Applicant (AT & T WIRELESS) is seeking relief by SPECIAL PERMIT under
Nantucket Zoning By-law Section 139-17C(2) (Height Limitations - antennas).
Applicant proposes to construct, operate and maintain a wireless communications facility
consisting of an about 80-foot monopole, that may be designed to appear as a tree, or
some other item such as a flag pole, and related base station equipment that mayor may
not be required to be enclosed within a structure and security fence. All parking
requirements will be met. The vacant about 20,150 square-foot Lot is conforming in all
respects. The new tower would conform to setback requirements.

Pursuant to G.L. c. 40A, ~ 9, and Sections 139-17(C)(2) and 139-30 of the Nantucket
Zoning By-law, Eastern Towers, LLC ("Eastern Towers") and AT&T Wireless PCS, LLC by and
through its member AT&T Wireless Services, Inc. ("AT&T Wireless") submit this application
through Nelson K. Eldridge, the owner of the above property, for all necessary zoning relief
including a special permit to install, operate and maintain a wireless communications facility
consisting of Eastern's proposed eighty foot monopole designed to appear as a tree, AT&T
Wireless' proposed wireless communications facility and related equipment.
Filed concurrent with this application are three (3) related applications for proposed
wireless facilities at 26 Polpis Road (Assessor's Map 54 Lot 176),320 Polpis Road (Assessor's
Map 24 Lot 1) and 120 Miacomet Road (Assessor's Map 81 Lot 6). Detailed plans and
specifications for each of those facilities are included with each respective application.

I. DOCUMENTS SUBMITTED IN SUPPORT OF APPLICATION
Enclosed are a check in the amount of$200.00 payable to the Town of Nantucket and the
original and five (5) copies of this letter and the following attachments:
1. The Application for Relief from the Zoning Board of Appeals;
2. A redacted copy of the Lease dated October 31,2002, between Nelson K.
Eldridge and US Tower Group, LLC;
3. A copy of the Assignment and Assumption of Lease Agreement between US
Tower Group, LLC and Eastern Towers, LLC as well as the Consent to the
Assignment by Nelson K. Eldridge;
4. Drawings prepared for AT&T Wireless by Turning Mill Consultants, Inc., dated
March 28, 2003, detailing the proposal. These drawings include the Title Sheet

5. A Radio Frequency Specialist's report demonstrating the need for the facility and
describing other feasible sites, if any, within the reception/transmission area of the
proposed facility;
6. A written report dated March 25, 2003, by SRS Engineering Applications, Inc.
confirming that the facility complies with RF emission regulations of the FCC and
the MDPH as well as a copy ofMDPH's revised policy;
7. A TOW AIR determination demonstrating that the monopole will not be a hazard
to air navigation;
8. Manufacturer's Specification Sheet for Ericsson RBS 2106 Cabinet;
9. Manufacturer's Specification Sheet for Allgon 7262 Antenna;
10. Noise dispersion data for Ericsson RBS 2106 Cabinet;
11. A copy of AT&T Wireless' FCC License; and
12, A certified abutters list (including the names and addresses ofthe owners of all
abutting land and of abutters to those abutters within 300 feet of the Site);

We understand that the Town of Nantucket will mail notice to all parties in interest and
cause notice to be posted and published in accordance with Massachusetts General Laws and the
Bylaw,
II. PROPOSAL
Eastern Towers proposes to construct a wireless communications monopole that will be
designed to appear as a tree. The entire facility will be enclosed inside a fenced compound. The
proposed monopole will be located on a parcel at 5 Eldridge Lane identified as Lot 77.2 on
Assessor's Map 49. The proposed wireless monopole will be 80' tall and will be capable of
accommodating the facilities of AT&T Wireless., up to two additional carriers. The fenced area
will also be of sufficient size to accommodate the ground equipment for all three carriers.
AT&T Wireless proposes to install and operate a wireless communications facility
consisting ofthree antennas mounted to the pole at a height of 77' :!: above ground level (AGL)
and supported by one or more Ericsson RBS 2106 equipment cabinets that will be installed
inside the fenced compound, The proposed antennas, cables, cable tray and equipment cabinets
are described in detail on the plans and specifications submitted herewith. The proposed
installation will be an unoccupied, unmanned, specialized wireless telecommunications facility.
The installation will be served by telephone and electric service. The antennas will be connected
to the equipment cabinet(s) by means of coaxial cables running up the inside of the proposed
monopole.
The proposed pes wireless facility will enhance wireless telephone service to the
residents and businesses of Nantucket. Through a fully digital system, this technology affords
improved reception, more private communication, increased ability to handle data, short
messaging, enhanced cellular battery life, and other technological advances.
Additional details of the proposed installation, including electrical, mechanical,
equipment and related information, are set forth below, in the enclosed plans and attached
materials,
III. COMPLIANCE WITH THE REQUIREMENTS OF THE ZONING BYLAW
a. The Special Permit Requirement

Section 139-17 sets for height limitations for buildings and structures. Section 139-
17(C)(2) provides that "[t]he Board of Appeals may grant a special permit to allow the following
uses exceeding such height limitations:...(2) antennas....." As the proposed facility involves the
installation of antennas at a height that will exceed the height limits of Section 139-17 a Special
Permit from the Board of Appeals is required.
b. The Purpose of the Bylaw
Section 139-30 provides that "[t]he special permit granting authority may issue Special
Permits for structures and uses that are in harmony with the general purpose and intent of the
Zoning Bylaw subject to the provisions of such bylaw,"
The purpose of the Nantucket Zoning Bylaw, as defined in Article I Section 139-1, is :
"[t]o promote the health, safety, convenience, morals and general welfare of its
inhabitants, to lessen the danger from fire and congestion and to improve the town
under the provisions of the State Zoning Act, Massachusetts General Laws,
Chapter 40A, ..."
The proposed facility is consistent with the purpose of the Bylaw and will serve to
minimize or eliminate any perceived adverse impacts as follows:
(a) The proposed facility will promote the health, safety, convenience, and general
welfare of the inhabitants of Nantucket by providing a valuable wireless
communications service for personal, business, and emergency communications.
(b) The proposed facility will lessen the danger from fire by providing a wireless
communications service that will speed emergency communications by allowing
users in the vicinity to more timely report emergencies to the appropriate
authorities and thereby improve response times of emergency services.
(c) The proposed facility will have little or no effect on traffic congestion in the
streets because the facility will be unmanned and will require only approximately
one vehicle trip per month per carrier for scheduled maintenance.
(d) The proposed facility improves the town by providing access to modem wireless
communication services for personal business, and emergency communications to
the residents and businesses of Nantucket.

