MURPAY, ET UX (003-79), after due deliberation, the Board found: 1. The Petitioners' existi_ng husiness structure at 62 Main Street, Lot Al on Land Court Plan No. 15185-C; is a one-story co~ercial huilding which covers 80% of the lot. They wish to expand the business by adding a second story to a total height of 30 feet. They request a Special Permit to expand the structure by 1938 square feet beyond the permitted floor area ratio to a total of 3959 square feet, and a variance from the required loac- ing facilities. 2. This property is located in a fully-built corrunercial neighborhood where most of the buildinqs are two-story co~mercial structures. The surroundings do not allow any expansion laterally and provide no adequate space for loading facilities. The nature of the business (retail clothing) does not require frequent deliveries. The HDC, which has primary responsibility for the visual integrity of Main Street, has approve~ the external appearance of the building. 3. "'ho Pet_itionf>rf-i have' il 1-1ilnlship rluc~ to the size and shape of the structure on this lot in this area. 7\. 1 i tera 1 enforcement of the ))V-1<1\'1 woul c1 i tJ vol vc ~; ub- stantial hardship to the petitioners and relief may be granted from the loading reauirements without substantial detriment to the public good and without nullifying the intent and purpose of the by-law. The requested expan- sion of the building would not be substantially more detrimental than the existing non-conforming use to the character of the neighborhood. On motion duly made and seconded, it was unani- mously voted: 1. To grant the exemption from the loading facilities required by the by-law. 2. To grant the Special Permit for expansion of the building at 62 Main Street as requested. /, /\ . I " --7 ,! , / I r I .'/! ....
