DECISION:
At a public hearing of the Nantucket Zoning Board of Appeals, on Friday,
December 15, 2003, at 1:00 P.M., in the Conference Room in the Town Annex
Building, 37 Washington Street, Nantucket, Massachusetts, the Nantucket
Zoning Board of Appeals made the following Decision on Application (090-03)
of The W AUWINET LAND CORPORATION, of One Wells Avenue, Newton,
Massachusetts 02159, in connection with property located on Wauwinet Road,
Nantucket, Massachusetts.
1. Applicant is seeking relief by SPECIAL PERMIT under Nantucket
Zoning By-law Section 139-33(A) (alteration/expansion of a pre-existing
nonconforming structure/ use). Applicant proposes to demolish an existing
pump house shed and construct a new pump house in substantially the same
location as the existing structure. The shed contains the mechanicals for the
private well water line that services multiple lots in Wauwinet, including the
Wauwinet House. The Locus is conforming as to lot size and frontage, and the
existing shed is conforming as to all setbacks and ground cover. The Locus is
nonconforming as to use, as the existing structure is an ancillary structure on a
lot without a dwelling in a residential zone that does not permit an ancillary
structure on a lot by itself.
The Premises are located on Wauwinet Road, Assessor's Map 12, Parcel
51, Land Court Plan No. 15961-C, Lot 10-D. The property is zoned Residential-I.
2. Our Decision is based upon the Application and accompanying
materials and representations and testimony received at our public hearing. The
Planning Board made no recommendation, finding that the Application did not
present issues of planning concern. No letters were received at the hearing, and
there was no opposition. A representative of the property owner stated that the
water well provided service for about 20 homes to the north of the Wauwinet
Inn, all original cottages associated with the old Wauwinet House, and not for
those located to the south of the well. He added that the system was upgraded in
1997 without any changes having been made to the structure, which appeared to
be old and in bad shape.
3. The Applicant proposes to demolish and rebuild an existing pump
house shed. The shed houses mechanical systems related to a large well on the
Premises, which supplies water to the Wauwinet Inn and many private
dwellings in the Wauwinet neighborhood. The shed is pre-existing, being
clearly visible in its present location and configuration on the 1938 aerial
photograph of the area filed with Town records; and nonconforming, being an
ancillary structure on a lot without a dwelling in a residential zone. The Lot and
structure comply with all dimensional zoning requirements in the Residential-l
zone in which it is situated. The reconstructed shed would be built in
approximately the same location and of approximately the same dimensions as
the existing shed, allowing for some slight shifting of the structure and minor
change in footprint, but would continue to comply with all dimensional
requirements of the Zoning By-law.
4. Therefore, based on the foregoing, the Board finds that replacing
the existing pump house shed with a shed in approximately the same location
and with approximately the same dimensions, allowing for some minor shifting
of the location and alteration of the footprint, provided that it remain
conforming as to ground cover and setbacks, would not be substantially more
detrimental to the neighborhood than the existing nonconformity, and further
finds that relief may be granted without substantial detriment to the public good
or derogation from the Zoning By-law. In addition, the Board finds that the use
in this case is not abandoned with the demolition and reconstruction of the
pump house shed and that the Variance relief contained in the public notice is
not found to be required to complete the project as proposed.
5. The Board of Appeals, upon a UNANIMOUS vote, GRANTS the
requested SPECIAL PERMIT relief under Nantucket Zoning By-law Section 139-
33(A) to demolish an existing pump house shed and construct a new pump
house shed as proposed in approximately in the same location and with
approximately the same dimensions as the existing shed, continuing to maintain
dimensional zoning compliance, upon the following condition:
a. The new pump house shed shall be constructed in
substantial conformance with the Certificate of Appropriateness No.
42,645 issued by the Nantucket Historic District Commission, (with the
demolition being issued in No. 42,608), as may be amended.

sited within the required 20- foot rear yard setback area, and construct a new pump house
shed in substantially the same h>cation as the existing structure. The shed contains the

including the Wauwinet House. In the alternative/in addition, Applicant is seeking relief
by VARIANCE under Section 139-16A to allow the placement of the shed back in the
setback to avoid moving the mechanical system. In addition to the aforementioned, rear
yard setback violation, the Locus is nonconforming as to use, as the existing structure is
an ancillary structure on a lot without a dwelling in a residential zone that does not permit
ancillary structures on a lot by itself; and as to frontage and lot size.
The Premises is located on WAUWINET ROAD, Assessor's Map 12, Parcel 51,
Land Court Plan 15961-C, Lot 10-D. The property is zoned Limited-Use-General-3.