( e) The stealth design of the wireless tree protects sensitive areas and land uses from
perceived adverse visual impacts of wireless telecommunications facilities and
antennas, thereby conserving the value of property within the Town.
(f) The proposed facility avoids alleged damage to adjacent properties through
careful engineering and siting.
(g) By creating the opportunity for up to two additional collocators on a single
monopole, the proposed facility minimizes the total number of wireless
communication facilities throughout the community. It also enhances the ability
of the providers of telecommunications services to provide such services to the
community quickly, effectively, and efficiently.
(h) The proposed facility will operate in conjunction with AT&T Wireless' proposed
neighboring wireless communications facilities and will function within a local,
regional, and national wireless communications system. It is this system that will
allow AT&T Wireless to provide enhanced wireless communications services to
the residents and businesses of Nantucket on both a day-to-day basis as well as
during emergencies. Uninterrupted coverage will further contribute to the general
welfare and safety of the Town of Nantucket by providing superior quality
conversations as well as increased ability to handle emergency calls, thus allowing
users in the vicinity to more timely report emergencies to the appropriate
authorities.
(i) AT&T Wireless' proposed facility will not pose a substantial risk of fire. The
equipment is connected to and monitored by a communications center 24 hours
per day, seven days per week. In the substantially unlikely event of a malfunction
or fire an alarm would be triggered, emergency personnel would be dispatched to
the site, and, if necessary, the appropriate authorities would be notified.
G) The facility will comply in all respects with Radio Frequency emissions standards
established by the Federal Communications Commission and administered by the
Massachusetts Department of Public Health.
(k) The Facility will generate no objectionable noise, vibration, smoke, dust, odors,
heat, glare or other effects; the only noise associated with the facility will be in
connection with the air conditioning equipment which will not generate
objectionable nose at the property boundary.

Thus the design and location of the facility (1) hide the facility from view as much as
reasonably possible by using a stealth designed monopole that will look like a tree, and (2)
present an environmental sound, safe and secure facility.
As demonstrated herein, the proposed facility is in harmony with the general purposes
and intent of the Bylaw and is consistent with Mass. Gen. Laws C. 40A, 9 9. Therefore, the
applicants respectfully request that this Board issue the Special Permit requested herein.
IV. CONCLUSION
The Federal Telecommunications Act provides in relevant part that "The regulation ofthe
placement, construction, and modification of personal wireless service facilities by any State or
local government or instrumentality thereof - (II) shall not "prohibit or have the effect of
prohibiting the provision of personal wireless services." 47 U.s,c. 9332(c)(7)(B)(ii). Because
the applicants propose to construct a monopole within an area that AT&T Wireless has a
substantial gap in coverage and the need to address the identified significant coverage gap, the
applicants are entitled to the protections afforded by this section of the Act.
In addition, the Federal Telecommunications Act of 1996 makes it unlawful for any
municipality to impose regulations "on the basis of the environmental effects of the radio
frequency emissions to the extent that such facilities comply with the [Federal Communication]
Commission's regulations concerning such emissions." 47 USC 9 332(c)(7)(B)(iv). The
proposed installation fully complies with those regulations.
AT&T Wireless holds a license from the Federal Communications Commission (FCC) to
provide wireless communications services in this area of Massachusetts. This license, and the
statutes under which this license was granted, provide that the development of such services is in
the public interest. Under the statute, AT&T Wireless is required to serve the public, and the
terms and conditions of its service are subject to regulation by the FCC. 47 U.S.C. 9201(b).
The applicants believe that they have met the criteria for a special permit set forth in the
Town of Nantucket Zoning Bylaw and specifically Section 139-30 thereof. The applicants
looks forward to working with the Board of Appeals in a cooperative effort to insure that both the
purposes of Nantucket's zoning are met and the purposes of the Federal Telecommunications Act
are satisfied with respect to the proposed installation.
Accordingly, the applicants respectfully request that the foregoing zoning reliefbe
allowed. Further the applicants respectfully request that the Board schedule this application for a
public hearing at its next regularly scheduled meeting.

Recitals

1, Option To Lease:
a. Landlord hereby grants to Tenant an option (the "Optionlt) to lease a portion of the Property, together with a
right-of-way for access and an easement for utilities as more particularly descn"bed on attached Exhibit B (collectively, the
"Premises").

c. During the Option Term and any extension thereof, and during the tenn afthis Agreement, Tenant and its
agents, engineers, surveyors and other representatives shall have the right to enter upon the Property to inspect, examine, roof tops,
outside and inside buildings and their structural supports, conduct soil borings, drainage testing, material sampling, and other
geological or engineering tests or studies of the Property, to apply for and obtain any and all licenses, pennits, approvals or other relief
required or deemed necessary or appropriate in Tenant's sole discretion for its use of the Premises, including, without limitation,
applications for zoning variances, zoning ordinance amendments, special use pennits and construction permits, and to otherwise do
those things on or off the Property that, in the opinion of Ten ant, are necessary or appropriate to detennine the physical condition of
the Property, the environmental history of the Property, Landlord's title to the Property and the feasibility or suitability of tbe Property
for Tenant's intended use , all at Tenant's expense. Tenant shall not be liable to Landlord or any third party on account of any pre-
existing defect or condition on or with respect to the Property, whether or not such defect or condition is disclosed by Tenant's
inspection.
d.. During the Option Tenn and any extension thereof, Tenant may exercise the Option by notifying Landlord
in writing. If Tenlillt exercises the Option. then, subject to the following terms and conditions, Landlord leases the Premises to Tenant
If Tenant does not exercise the Option during the Option Tenn or any extension thereof, this Agreement will terminate and the Parties
will have no further liability to each other.
2. Use of Premises. Access.

use the Premises solely for the installation, operation and maintenance, at Tenant's sole expense, of a multiple user
cammuni~tions facility, including without limitation, the erection and operation ofan antenna mounting muctUre(s),
equipment ghelter(s), utility Hnes, supporting structures and other associated improvements and equipment which are initially
described on attflched ~ibit C (collectively, "Tenant's Communications Facility").
b. Prohibited Uses. Tenant shall not use the Premises for any illegal purpose and shall not conduct
any activity at the Premises that is harmful to the health or safety of others, including, without limitation, other tenants or
occupants of the Property. Tenant shall conduct its business and control its agents, employees, invitees, licensees and visitors

