NANTUCKET ZONING BOARD OF APPEALS 1 East Chestnut Street Nantucket, Massachusetts 02554 Map 55.1.4, Parcels 33 and 63 56 Union street Residential Commercial Book 646, Page 284 Plan Book 15, Page 84 Plan Book 11, Page 42 DECISION: At a public hearing of the Nantucket Zoning Board of Appeals, on Thursday, September 18, 2003 at 3:00 PM (originally opened and heard on Friday, September 12, 2003, at 1:00 PM), in the Conference Room, Town Annex Building, 37 Washington Street, Nantucket, Massachusetts, the Board made the following Decision on the Application of PETER JANNELLE and WENDY J. CLINTON- JANNELLE, c/o Sarah F. Alger, P.C., Two Union Street, Nantucket, Massachusetts 02554, File No. 061-03: 1. The Applicants are seeking relief by SPECIAL PERMIT under Nantucket Zoning By-law (the "By-law") S;139-33A (alteration or expansion of a pre-existing, nonconforming use/structure) to validate the existing 122 patron seats for the restaurant known as "Fifty-Six Union," which includes 82 interior seats, 38 exterior seats on the patio, and 2 exterior seats in front of the restaurant to which there is no service. In addition to the restaurant, the existing structure on the Locus contains an apartment on the second floor and on-site housing at the back of the first floor. Further, the Applicants are seeking a SPECIAL PERMIT under By-Law S;139-18 to waive 21 of the 42 on-site parking spaces required for the existing uses, with 21 such spaces being provided. No changes to the existing uses or structure are proposed under this Application. The Locus is nonconforming as to frontage, having about 31.75 feet of frontage along Union Street in a district that requires a minimum frontage of 40 feet; and as to side yard setbacks, with the structure being sited as close as 0.4 feet from the northerly side yard lot line and as close as about 1.0 feet from the southerly side yard lot line, in a district the requires a minimum side yard setback of five feet. The Premises is located at 56 UNION STREET, Assessor's Map 55.1.4, Parcels 33 and 63, Plan Book 15, Page 84, and Plan Book 11, Page 42. The Locus is zoned Residential-Commercial ("RC"). 2. Our Decision is based upon the Application and accompanying materials, and representations and testimony received at our public hearings. The Planning Board made no recommendation as this matter was not of planning concern. There was no opposition presented at the public hearing, personally, by representatives, or in writing. 3. The Applicants, through counsel, represents that due to concerns raised with another restaurant on the Island during a public hearing process earlier in 2003 before the Board of Selectmen (the "BOS"), scrutiny has now been brought to bear on all outdoor patios where patrons are served. The BOS is requiring patios to become part of the premises licensed under a liquor license, which possibly calls into question the grandfathering of the use of certain patios for zoning purposes. As a result, the Applicants find that they must now validate the nonconformities on the Locus through a Special Permit issued by this Board, even though most, if not all, of such nonconformities predate the 1972 effective date of the Nantucket Zoning By-law and are effectively grandfathered as pre-existing. The BOS voted unanimously to expand the liquor license at the end of August 2003 to include all 122 restaurant seats, including those on the patio, pending favorable action of this Board on this Application. 4. The Applicants represented that they run "Fifty-Six Union" through their corporation, Orbrieo, Inc. They purchased the Locus and the existing restaurant business on January 5, 2000. At the time of the purchase, the Locus was used as a 122-seat restaurant, with an apartment on the second floor and housing for 18 employees in the back of the first floor. The Applicants have continued all of these uses on the Locus, but have reduced the total number of employees housed from 18 to eight. This occupancy reduction cut the required parking spaces for that specific use in half from ten to five. 5. Applicants further represent that the current uses on the Locus, that is, a restaurant, on-site housing, and a single- family dwelling unit, are all valid permitted uses in the RC district; however, the Locus is nonconforming as to parking. The structure on the Locus is also nonconforming as to frontage, having about 31.75 feet of frontage along Union Street where a minimum of 40 feet is required, and as to side yard setback, having side yard setback, at its closest point, of about 0.4 feet from the northerly boundary line and about 1.0 foot from the southerly boundary line. The frontage and setback violations predate the 1972 effective date of the By-Law and are exempt from enforcement as valid pre-existing, nonconformities. Some, if not all, of the parking nonconformity is also validly pre-existing. 6. Applicants state that the 122 restaurant seats are allocated as follows: 50 seats in the front dining room, 32 seats in the garden dining room, 38 seats on the patio, and two seats in front of the restaurant for display. The 38 patio seats are used only in the warmer months. When the patio is closed, those seats are not relocated inside the restaurant. The interior seating remains at a total of 82 seats. Restaurant patrons who have gone outside to smoke use the two seats at the table on the sidewalk in front of the restaurant, from time to time. The BOS included those seats in the Applicants' expanded liquor license. The Applicants do not use this table for food service. Any person seated at this table has left a seat in the restaurant unoccupied. 