BAKER, of PO Box 2112, Nantucket, MA 02584, Board of Appeals File No. 070-03, the Board made the following Decision: 1. Applicant is seeking relief by SPECIAL PERMIT under Nantucket Zoning By- law Section 139-9B(2)(a), (b) and (c) to operate his construction business from the first floor of the mixed-use building. The structure also contains one apartment that is situated on both the second and third floors. The Locus is conforming to all dimensional zoning requirements and all parking and the loading zone would be provided on site. There would also be outdoor storage of materials that would be properly screened and is allowed by Special Permit under Section 139-9B(2)(b). The Premises is located at 1 'h (or IB) MARY ANN DRIVE, Assessor's Map 68, Parcel 493, Land Court Plans 16514-T, 16514-39 and 16514-45 (pending), Lot 676. The property is zoned Residential-Commercial-2. 2. The Decision is based upon the Application and the materials submitted with it and the testimony and evidence presented at the Hearing. The Planning Board made no recommendation finding that the matter did not present any issues of planning concern. There was one letter on file that expressed concern about drainage and screening of the property from the street and neighbors. 3. The Applicant represented that the property is situated in a mixed-use residential- commercial area and that the Board had granted several Special Permits in the immediate area for similar uses. Applicant stated that he had constructed his building with the intent of using the first floor in conjunction with his renovation business, with one apartment above that was comprised of space on the second and third floors. When he went for the Certificate of Occupancy the Building Department noted the ancillary outdoor storage area and requited that the Applicant come to this Board for the proper permits. To assuage the concerns expressed in the neighbor's letter, the Applicant has installed a "French drainage" system as requested by the Director of the Wannacomet Water Company, cleaned up the yard area and provided privet hedge screening. Applicant has also received permission from the Historic District Commission for the installation of a six-foot fence that would run almost the entire length of the northerly and southerly property lines dropping to 40" towards the front of the Lot, as well as a portion that would run in a north to south direction in the middle of the Lot to screen the outdoor storage area. Applicant redesigned the parking area and access to maintain the existing trees on the Lot to the extent possible, and will provide four parking spaces (three are required for the uses) as well as a loading zone on site all as shown on "Proposed Site Plan A", done by Richard K. Earle of Nantucket Surveyors, Inc., dated Oct. 15,2003, a reduced copy of which is attached hereto as Exhibit A. 4. Based upon the foregoing, the Board finds that the proposed use is in harmony with the general purpose and intent of the Zoning By-law. The Board further finds that a grant of relief with conditions would be consistent with similar relief previously granted in the immediate area. 5. Accordingly, by a UNANIMOUS vote, the Board GRANTS the requested relief by SPECIAL PERMIT under Nantucket Zoning By-law Section 139-9B(2)(a), (b) and ( c), to operate the business as proposed, including properly screened outdoor storage of goods and materials as indicated on Exhibit A upon the following conditions: a. There shall be one commercial tenant in the structure and one apartment shall be maintained on the second and third floors, unless further relief is granted by this Board; b. The improvements on the site shall be done in substantial conformance with Exhibit A, which includes the fencing, screening and French drainage details: c. The existing screening along the rear property line shall be maintained; d. The outdoor storage shall be confined to the area indicated on Exhibit A; e. There shall be no commercial activity on Sundays; f When power equipment is being operated, all doors and windows in the shop area shall be closed to avoid excessive noise; g. Hours of commercial operation shall be limited to the hours between 7:30 AM to 6:30 PM. The Board acknowledges that there would be times after 6:30 PM that there will be commercially related activity but the use of any power tools is to terminate at 6:30 PM. h. Any hazardous materials are to be stored and disposed of in accordance with local, state and federal regulations. 6.