. iri\uch manner as not to create any nuisance or interfere with, annoy, or disturb any other tenant or occupant of the Property.
Tcnalit shall not construct structures having an aggregate ground cover of more than 1.600 square feet as defined in the
Nantucket Zoning Bylaw.
c. Access to Premises. Landlord hereby grants to renant, its Subtenants (as defined below), and
their respective agents, employees, contractors and invitees, a non-exclusive right of way, 20' wide, extending from the
Premises over, through and under the Property and Eldridge hmd to the nearest public right-of-way ("Access Right of Way")
to use such Access Right of Way for ingress and egress seven (7) days a week. twenty-four (24) hours a day, everyday of the
year. The Access Right of Way shall be located on the Property and shown on the plans to be approved by Landlord pursuant
to Paragraph 12.
3. Term; Renewal and Termination.
a. Initial Term. The initial lease term of this Agreement ("Initial Tenn") shall COmmence on the
Commencement Date and shall continue for a period ofren (10) years thereafter. The "Commencement Date" shall be the
date which is the earlier of (i) the completion of installation of two ofTenant's Subtenant's communications equipment on the
Premises> or (ii) ten (l0) days after Tenant first receives a payment of rem from any Subtenant. "Subtenant" shall mean any
communications subtenant to enter into a sublease or license for any portion of Tenant's Communications Facility or the
Premises. The Parties agree to evidence the Commencement Date by completing Exhibit D attached hereto.
b. Automatic Renewal. Upon the expiration ofthe Initial Term, this Agreement shall automatically
renew for (4) additional periods often (10) years each (each a "Renewal Tenn" and collectively "Renewal Tenns") on the
same terms and' conditions set forth herein, except that the Monthly Rent (hereinafter defined) shall increase as set forth
herein, Said renewals shall become effective unless Tenant shall give written notice of cancellation no less than ninety (90)
da>,s prior to the expiration of the Initial Tenn or any Renewal Term, 8S applica.ble. The Initial Term and the Renewal Tenns
may hereinafter be collectively referred to as the 4ITerm".
c. Additional Extension of Term. At any time after the Initial Tenn, and with at least one hundred
and tWenty (120) days written notice, Tenant shall advise Landlord in writing if it wishes to further extend the Tenn, setting
forth its proposed extension tenn. Within thirty (30) days after the receipt of such notice, Landlord shall advise Tenant
whether it will consent to the proposed extension and if so, whether the proposed extension term is ac.ceptable or Landlord
shall set forth the length of the extension tem1 which would be acceptable to Landlord, Upon establishing the terms of any
proposed extension term as set forth herein, this Agreement shall be amended in writing signed by both parties setting forth
those terms and incorporating all of the other terms and conditions oftbis Agreement.
d, Right to Terminate. This Agreement may be tenninated by TeI18nt, upon ninety (90) days prior written
notice to Landlord: (i) if the Property becomes unusable by Tenant or its Subtenants for the purposes intended hereunder due to
Tenant's or any Subtenant's inability to obtain or maintain any approval, permit or license ("Approval") necessary to install or use the
Premises for the purposes permitted hereunder; (ii) if there occurs any change in governrnental statutes, rules or regulations, including
but not limited to the regulations ofthe FCC or the Federal Aviation Administration ("FAA") or any other federal, state or local
statutes, regulations or codes which prohibits the use of the Premises or Property for the purposes permitted hereunder; (iii) if there
occurs environmental contamination at the Property not caused by Tenant ot its use of the Property or the Premises; or (iv) if Tenant
determines, in its sole discretion, that the Premises or Tenant's Communications Facility cannot be used or operated for any other
reason including, without limitation, in the event there are no Subtenants paying rent under a lease, license or other occupancy
agreement ("Tower Attachment Agreement"). In addition, Tenant shall have the right to terminate this Agreement immediately in the
event Tenant detennines that any tests, studies, investigations or reports or the results of the title search set forth in Paragrnph I.e. arc
unsatisfactory to Tenant, in jts sole discretion, Notwithstanding any other provision contained in this Paragraph 3.d. in the event that
no Subtenant is paying rent under a Tower Attachment Agreement, Tenant shall have the option, upon written notice to Landlord, to
abate Monthly Rent (hereinafter defined) from the date such notice is sent to Landlord until such time as Tenant shall next receive rent
from a Subtenant pursuant to a Tower Attachment Agreement (such period, the '~Rental Abatement Period"). During the Rental
Abatement Perioc, 3.11 :erms, covenants and conditions contained in this Agreement, other than Tenant's obligatio!: to )Jay Montr.:y
Rent, shall remain in full force and effect unless this Agreement is otherwise terminated in accordance with the provisions hereof.

d. Add ress for Payment. The Monthly Rent and all other sums due hereunder shall be sent and made
payable to Nelson K. Eldridge, to Landlord at his USPS mailing address set forth in Section 20.
e. Taxes. Tenant shall pay any increases in real property taxes levied against the PropertY as a direct
result of me construction by Tenant of Ten ant's Communications Facility, provided reasonable satisfactory proof is given to
Tenant that such property tax increases are due to construction of Tenant's Communications Facility. Tenant shall also pay,
prior to delinquency, all taxes assessed against and levied upon trade fixtures, furnishings, equipment, antennas and all other
personal property of Tenant installed atthe Premises by Tenant. Except as otherwise set forth above, Landlord shall pay
when duo all real property taxes and assessments attnbutable to the Property. Any taxes due shall be paid quarterly.
s. Interference.
Tenant represents and warrants that Tenant's Communications Facility and all associated equipment to be
used in connection therewith will be operated in compliance with all FCC regulations and will not interfere with any existing
communications facilities at the Property. Landlord represents and warrants that there are no other communications carriers
located at the Property as of the date of this Agreement, except as set forth On attached Bxhibit E.
After the execution of this Agreement, Landlord shall not permit all or any portion of the Property or land
owned or controlled by Landlord adjacent to the Property (or improvements thereon) to be used for any purpose which
interferes with, alters or restricts the operations of Tenant's Communications Facility or Subtenant's antennas or equipment
used in connection therewith. Should such inte1ference oecur, Landlord shall promptly take all necessary action, at no cost to
Tenant, to eliminate the cause of said interference, including, if necessary removing or causing to be removed the equipment
causing said interference. Landlord agrees to ensure that any and all ofhi$ employees, agents, invitees and contractors with
potential for radio frequency exposure are made aware of the potential for exposuro and can exercise control over their
exposure.
6. Electrical and Other Facilities and Services.
Tenant and any Subtenant shall have the right to procure electrical and telephone services necessary to
operate Tenant's Communications Facility and any Subtenant's facilities. Landlord agrees to grant to Tenant or any utility
provider or Subtenant, at no additional charge, non-exclusive easements to install and maintain on the Property separate utility
meters, transformers. breakers and associated equipment, utility wires, cables, conduits and pipes extending from the Premises
over, under and through the Property to the nearest public right of way ("Utilities Easement"). All such installations shall be
subject to Landlord's reasonable approval as to the location of utility routes. Tenant or its Subtenants will pay for all such
utilities consumed at the Premises
7. Approvals.
Tenant will install, maintain, and operate Tenant's Communications Facility, Access Right of Way and
Utilities Basement at all times in material compliance with all Approvals and Tenant shall be responsible for securing and
maintaining all Approvals. Landlord will cooperate with Tenant in making application for, obtaining and maintaining any
such Approvals. Within ten (10) days of securing such Approvals, Tenant shall deliver to Landlord copies of any such
Approvals.