7. The Applicants showed that they are able to provide 21 parking spaces, seven of which are located in a wedge-shaped island in the Union Street road layout to the west of the property, that has been in common ownership with the Locus since ') , a time prior to the effective date of the By-law in 1972 and has been used for parking for the commercial uses in the structure since its construction. Applicants represent that the required parking spaces are arguably inflated, because certain spaces are counted more than once. For example, eight of the 15 employees at peak shift also reside in the on-site housing. As a result, it could be said that spaces are being provided twice for these eight employees. If the parking requirements were calculated only on the basis of the seven employees at peak shift not housed on site, then the number of spaces required in this category would be reduced by three to two, and the total number of spaces required on site would be 38. In addition, because the on-site housing consists of four separate bedrooms with no kitchen or eating facilities, it may not technically constitute an Employer Dormitory, and the parking could be calculated at one space for one dwelling unit, reducing the required spaces by four to 34. Finally, the Applicants and their family reside in the second floor apartment during the summer months, and parking is provided for them in the dwelling unit calculation. Applicants stated that those employees living on site were prohibited from bringing cars to the site. 9. Applicants explained that the Locus has a vast, complex history of commercial use, the nature and extent of which are varied. It appears that the structure was built sometime in the 1950's. It is clearly present substantially in its present configuration on the 1958 aerial in the Town archives. The structure was never used solely as a residence. Over time, it was used as a grocery store, fish and/or meat market, and delicatessen, featuring Portuguese food, with storage in the back. In 1960, the first restaurant use was made of the structure. This use, and the other commercial uses of the Locus, ':l were expanded dramatically beginning around 1966. A portion of the structure was used for the storage and wholesale distribution of scallops up and down the Eastern seaboard, and a store selling fish and aged meats was added to the existing market and restaurant use. In addition, there was an office, a raw bar on the patio, a live lobster tank in the seating area, and a separate diner that had a few counter seats and take-out service for boxed lunches, all at the same time. Under today's parking standards, there would have been substantially more parking spaces required. Between 1968 and 1977, the Locus changed hands several times with there never being a gap in the commercial use of the property. Throughout, the restaurant use, including patio service, continued, albeit not always successfully. In 1977, the Locus was sold, bringing another wave of changes to the Locus, and the history becomes murky. The new owners turned the raw bar on the patio into a wait station, while maintaining the patio seating, which it still is today, continued operating the restaurant, used the apartment and on-site housing, had a separate telephone answering service in the office on the first floor, and ran a retail shop about where the diner used to be. From 1977 to 1994, these owners altered and expanded the uses of the Locus and changed the uses back and forth, often without benefit of permits or relief from this Board. At various times during this period, the restaurant was in use, with the seating capacity being first reduced and then reinstated. Unfortunately the changes in seating capacity were never corrected on the license, with the license continuing to indicate a lower capacity until the present. During the same time period the apartment and employer dormitory were expanded and improved through relief granted by this Board; and there was a market and a retail store. In 1994, the Locus was sold to the Applicants' immediate predecessor in title as a 122-seat restaurant, with housing for 18 employees, and an apartment on the second floor. This use, including the use of the patio, has continued to this day with little or no alteration, except for the reduction in the on-site housing from 18 to eight employees. 10. Applicants argue that the parking nonconformity of the Locus is grandfathered based upon the documentation of the past uses in the structure. Unfortunately, because of the various changes that were made over the course of almost 40 years and because the restaurant seating capacity has been stated to be 50, albeit exclusive of the patio seating, on the annual licensing, it is difficult to determine exactly how many parking spaces are grandfathered. However, 21 spaces have continued to be provided during the entire time. It is also arguable that once grandfathered spaces might have been lost as a result. What can be said is that the uses in place on the Locus on April 4, 1979, the effective date of By-law S;139-11, required the provision of 31 parking spaces (22 for the 50-seat restaurant plus 38-seat patio service; 1 for the apartment; 1 for the office; 1 for the retail shop with up to 3 employees; and 5 for the 18-bed housing); that since 2000, the Applicants have been using the Locus in good faith, with no notice of irregularity, including renewal of licenses on a yearly basis without comment from those 11 " regulating authorities, until the recent liquor license issue arose with another establishment; and that such uses require 42 parking spaces, or 11 more than required in 1979. 