At a Public Hearing of the Nantucket Zoning Board of Appeals held at 1 :00 P. M.,
Friday, October 17,2003, in the Conference Room, Town and County Annex
Building, 37 Washington Street, Nantucket, MA, on the Application of ALLISON
DILLON KIMMERLE, of 133 Bruning Road, New Hartford, CT 06057, Board of
Appeals Application No. 073-03, the Board made the following Decision:
1. Applicant is seeking relief by SPECIAL PERMIT under Nantucket Zoning
By-law Section 139-33A(8). Applicant proposes to merge two pre-existing
nonconforming lots into one larger, but still nonconforming lot with a total
permitted ground cover of 1,500 square feet. The properties are numbered 1 C
Street (Map 60.2.1, Parcel 34) and 321 Madaket Road (Map 60.2.1, Parcel 35)
and are located within the Residential-2 zoning district, with a minimum of 20,000
square feet required. 1 C Street consists of Lots 126A and 126B and has about
8,000 square feet of lot area, improved with a single-family dwelling and shed.
321 Madaket Road contains about 8,000 square feet of lot area, and is vacant
except for a small encroachment of the aforementioned shed on 1 C Street. When
combined, the resulting lot would have about 16,000 square feet of lot area
without increasing any existing nonconformity.
The Premises is located at 1 C STREET, Assessor's Map 60.2.1, Parcel
34, Land Court Plan 3092-10, Lots 126A and 126B, and at 321 MADAKET
ROAD, Assessor's Map 60.2.1, Parcel 35, Land Court Plan 3092-R, Lot 139. The
property is zoned Residential-2
2. The Decision is based upon the Application and material submitted with it
and the testimony and evidence presented at the hearing. The Planning Board
made no recommendation, as the matter was not of planning concern. There
were no letters on file. There were no abutters present in support or opposed to
the Application at the hearing.
3. Applicant, through counsel, represented that she was seeking relief by
Special Permit under Nantucket Zoning By-law, Section 139-33A (8). Section
139-33A (8) requires that no change in size, shape, boundaries or frontage of
any pre-existing, nonconforming lot shall be done in a manner except only
pursuant to the issuance of a Special Permit. Applicant proposed to merge 1 C
Street, with a lot area of 8,000 square feet and 321 Madaket Road, with a lot
area of 8,000 square feet, which would result in a less nonconforming lot, with a
total lot area of 16,000 square feet. A minimum lot size of 20,000 square feet is
required in the Residential-2 zoning district. There is a house and shed on 1 C
Street and 321 Madaket Road is vacant land except for a small encroachment of
the shed from the 1 C Street property. The latter nonconformity will be cured with
the merger of the lots. Applicant represented that the lots are now technically
merged by record title ownership and that the Applicant is before this Board to
validate said merger.
4. Based upon the foregoing, the Board finds that the merger of the lots is in
harmony with the general purpose and intent of the Zoning By-law and would not
be substantially more detrimental to the neighborhood. Further, the Board finds
that no new nonconformity is created and no existing nonconformity is increased,
in fact the merger makes the combined lots less nonconforming under zoning
creating one lot which may have up to 1,500 square feet of groundcover.
5. Accordingly, by a UNANIMOUS vote, the Board GRANTS, the requested
relief by SPECIAL PERMIT under Nantucket Zoning By-law Section 139-33A(8)
to validate the merger of the lots as presented, resulting in the creation of one
new lot with all of the grandfathered rights allowed under the By-law.

ADDENDUM
The Applicant seeks relief by Special Permit Relief pursuant to Section
139-33 A (8) to merge two (2) pre-existing nonconforming lots into one larger, but
still non-conforming lot with a total permitted ground cover of 1,500 square feet.
The properties are numbered 1 C Street (Map 6021, Parcel 034) and 321
Madaket Road (Map 6021, Parcel 035) and are located within the Residential-II
Zone. 1 C Street described in Certificate of Title No. 16,692 consists of Lots 126-
A and 126-B, shown on Land Court Plan 3092-10, and is 80' by 100' total or
8,000 square feet. There is a house and shed on 1C Street. 321 Madaket Road
described in Certificate of Title No. 20064 consists of Lot 139, shown on Land
Court Plan 3092-R, and is 80' by 100' or 8,000 square feet. 321 Madaket Road is
vacant land except for a small encroachment of the shed from the 1 C Street
property. All of the lots combined will have a total of 16,000 square feet in area.
The property will not be made any more nonconforming as to
groundcover, setbacks or other intensity regulations.
The proposed change is in harmony with the general purpose and intent of
the Zoning By-law and is not substantially more detrimental than the existing
nonconformity (lot area) to the neighborhood.

ADDENDUM
The Applicant seeks relief by Special Permit Relief pursuant to Section
139-33 A (8) to merge two (2) pre-existing nonconforming lots into one larger, but
still non-conforming lot with a total permitted ground cover of 1,500 square feet.
The properties are numbered 1 C Street (Map 6021, Parcel 034) and 321
Madaket Road (Map 6021, Parcel 035) and are located within the Residential-II
Zone. 1 C Street described in Certificate of Title No. 16,692 consists of Lots 126-
A and 126-B, shown on Land Court Plan 3092-10, and is 80' by 100' total or
8,000 square feet. There is a house and shed on 1C Street. 321 Madaket Road
described in Certificate of Title No. 20064 consists of Lot 139, shown on Land
Court Plan 3092-R, and is 80' by 100' or 8,000 square feet. 321 Madaket Road is
vacant land except for a small encroachment of the shed from the 1 C Street
property. All of the lots combined will have a total of 16,000 square feet in area.
The property will not be made any more nonconforming as to
groundcover, setbacks or other intensity regulations.
The proposed change is in harmony with the general purpose and intent of
the Zoning By-law and is not substantially more detrimental than the existing
nonconformity (lot area) to the neighborhood.