8. Maintenance and Repair.
During the Tenn, Tenant shall repair and maintain the Premises and Tenant's Communic3tions Facility and
shall keep same neat and cJean. Tenant shall take, at its own expense, all measures and precautions necessary to render
Tenant's Communications Facility inaccessible to unauthorized persons. Landlord shall remain responsible for maintaining all
other portions of the Property.
9. Assignment, Subletting and Exclusivity.
Tenant shall not assign this Agreement without the prior written consent of Landlord, which consent shall not be
unreasonably withheld; provided, however Tenant shall have the right without the prior written consent of Landlord to assign this
Agreement to any affiliate of Tenant and Tenant may collaterall)' assign andlor grant a security interest in its rights under this
Agreement and any other tangible and intangible personal property of Tenant to any lender, group of lenders, equity investors to secUre
debt or other obligations of Tenant to such lender(s). Tenant shall be permitted to sublease to, or share with, third parties the Premises
andlor Tenant's Communications Facility without the prior written consent of Landlord. Landlord agrees not to lease or license all or
any portion of the Property (or improvements thereon) to others for purposes of installing or operating communications facilities at the
Property.
10. Inspection.
Tenant shall pennit Landlord, its agents or representatives and any representative of any government'll
authority at all reasonable hours to have access to Tenant's Communications Facility upon prior written notice to Tenant so
long as Landlord is escorted by a representative of Tenanl
11. Title to Tenant's Communications Facility and Risk 01 Loss.
Legal title to all of Tenant's Communications Facility shall be and remain with Tenant. Tenant at all times
shall have care, custody, and control of Ten ant's Communications Facility, subject to the provisions of this Agreement, and
all of Ten ant's Communications Facility kept, itOred, or maintained on the Premises will be kept, stored, or maintained at the
sole risk of Tenant.
12. Submission of Plans.
Prior to initial installation of Tenant's Communications Facility at the Premises, Tenant shall submit to
Landlord detailed plans and specifications of the proposed installation, which plans shall depict those items requested on
Exhibit B and Q, show the proposed location of the Access Right of Way and Utility Easement. Landlord shall have twenty
(20) days from receipt of such plans to review and approve such plans and Landlord's approval shall be granted upon
Landlord initialing such plans and returning same to Tenant. In no event will Landlord's approval of such plans be deemed a
representation that they comply with applicable laws,' ordinances, rules or regulations, will not cause interference with other
communications operations, or are strUcturally sound.
13. Removal of Tenant's Communications Facility and Holdover.
On or before the expiration or earlier termination of this Agreement, Tenant shall remove Tenant's
Communications Facility from the Property, and restore it to the same condition, which existed on the Commencement Date,
ordinary wear and tear and casualty excepted. Tenant shall remove any improvements contemplated hereunder which are
pennanent in nature including, but not limited to, foundations, footings, concrete, paving, gravel. Tenant shall not be required
to remove any vegetation and underground utility lines.
14. Default.
a. Event of Default Each of the following shall be deemed to be an event of default by Tenant
("Event of Default") under this Agreement
i. The Monthly Rent or any other sum due by Tenant under this Agreement remains unpaid
for tlmty (30) days after Tenant's receipt of notice of such nonpayment; provided, however, that failure to
pay Monthly Rent during any period of abatement of Tenant's rental obligation shall not be deemed an
Event of Default.
ii. If Tenant files a petition under any section or chapter of the Federal Bankruptcy Code, as
amended, or under any similar la.w or statute of the United States or any state thereof, or Tenant becomes
the subject of any involuntary bankruptcy or insolvency in proceedings filed against Tenant thereunder and
any such involuntary J'lroceeding is not discharged within ninety (90) days of such filing. ~

thirty (30) days after written notice thereof; provided, however, that if such failure is curable but cannot be
cured within such thirty (30) day period, then if Tenant fails to cure such default within ninety (90) days

notice.
b. Landlord's Default. If Landlord fails to comply with any covenant, condition or agreement
continued hereunder if any representation or warranty of Landlord proves to have been false and such failure continues for a
period of thirty (30) days after notice thcrcofto Tenant (<'Landlord's Default"), Tenant may exercise the rights and remedies
provided in subparagraph c below.
c. Remedies. If an Event of Default shall occur, Landlord may tenninate this Agreement upon thirty
(30) days prior written notice to Tenant and Landlord may exercise any other rights or remedies which Landlord may have
hereunder, at law Or in equity. Upon the occurrence of any Landlord Default, Tenant may terminate this Agreement upon
thirty (30) days prior written notice to Landlord or Tenant may exercise any other rights or remedies which Tenant may have
hereunder, at law or in equity.
15. Damage and Destruction.
If all or any portion of the Property Or Premises or Tenant's ComnllUlications Facility is damaged by fIre or any
other cllSUalty to such an extent as to render Tenant or any Subtenant Wlable to utilize Tenant's Communications Facility, Tenant
shall have the right to terminate this Agreement by providing written notice to Landlord within ten (10) days after such casualty
occurs. If Tenant elects to rebuild or restore rather than terminate this Agreement pursuant to this paragraph, Tenant shall be
entitled to abate the Monthly Rent due during the period of time Tenant's Communications Facility (including any temporary
facility) are rendered unsuitable, in Tenant's reasonable opinion) for Tenant's use,
16. Condemnation.
Irall or any pornon of the Property shall be taken Or condemned for any public purpose to such an extent as
to render Tenant or any Subtenant unable to utilize Tenant's ~mmunications Facility, this Agreement shall, at Tenant's
option, forthwith cease and terminate. Tenant shall have no claim to any part of the condemnation award, except for the value
of Tenant's leasehold interest in the Premises, the loss of use of Tenant's Communications FaciI1ty and for moving expenses.
17. Ten:ant!1I Insurance.
s.. TenllDt!s Insurance. Upon gaining all necessary approvals from municipal, state and federal
authorities to operate Tenant's Communication Facility, Tenant shall activate, commence and maintain the following
insurance during the Tenn of this Agreement and shall provide Landlord with proof of such insurance:
i. general liahility insurance, with contractual liability endorsement, for claims for bodily
injury or death and property damage with combined single limits of not less than $2,000,000 per
occurrence;
ii. worker's compensation insurance in statutory limits.
lU. if Tenant operates owned, hired or non-owned vehicles on or about the Property,
comprehensive automobile liability insurance with a limit of not less thlln $500,000 combined bodily injury
and property damage; and
iv. all-risk extended coverage casualty and property damage insurance for Tenant's
Communications Facilit}' for the full insurance value thereof (Le. actual replacement cost without deduction
for physical depreciation).
Each such policy shall list Landlord as an additional insured (except workers' compensation), and
shall provide that it will not be terminated during the Te:111 to affect the coverage required except after
rbirty (30) days prior notice thereof to Landlord.
b, Certificates of Insurance. Tenant shall, within thirty (30) days following Tenant's occupancy
and annually thereafter, furnish to Landlord certificates of imiurance evidencing the requirements under this Paragraph.
c, Landlord!s Insurance. In the event that Landlord builds a dwelling on Property, Landlord
llgfees, at all times, to carry and maintain comprehensive, oustomary property-casualty insurance and extended coverage
insurance C()vering any improvements on the Property in reasonable amounts.

