicant, and that desirable relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of the By-law, therefore, the Board, by UNANIMOUS vote, granted relief by VARIANCE to validate the existing structure and allow the construction of the renovations as proposed. 7. The Board furth~r-finds in connection with the proposed renovations,that compliance with off-street parking requirements would be physically impossible for the applicant to provide and would have a significant and adverse effect on the scenic and historic integrity of the neighborhood, and that the granting of a special permit would be in harmony with the general purposes and intent of the zoning by-law.
