DECISION:
At a public hearing of the Nantucket Zoning Board of
Appeals, on Friday, September 12, 2003, at 1:00 PM, in the
Conference Room, Town Annex Building, 37 Washington Street,
Nantucket, Massachusetts, the Board made the following Decision
on the Application of ANDREW D. WING AND MELISSA N. WING, of PO
Box 2322, Nantucket, Massachusetts 02584, File No. 063-03:
1. Applicants are seeking relief by VARIANCE from the
provisions of Nantucket Zoning By-law Section 139-7A(2) (b) to
validate an about nine-foot scalar separation between the
existing primary and the secondary dwellings, where a 12-foot
scalar separation is required. The Locus is conforming in all
other respects under the Zoning By-law.
The Premises is located at 34 TICCOMA WAY (1 DOOLEY COURT),
Assessor's Map 68, Parcel 150, Plan Book 17, Page 76, Lot 7. The
property is zoned Residential-2.
2. This Decision is based upon the Application and
materials submitted with it, along with the testimony and
evidence presented at the hearing. There was no opposition to
this Application expressed at the hearing or in writing on file.
One neighbor spoke in favor of the Application stating that the
Applicants had done a good job of renovating the property. She
questioned whether there was a deed restriction on having a
secondary dwelling. The Board clarified that it did not have
jurisdiction over private deed restrictions. There was a letter
from the Acting Nantucket Fire Chief stating that he saw no
issues of fire safety concern if the Applicants removed the
excess brush between the two structures. The Planning Board
recommendation stated that the Board did not have an issue with
the Variance relief requested. However, the Board questioned the
existence of two separate driveway access points to the property.
Zoning By-law Section 139-20.1 stated that there should be one
driveway access without Special Permit relief having been granted
by the Planning Board or validly grandfathered. The Planning
Board asked the Board of Appeals to take this into consideration
when drafting conditions for any grant of relief. The Zoning
Enforcement Officer stated that he did not see any issues of
health or safety due to the lack of the 12-foot scalar
separation, nor did he see any negative impact from a grant of
relief in this instance.
3. Applicants, through counsel, represented that the
current 12-foot scalar separation violation seemed to have been
created by a series of errors made by several participants,
including the Nantucket Building Commissioner at the time. In
1987 a predecessor-in-title obtained Building Permit No. 5550-87
to construct a rectangular new garage on a conforming lot that
was then improved with a single-family dwelling. The work was
completed and a Certificate of Occupancy was issued for the new
structure.
The ownership of the property was transferred and the
new owner obtained Building Permit No. 13669-96 to add dormers to
the garage structure and convert the second floor space into a
heated studio with bath. The Building Permit was amended in May
of 1997 to allow the conversion of the structure into a secondary
dwelling with the addition of a small wart to house the utilities
on the northeasterly side of the structure in the space between
the two dwelling units. A Certificate of Occupancy was issued for
the alterations on April 13, 2000, based upon a ~Mortgage
Inspection Plan", done by Jeffrey L. Blackwell, dated December 1,
1998, a reduced copy of which is attached hereto as Exhibit A.
Said plan indicated that there was no violation of the 12-foot
scalar separation requirement at that time as no improvements had
been made to the primary dwelling yet. The plan provided as the
~as-built" for zoning purposes to the Building Department
contains the ~Approval" stamp with the then Building
Commissioner's signature and it was included in the Building
Department's permanent file.
In October of 2000, the current owners received
Building Permit No. 1110-00 to make substantial renovations to
the primary structure, which included expansion of the footprint
to provide additional living space and integrated porches.
Unfortunately, the plan produced by and provided to the HDC by
the Applicants' builder during their review of the proposal was
incorrect, showing the original footprint of the garage
structure, without the northeasterly addition reflected. In
addition, the then Building Commissioner used this incorrect plan
on which to base the issuance of the Building Permit. The
additions and alterations were done in conformance with the HDC
plans and the Building Permit. However, when a new ~As-Built Plot
Plan" was done by Richard K. Earle of Nantucket Surveyors, Inc.,
dated May 14, 2003, a reduced copy of which is attached hereto as
Exhibit B, the secondary dwelling footprint was correctly
indicated. It was then found that with the new additions to the
primary dwelling, some occurring in the space between the two
dwelling, the separation distance was shown to be as close as
about nine feet, not the required 12 feet. Applicants represent
that they were unaware of the error until they had gone for the
Certificate of Occupancy and were issued a denial letter based

upon the zoning violation. They further stated that they relied
in good faith on their builder and the Building Department and
did not reduce the distance for any personal gain.
Applicants represented that the impact of the reduced
separation distance was minimal as the property is located at the
end of a heavily wooded dirt road and not highly visible. The
nState Forest" which is open land, also abutted the Locus on the
southeasterly side of the Lot. In addition, the letter from the
Acting Fire Chief indicated that there were no fire safety
concerns with the current locations of the buildings not
impairing emergency operations. Applicants had already removed
the brush from between the dwellings. The new porch section of
the primary house located on the southwesterly side of the
structure is an integrated porch, with entryway into the side
door, making steps necessary in any case, which would still
violate the scalar requirement. The addition on the secondary
dwelling contains all of the utilities, as there is no basement
under that structure. Applicants also represented that to cut off
pieces of either structure would be cost prohibitive for them and
would constitute an undue financial burden. Applicants
represented that there would seem to be sufficient mitigating
factors to warrant a grant of relief by Variance.
4. Therefore, based upon the foregoing, the Board finds
that there would be little impact upon this neighborhood by a
grant of relief by Variance to validate the current about 9-foot
scalar separation of the primary and secondary dwellings as
presently configured, especially in light of the letter from the
Acting Chief of the Nantucket Fire Department as noted above, the
supporting testimony of the Zoning Enforcement Officer, the
absence of neighborhood opposition, the supporting documentation
from the Building Department file and good faith reliance by the
Applicants on both the Building Commissioner and their builder.
The facts on the ground would not change with a grant of relief.
In addition, the Board specifically found that owing to
circumstances relating to the topography of the structures, and
especially affecting the Locus and structures, but not affecting
generally the zoning district in which it is located, a literal
enforcement of the provisions of this Zoning By-Law would involve
substantial hardship, financial or otherwise, to the Applicants
and relief could be granted without substantial detriment to the
public good and without nullifying or substantially derogating
from the intent or purpose of such By-law.
5. Accordingly, by a vote of four in favor (Sevrens,
Waine, Loftin, Sanford) and one opposed (Toole), the Board GRANTS
the requested relief by VARIANCE under Nantucket Zoning By-Law
Section 139-7A(2) (b) to validate the current siting of the

structures contained on the Locus, with a scalar separation as
close as about nine feet, upon the following conditions:
a. The siting of the structures shall be in substantial
conformance with Exhibit B;
b. There shall be no further encroachment into the 12-
foot scalar separation area;
c. The open porch area that is situated on the
southwesterly side of the primary structure shall
remain unenclosed; and
d. Should the Planning Board validate multiple driveway
accesses for the Locus or they are substantiated to
be validly grandfathered by the appropriate
authorities, the Applicants would not need to seek
further relief from this Board to maintain them.
However, in the absence of such relief or proof, the
Applicants shall have no more than one driveway
access on the Locus.