d, Waiver of Subrogation. To the extent allowable under the laws and regulations goveming
insurance within the state in whieh the Property is located, Landlord and Tenant each release the other and their respective
agents and employees from all liability to each other, or anyone claiming through or under them, by way of subrogation or
otherwise, for any loss or damage to property caused by or resulting from risks imured against under this Agreement, pursuant
to insurance policies required to be carried by the parties which are in force at the time ofthe loss or damage. Landlord and
Tenant will each cause its insurance carrier to include in the policies provided pursuant to thig Agreement an endorsement
recognizing this waiver of subrogation. The provisions of this Paragraph shall survive the expiration or termination of this
Agreement
18. Liability.
a. Indemnity by Tenant. Tenant will indemnify, defend and save hannless Landlord and its
partners, trustees, beneficiaries, directors, officers, employeesl affiliates and agents from and against any and all claims, loss,
damage, liability, and expenses (including without limitation attorneys' fees ll11d disbursements), occasioned by, or arising out
ofTenantls use of the Premises or any act or failure to act by Tenant, its agents, officers, empk)y~es or contraetors including,
without limitation, the failure by Tenant to comply with its obligations under Paragraph 25(g)
b. Indemnity by Landlord. Landlord will indemnify, defend and save harmless Tenant and its
partners, trustees, beneficiaries, directors, officers, employees, affiliates and agents, and Subtenants from and against any and
all claims, loss, damage, liability, and expenses (including without limitation attorneys' fces and disbursements and
investigative, remedial. sett1eme~ compliance and response costs in connection with the breach of any environmental
representation or warranty under Paragraph 25(g), occasioned by, or arising out of this Agreement directly or indirectly or
Landlord's use of the Property Or any act or failure to act by Landlord, his agents, officers, employees or contractors.
19. Right of First Refusal.
If at any time during the tenn of this Agreement Landlord receives an irrevocable (except such offer may be
conditioned upon the non-exercise of this right ofmst refusal) bona fide written offer from Ii third person ("Offer") to sell,
a!lsign, conveyor otherwise transfer its interest in the Premises and/or Property, which Landlord desires to accept, Landlord
shall flTst give Tenant written notice (including a copy of the proposed contract) of such Offer prior to becoming
unconditionally obligated. Tenant shall have 8. period of thirty (30) days after receipt of Landlord's notice to accept the Offer
and exercise its right of First Refusal to purchase the Premises andlor Property by notifying Landlord in writing. After thirty
(30) days the Offer will be deemed rejected. Exempt from this provision are transfers by operation of law and transfers to a
spouse. immediate family member or the trustee of a trust for the benefit of the Landlord, or such spouse, or immediate family
member.
20. Notice.
Any notice, communication, request or reply in this Agreement required to be given, must be in writing and
shall be effectively given if sent by telecopy and deposited in the United States mail, postage prepaid, certified or registered
and addtessed to the Party to be notified, or if sent by a nationally recognized, reliable overnight courier or if delivered in
person to such Party. Any noticc mailed shall be effective, unless otherwise stated in this Agreement, from and after the
expiration of seven (7) days after it is deposited in a depository of the United States Postal Service and the next day ifsent via
an overnight courier. For purposes of notice the addresses of the Parties shall, until changed as hereinafter provided, be as
follows;

The Parties may from time to time change their respective notice address by giving fifteen (15) days prior written notice in
accordance with the tenns above.
22. Liens.
a. Mechanic's Liens. Tenant shall keep the Property and Promises free from any mechanic's,
materialmen's or similar liens in connection with any work on or respecting the Premises not performed by or at the request of
Landlord, and Tenant shall indemnitY and hold Landlord ha.rmless from and against an)' claims, liabilities, judgments, or costs
(including attorneys' fees and disbursements) arising out of the Mme. Tenant will remove any such lien within ten (lO) days
after written notice by Landlord, and if Tenant fails to do so Landlord may pay the amount necessary to remove such lien or
encumbrance, without being responsible for investigating the validity thereof, and the amount so paid will be deemed an
additional charge to be paid be Tenant hereunder upon demand.
b. Lien Disclaimer. Landlord disclaims and waives any now existing or hereafter arising landlord's
lien or other statutory or non-statutory lien or security interest in Tenant's Communications Facility and/or its Subtenant's
facilities, equipment, improvements, frxtures or other property.
23. Mortgages/Security Interests.
a. Mortgages/Security Interests Encumbering L.andlord's Interest. This Agreement may be
subordinate to any mortgage, deed of trust or other hypothecation for security by Landlord which from time to time may
encwnber all or any part of Landlord's interest in the Property, and to all renewals, modifications, consolidations,
replacements and extensions thereo~ provided that every such mortgagee shall recognize (in writing and in a fonn reasonably
acceptable to Tenant) the validity of this Agreement in the event ofa foreclosure of Landlord's interest and also Tenant's
rights under this Agreement, including, but not limited to, the right to remain in occupancy and have access to the Premises in
accordance with the tenns of this Agreement as long as Tenant is not in default of this Agreement, unless this Agreement is
otherwise terminated or expires by its terms. Tenant shall promptly execute whatever instruments may reasonably be required
to evidence this subordination. If, as of'the date of execution of this Agreement, there is any deed of trust, mortgage, ground
lease or other similar encumbrance affecting the Property, Landlord agrees to use reasonable efforts to obtain from the holder
of such encumbrance an agreement that Tenant's rights under this Agreement shall not be disturbed so long as there does not
exist an Event of befault. Such agreement shall be signed by such security holder within 90 days of signing this Agreement,
or Lessee, at his option, may cancel this agreement upon written notice as provided herein.
b. Leasehold Mortgages/Security Interests. Landlord hereby agrees, for the benefit of the holder
ofa leasehold mortgage or the holder of any other security interest in Tenant's interest in this Agreement and/or Tenant's
Communications Facility ("Lender"), that:
i. Landlord wiIJ send a copy of any notice of an Event of Default to Tenant and to each
Lender of which Landlord has notice; and no such notice to Tenant shall be deemed to have been duly
given, nor shall such notice be effective, unless such notice is also given to each known Lender.
it lfTenant shall default in respect of sny provisions of this Agreement, any Lender shall
have the right, but not the obligation, to cure such default, and Landlord shall accept performance by or on
behalf of Lender as thought it had been done or perfonned by Terumt. A Lender wiu have the swnc period
of time after delivery of such notice upon it within which to cure the default specified in sueh notice, or
cause it to be cured, which is the same period for cure, if any, as given to Tenant. Landlord agrees that it
shall allow the Lender additional time beyond any cure period provided herein as follows: (a) in the case of
a monetary default, an additional period of ten (10) days to cure the default or (b) in the case of a
non-monetary default, an additional period of thirty (30) days to CUre the default or to commence to cure the
default; provided, however, that the Lender shall give written notice to Landlord of such Lender's intention
to so cure Tenant's default prior to the expiration of any such cure period of Tenant hereunder,
iii. If, in order to cure any default by Tenant. a Lender, pursuant to its advice of its intent to
do 50 pursuant to subparagraph ii. above that it elects to pcrfonn any act or acts other than the payment of
Monthly Rent or other sUn'l8 owed to Landlord hereunder, and if the default is reasonably susceptible of
being cured by Lender only after Lender obtains possession of the Premises by appointment of a receiver,
institution of foreclosure proceedings or otherwise Landlord shall take no action, to effect a tennination of @
this Agreement until the Lender has bad a reasonable opportunity to cure such defau It and to institute and C\l,'
with reasonable diligence complete foreclosure or other appropriate proceedings to acquire possession of \
and control over Tenant's interest under this Agreement; but upon condition that the Lender shall (x) pay all
Monthly Rent and other SUlIUl owed to Landlord hereunder on 8 timely basis, (y) diligently pursue obtaining