11. Therefore based upon the foregoing, by a UNANIMOUS vote, the Board makes the following findings: (a) That the alterations and extensions that have occurred on the Locus since April 4, 1979, the effective date of By-law S;139-11, added together, do not meet or exceed the criteria of By-law S;139-11.B. Specifically, we find that the uses in place on the Locus as of April 4, 1979 required the provision of 31 parking spaces and that the alterations and extensions of those uses since that date have generated only 11 additional parking spaces. Accordingly, under By-law S;139-11.C, this Application does not involve a Major Commercial Development and does not require a Special Permit under By-law S;139-11 from the Planning Board. (b) That, to the extent that the current uses of the Locus, that is, a 122-seat restaurant, on-site housing for eight employees, and a single-family dwelling unit, are nonconforming as to parking, at least some, if not all, of such parking nonconformi ty pre-exists the 1972 effective date of the By-law and is therefore grandfathered, and that any extension or alteration of such nonconformity occasioned by such current uses is not substantially more detrimental to the neighborhood than the existing nonconformities; the uses are permitted uses; and the nonconformi ties of the structure as to side yard setback requirements and of the Lot as to frontage requirements have not been and will not be altered or extended in any way without further relief from this Board. (c) That the waiver of 21 of the 42 required parking spaces is ln harmony with the general purpose and intent of the By-law; and that compliance with the parking requirements set forth in S;139-18 would be physically impossible for the Applicants to provide and a waiver would be in harmony with the general purpose and intent of the By-law and not contrary to traffic and safety concerns. The Board notes that the uses have operated without incident for decades. 12. Accordingly, by a UNANIMOUS vote, the Board of Appeals GRANTS the requested relief by SPECIAL PERMIT under Nantucket Zoning By-law ~139-33A, validating the current use of the grandfathered pre-existing, nonconforming structure on the Locus as a 122-seat restaurant, with on-site housing for eight employees in the back of the first floor and with a single-family dwelling unit on the second floor, and under Nantucket Zoning By- law ~139-18, waiving 21 of the 42 required parking spaces, subject to the conditions set forth in Paragraph 13. 13. The relief hereby granted is subject to the following conditions: c:; .... (a) The use of the Locus shall be limited to (i) a restaurant having up to a maximum total of 122 seats: a total of 82 in the interior of the structure, consisting of 50 in the front dining room and 32 in the garden dining room, and a total of 40 outside, consisting of 38 on the patio and two in front of the restaurant; (ii) on-site housing for eight employ~eSi; and (iii) a second floor single-family dwelling unitJ-rlft1 Ot'lk' t'.ie(Yr'CJc)fYJ. u-l (b) The restaurant seating shall remain in substantial conformity to the floor plans (showing the seating capacity with square footage calculations)marked as "Floor Plan for Fifty-Six Union", a reduced copy of which is attached hereto as Exhibit A. (c) The exterior of the structure and the parking provided shall be in substantial conformity to the site plan, marked as "Site and Parking Plan - 'Fifty-Six Union' Restaurant", done by Charles W. Hart, dated September 15, 2003, a reduced copy of which is attached hereto as Exhibit B. (d) When the patio is not in use, the 38 seats shall not be relocated to the interior of the restaurant, which shall have a maximum interior seating capacity of 82 seats. Based upon review of the application, supporting documents and testimony at Public Hearing, the BOARD finds that the applicants currently rent out dormitory space at the subject premises to Summer workers on Nantucket, that the structure at issue is a lar6e, cinderb10ck building, that the applicants propose to increase dormitory space in the building without sjgnificant exterior expansion ani alteration, that owing to these circumstances, which especially affect such structure but do not affect generally the RESIDENTIAL/COMMERCIAL ZONING DISTRICT, a literal enforcement of the 'Zoning By-Law would cause the applicants a substantial hardship, that thE:re is a serious shortage of affordable rental hous~ng for summer workers in Nantucket, that the proposed expansion of dormitory use wEI help to alleviate this shortage, and that the Variance may be granted without substantial detriment to the public good and without nullifying the intent of the Zoning By-Law. 3. For the reasons set forth, the BOARD hereby GRANTS the applicants a Variance from SECTION 4-C-l-a of the Zoning By-Law (allowance of expanded dormitory use), by unanimous vote.
