Applicants are seeking relief by SPECIAL PERMIT under Nantucket Zoning By- law Section 139-8B(2) (Neighborhood service establishments). Applicants propose to convert about 396 square feet of first floor living space of the principal dwelling unit on the Lot into a hair salon. All parking would be provided on site. There would be up to a maximum of three employees working in the establishment. The Lot also contains a garage/apartment. The Locus is conforming to all dimensional zoning requirements. The Premises is located at 11 HOOPER FARM ROAD, Assessor's Map 55, Parce1225, Plan Book 14, Page 35, Lot 1. The property is zoned Residential-I. 2. The Decision is based upon the Application and the materials submitted with it and the testimony and evidence presented at the Hearing. The Planning Board made no recommendation finding that the matter did not present any issues of planning concern. There were no letters on file. One abutter, represented by counsel, expressed concern about the use of an easement across his property to the north of the Locus, that the Applicants had been using for several years. However, he had no concern with the proposed use. He asked that the access to the property be restricted to the new driveway indicated on the submitted plan. 3. The Applicants represented that they wished to convert about 396 square feet of their interior living space, to a neighborhood service establishment, i.e., a hair salon, as allowed by Special Permit under the Zoning By-law in this residential zoning district. Applicants stated that their daughter would be operating the establishment. All of the required parking, including a handicap space, would be provided on site. There would be a maximum of three employees working in the shop at peak shift. The remainder of the structure would continue to be used as a single-family home. The Locus also contains a garage with an apartment on the first and second floors. Applicants also represented that the access to the property for the business would be through the driveway on the southerly side of the property as shown on a "Building Location Plan", done by Charles H. Hart and dated August 1,2003 and revised August 8,2003, a reduced copy of which is attached hereto as Exhibit A. 4. Based upon the foregoing, the Board finds that the conversion of living space into a neighborhood service establishment, a hair salon, would not be contrary to the Zoning By-law and would be in harmony with the general purpose and intent of the By-law. The Board also finds that given that all required parking will be provided on site there would be little negative impact upon the neighborhood. The Board also notes that almost directly across the street a Special Permit had allowed a similar establishment to operate and that shop has since closed. 5. Accordingly, by a UNANIMOUS vote, the Board GRANTS the requested relief by SPECIAL PERMIT under Nantucket Zoning By-law Section 139-8B(2) to allow the project as proposed based upon the following conditions: a. The shop area shall be limited to no more than 396 square feet with up to three employees at peak shift; b. The access for the hair salon use shall be from Hooper Farm Road only; and c. The parking and access for the hair salon shall be substantially as shown on Exhibit A. 6. By a UNANIMOUS vote, the Board also approves the site plan under Zoning By- law Section 139-23 and attached hereto as Exhibit A.