possession of the Premises by foreclosure or otherwise, and (z) diligently proceed to cure such default. No
Lender shall be required to commence or continue any foreclosure or other proceedings or to obtain or
continue possession of the Premises, except as specified above as a prerequisite for exercise or preservation
of Lender's rights.
iv. A Lender may succeed to the interest of Tenant under this Agreement by foreclosure or
other enforcement proceedings, or by obtaining an assignment of this Agreement in lieu of foreclosure or
through settlement of or arising out of any pending or threatened foreclosure proceeding, without Tenant's
consent, but ~uch interest shall be subject and subordinate to Landlord's fee interest in the Premises. In
such event, Lender shall have the right thereafter to assign this Agreement, upon prior written consent by
Landlord, which consent shaH not be unreasonably withheld. Any such assignee consented to by Landlord
shall take such assignment subject and subordinate to all terms of this Agreement. Lender shall
immediately give written notice to Landlord of the name and address of such assignee. Such assignee shall
become the Tenant, and shall be substituted for the Lender as the owner and holder of this Agreement for all
purposes, as of the effective date of such assignment; and from and afterthe effective date of such
assignment Lendor shall be released from aJI liability under this Agreement thereafter arising (it being
understood that Tenant shall continue to be liable for sums due Landlord hereunder which may have
accrued prior to such effective da.te of such assignment) or extensions thereof, and all indebtedness now 01'
hereafter secured thereby and all interest therein.
v. A Lender may enter the Premises and remove Tenant's Communications Facility without
liability to Landlord, except damages to persons or property caused by such removal, sO long as the Lender
otherwise complies with the terms of this Agreement.
24. Estoppel Certificate. Each party agrees to execute, acknowledge and deliver, within twenty (20) days after
written request from the other party, an estoppel certificate containing terms reasonably acceptable to the requesting party.
2~. Miscellaneous.
a. Partial Invalidity. Ifany tenn or provision oftrus Agreement, or the application thereof to any
person or circumstance, shall to any extent be invalid or unenforceable, as finally determined by a court of competent
jurisdiction, the remainder of this Agreement or the application of such term or provision to persons or circumstances other
than those as to which it is invalid or unenforceable, shall not be affected thereby, and each tenn and provision of this
Agreement sha.ll be valid and enforced to the fullest extent permitted by law.
b. Attorney's Fees. If either party fails to perform any of the tenus, covenants, agreements or
conditions contained in this Agreement and the other party places the enforcement of this Agreement, or any pan: thereof, or
the collection of any sums duc, or to become due hereunder in the hands of any attorney, or files suit upon same, the
non-prevailing party agrees to pay all of the prevailing party's reasonable costs associated with the same including reasonable
attorneys' fces and disbursements.
c. Non- Waiver. Failure of any party to insist on strict perfonnance of any of the conditions,
covenants, terms or provisions of this Agreement or to exercise any of its rights hereunder shall not waive such rights, but
such party shall have the right to enforce such rights at any time and take such action as might be lawful or authorized
hereunder, either in law or in equity. The receipt of any sum paid by Tenant to Landlord after 8 breach of this Agreement
shall not be deemed a waiver of such breach unless expressly set forth in writing.
d. Entire Agreement and Amendment. :This Agreement constitutes the entire agreement and
understanding between the parties, and supersedes all offers, negotiations and other agreements conoerning the subject matter
contained herein. Any amendments to this Agreement must be in writing and executed by both Parties.
e. Binding Effect, Gender and Captions. This Agreement shall be binding upon and inure to the
benc"ii of l:lc successors and assigns of Landlord, and shall be binding upon and inure to the benefit of Tenant, its successors.
Subtenants and, ro the extent assignment may be approved by Landlord or permitted hereunder, Tenant's assigns. The
pronouns of any gender shall include the other gender, and eithcr the singular or the plural shall include the other. The
captions ofthis Agreement have been inserted for convenience only Bnd are not to be construed as part of this Agreement or
in any way limiting the scope or intent of its provision.

f. Governing Law. All of the terms of this Agreement shall be construed according to the laws of
the State in which the Property is located.

g. Environmental.
j, Tenant shall not bring onto or pennit to be brought onto the Property any Hazardous
Substances, except for those contained in back-up power batteries (e.g. lead-acid batteries) and properly
stored, reasonable quantities of common materials used in telecommunications operations (e.g. cleaning
solvents) HHazardous Substances" means any substance, chemical, pollutant, or waste that is presently
identified as hazardous, toxic or dangerous under any applicable federal, state or local law or regulation and
specifically includes but is not limited to asbestos and asbestos containing materials, polychlorinated
biphenyl's (PCBs) and petroleum Of other fuels (including crude oil or any portion or derivative thereof).
ii. Landlord hereby represents and warrants to Tenant that Landlord has no actual knowledge
that the Property, a portion of which consists of the Premises, is or has been contaminated by any Hazardous
Substances, except as set forth in below (ui.).
Hi. Landlord Environmental Disclosure: Prior to Tenant commencing any construction, at
Landlord's expense, Landlord agrees to remove a 300 gallon underground gas tank.
h. Recordation. Either party, at its expense, may record a memorandum of this Agreement and the
other party shall cooperate in executing and delivering same.
i. Force Majeure. Neither Landlord nor Tenant shall be liable for aIlY unanticipated matter beyond
its reasonable control, such as acts of God, riot, strike, insurrection, terrorist acts and or declared or undeclared acts of war,
j. Brokers. Landlord and Tenant each represent and warrant to the other that it has not had any
dealings with any broker or finder which may result in any liability for a brokerage or fmder's fee, and each party hereby
agrees to indenmify, defend and hold the other harmless from and against any and all costs (including reasonable attorneys'
fees), liabilities, losses, damages, claims, causes of action or proceedings which may result from any breach of such
representation.
k. Interpretation. Bach party to this A.greement and its counsel have reviewed and had the option to
revise this Agreement. The normal role of construction to the effect that any ambiguities are to be resolved against the
drafting party will not be employed in the interpretation ofthis Agreement or of any amendments or exhibits to this
Agreement
1. Title and Quiet Enjoyment. Landlord represents and warrants that: (i) To the.best of Landlord's
knowledge, Landlord has sufficient right, title and interest in the Property to enter into this Agreement and to grant Tenant its
rights hereunder; (ii) To the best of Landlord's knowledge, there are no matters affecting title that would prohibit, restrict or
impair the leasing of the Premises or use or occupancy thereof in accordance with the tenns and conditions of this Agreement;
and (tii) SO long as Tenant complies with the teIIllB and conditions of this Agreement, Tenant and all Subtenants will have
quiet and peaceful possession of the Premises, Access Right of Way and Utilities Easements throughout the Term.

THIS ASSIGNMENT AND ASSUMPTION OF LAND LEASE AGREEMENT is made as of the 4111 day of
November 2002. by and between US TOWER GROUP, L.L.C. a limited liability company duly organized under
the laws of the State of Delaware, with a principal place of business located at 1770 Massachusetts Avenue,
Suite 590, Cambridge, Massachusetts 02140 as ("Assignor") and EASTERN TOWERS, L.L.C., a limited liability
company duly organized under the laws of the Commonwealth of Massachusetts with a principal place of
business located at 8 Doaks Lane, Marblehead, Massachusetts 01945 ("Assignee").
WITNESSETH
WHEREAS, Assignor and NELSON K. ELDRIDGE an individual with an address of 2 Eldridge Lane,
Village of Siasconset, Town of Nantucket. Massachusetts 02564 ("Landlord") are partIes to a lease dated
October 31,2002, as amended, (the "Ground Lease"), a copy of which is attached hereto as Exhibit "A," with
respect to a 3,600 square foot area of ground space on the property located on an approximate .46 acre lat
located at 5 Eldridge Lane, Village of Siasconset, Town of Nantucket, Nantucket County, Commonwealth of
Massachusetts, 02564 (the "Leased Premises"); and
WHEREAS, Assignor desires to assign to Assignee all of the Assignors rights, title and interests to the
Leased Premises and assign all obligations under the Lease; and
WHEREAS, the Assignee desires to acquire all of the Assignor's rights, title and interests to the
Leased Premises and assume all obligations under the Lease; and
WHEREAS. under the terms of the Lease, such assignment is expressly contingent upon the
Landlord's executing its consent of said assignment, a copy of which is attached hereto as Exhibit "S" and
Incorporated herein by reference.
NOW, THEREFORE, in consideration of the foregoing, and other good and valuable consideration, the
receipt and sufficiency of Which is hereby acknowledged, the parties hereto intending to be legally bound
thereby, do hereby covenant and agree as follows:
1. Assignor hereby assigns to Assignee and Assignee hereby assumes, as of the date first written above, at!
of the Assignor's rights, title and interest in, to and under the Lease.
2. Assignee hereby. assumes and undertakes to paYI satisfy and dilScharge all of the obligations of Assignor
in. to and under the Lease arising or accruing on and after the date first written above. Assignee further
agrees to comply with and be bound by all of the covenants. conditions, provisions. commitments. terms,
obligations and agreements specified in the Lease to be kept and performed on the part of the As5ignor on
or after the date first written above.
3. Assignor represent!! and warrants that this Assignment and Assumption of Land Lease does not constitute
a breach of the Lease.
4, This Assignment and Assumption of Land Lease Agreement shall be binding upon and inure to the benefit
of the parties hereto and their respective successors and assigns.

This report discusses AT&T Wireless' need for a wireless communications facility at the
above Property.
QUALIFICATIONS
I am a Radio Frequency Specialist for AT&T Wireless. I have extensive experience in
the design and testing of AT&T Wireless' wireless communication facilities as part of its
federally licensed network in Massachusetts. For example, I have participated in the design and
performance of the AT&T Wireless' network in Massachusetts, participated in engineering
efforts to provide a quality system build-out, evaluated zoning provisions applicable to wireless
communication facilities in various communities, testified before local zoning boards in zoning
hearings, prepared search areas for new installations, participated in drive tests and reviewed
drive test results, participated in site visits, prepared RF designs for proposed installations,
reviewed plans and prepared RF packages for zoning hearings, tested and evaluated new sites,
and located and corrected system performance problem areas.
I have been involved in AT&T Wireless' design of the proposed wireless communication
facility at the above Site. I have personally visited the area, reviewed coverage data for the
proposed installation, and reviewed RF coverage information for AT&T Wireless' existing sites
and potential alternative locations.
AT&T WIRELESS' FACILITY
On behalf of AT&T Wireless, I have determined that a coverage gap exists in the area of
the proposed Wireless Communications Facility. The purpose of installation of the proposed
facility is to address this coverage gap.
As shown on the enclosed plans, the proposed facility consists of the installation of three
(3) sectors of wireless communication antennas inside a 80' internal mount monopole that will be
designed to look like a flagpole. AT&T Wireless proposes to install antennas at a center line
elevation of 77' +/- above ground level (AGL). The antennas will be connected to
telecommunications equipment in up to two (2) Ericsson RBS 2106 equipment cabinets located
at the base of the tower, within the proposed equipment compound, by means of coaxial cables
running down the inside of the tower.l The antennas will be mounted inside the tower, such that
they will not be visible from the exterior. To the greatest degree feasible, therefore, the antennas,
cabling and ground equipment will be withdrawn from view, as shown on AT&T Wireless'
plans. The facility will be connected to standard electric and telephone utilities.
The proposed PCS wireless facility will enhance wireless telephone service to the
residents and businesses of Nantucket. Through a fully digital system, this technology affords
improved reception, more private communication, increased ability to handle data, short
messaging, enhanced cellular battery life, and other technological advances.
AT&T WIRELESS' NETWORK
AT&T Wireless is licensed by the Federal Communications Commission to provide
wireless phone service in areas across the country, including the Boston Metropolitan Trading
Area ("MT A"). Cape Cod & the Islands are located within the Boston MT A, and therefore
AT &T Wireless is licensed to provide wireless phone service within the Town of Nantucket.
Wireless phone coverage is provided by placement of a number of low-power antenna
sites within a given area. The sites are spaced so that the coverage from each location overlaps
with its neighboring sites. When a call is placed on a certain site, the phone monitors the signal
from the serving site, as well as the signal of all of the adjacent sites. When the phone receives a
stronger signal from an adjacent site, it requests a transfer from the site it is currently using to the
stronger site. If there is seamless coverage provided by the carrier, the call will transfer without
interruption. If there is a lack of appropriate signal strength at the transfer point, the call will
degrade and possibly drop.
This facility will be installed in two stages. The initial build will consist of one antenna per sector and one
Ericsson ground equipment cabinet. One additional antenna per sector and one additional Ericsson equipment
cabinet will be installed as AT&T Wireless' capacity and technology needs arise. See the zoning drawings
submitted herewith for further detail.
THE NEED FOR THE PROPOSED FACILITY
To demonstrate why the proposed facility is necessary, I have attached two coverage
maps of Nantucket showing AT&T Wireless' existing and proposed Wireless Communications
Facilities (one map without the facility at the Eastern Towers site and the other map with the
facility at the Eastern Towers Site).
These coverage maps were generated using an RF Propagation computer-modeling
program. The software takes into account the geographical features of the area, antenna models,
antenna heights, and RF transmit power. The maps represent existing and proposed antenna
locations, and the areas that currently have quality wireless phone service based on these
locations. Any phone that travels outside of the effective coverage area will have a high
likelihood of a degraded and possibly dropped call.
As the coverage maps show, without the proposed facility, AT&T Wireless has a
significant gaps in its coverage on much of the island. These are high-demand areas in which
AT&T Wireless lacks adequate communications network service without the proposed facility.
The installation on the proposed tower will provide coverage in the Siasconset area.
AT&T Wireless has examined the area for the most appropriate means of providing the
required coverage. I have determined that installing antennas at the stated height in the area of
the coverage gap is the only feasible way of providing wireless communication coverage within
this area of Nantucket. Since there is no existing structure that can provide this height, the only
option is to install a new structure at the necessary height at the proposed location.
The proposed facility must be located at this elevation due to technical, topographical and
other unique circumstances relating to the coverage gap, including the ground elevation at the
proposed tower site. The proposed facility represents the least intrusive means of addressing the
significant gap in AT&T Wireless' coverage. Given the topography of the area, and the
limitations on PCS Wireless technology, AT&T Wireless needs the installation to serve this area
of Nantucket.
THE USE WILL NOT CAUSE A DETRIMENT
The use does not result in a substantial detriment to the neighborhood for a variety of
reasons:
By proposing a tower that is no higher than necessary, by using a "stealth" design that
will eliminate any adverse visual impact and by using small equipment cabinets inside a fenced
compound at the base of the tower, AT&T Wireless has minimized the visual and aesthetic
impacts of the proposed facility to the greatest degree feasible.
The proposed tower will be specifically designed and built by Eastern Towers for
collocation of multiple wireless carriers including AT&T Wireless, resulting in the reduction of
the overall number of new structures required on Nantucket to provide wireless coverage.
AT&T Wireless has no objection to collocation by future wireless carriers, not inconsistent with
AT &T Wireless' use. AT&T Wireless' design is based on the minimum equipment necessary
and the minimum height necessary to achieve the coverage objective based on current and
anticipated future use.
The use is passive, requires no employees on the premises after initial installation, and
generates only about one vehicle trip per month. The installation is served by standard electrical
service, and requires no water, sewer or other town services. The facility complies in all respects
with RF emission standards established by the Federal Communication Commission and the
Massachusetts Department of Public Health. The proposed tower will not require any lighting or
marking under FAA and Massachusetts Aeronautical Commission guidelines. The facility will
generate no objectionable noise, vibration, smoke, dust, odors, heat, glare or other effects.
CONCLUSION

RBS 2106 is a high capacity. outdoor macro radio
base station supporting up to twelve transceivers per
cabinet. It is possible to build one, two and three sector
configurations including dual band configurations in one
cabinet.

Part of the grow-on-site concept
Since it is becoming increasingly difficult to find new
base station sites, it is of great interest to remain on the
existing sites as long as possible. Site space is otten a
limiting factor for capacity growth. The powerful RSS
2106, included in Ericsson's grow-on-site toolbox,
addresses this problem. On many sites, two or more
existing cabinets can be replaced by one RSS 2106.
This is of major importance, since it makes it possible
to reuse the space to rollout WCDMA equipment. The
RSS 2106 will pave the way for WCDMA
Also interesting for new locations, the RSS 2106 offers a
complete solution in stand-alone cabinet which rapidly
can be implemented outdoors. All the units to run the
RSS are included in this single cabinet, there is no need
for an extra product.
Doubled capacity - superior performance -
same footprint
The 12-transceiver RSS 2106 cabinet has the same
footprint as RSS 2102, but has doubled the capacity,
thanks to the new double-capacity transceivers and
combiners. The RSS 2106 has better output power than
the current RSS 2000 products, which are the best on
the market today. The improved radio performance
means increased site-to-site distance, and therefore,
fewer sites. Another example of a cost saving feature
is 121 km Extended Range. The RSS 2106 comes with
a configuration switch unit, the CXU, and two extremely
flexible combiners. Examples of configurations
supported by the Filter Combiner (CDU-F) are 3x4,
2x6, lx12 and dual band 8+4 in one cabinet. CDU-F
supports up to 12 transceivers on one dual-polarized
antenna. The other combiner (CDU-G) can be configured
in two modes: capacity mode and coverage mode,
making it very flexible. In coverage mode, the output
power from the CDU-G is increased, making it perfect
for rural sites or when fast rollout is required at a
minimum cost.
Prepared for the future
The RSS 2000 family is prepared for GSM data services,
including General Packet Radio Service (GPRS) and
High Speed Circuit Switched Data (HSCSD) including
14.4 kbiVs timeslots. To meet the operators' need for
faster datacom solutions, RSS 2106 supports EDGE.

internal buses guarantee full EDGE support. With the
optional SSS feature RSS 2000 synchronization, it is
possible to have up to 32 transceivers in one cell.
