MANSFIELD AND BARBARA A. MANSFIELD, Trustees of Mansfield Nominee Trust udt 12/7/99, of P.O. Box 3422, Nantucket, MA 02584, Board of Appeals Application No. 033-03, the Board made the following Decision: 1. Applicants are seeking relief by Variance under Nantucket Zoning By-law, Section 139-16A (Intensity Regulations - minimum lot size) to validate an existing lot as separately marketable from all adjoining parcels. The lot, containing about 77,412 square feet of area, in a district that requires a minimum lot size of 80,000 square feet, was created from one lot that was subdivided into six lots of similar size in 1978. All lots were certified by a registered engineer as containing 80,000 square feet, when in fact five of the lots contained less than 80,000 square feet. The Applicants constructed the dwelling in 1979 and received a Certificate of Occupancy in 1990 based on an as-built survey plan also indicating that the Lot had a minimum of 80,000 square feet of lot area. The garage received a Certificate of Occupancy in 1991 with the as-built not stating the lot area. The structures do not exceed the maximum ground cover allowed in this district and all other dimensional zoning requirements are met. The Board has issued similar relief to four of the other lots in said subdivision in the Decisions in BOA File Nos. 020-93, 063-93, 064-93 and 039-99. The Locus contains a single-family dwelling and a garage. The Premises are located as 12 Greenleaf Road, Assessor's Map 39, Parcel 46, Land Court Plan No. 15209-F, Lot 63. The property is zoned Limited- Use-General-2. 2. The Decision is based upon the Application and materials submitted with it and the testimony and evidence presented at the hearing. The Planning Board made no recommendation, as the matter was not of planning concern. There were no letters on file. , . 3. Applicants, through counsel, represented that the Lot in question was part of a single parcel, which was separated into a six-lot subdivision in 1978, when the area was zoned LUG-2 with a required minimum lot area of 80,000 square feet. Of the six lots, the plan showed one conforming lot that contained approximately 89,000 square feet, and five supposedly conforming lots all containing 80,000 square feet of lot area. The plan was stamped by a registered engineer and recorded in the Nantucket Registry District of the Land Court as Land Court Plan 15209-F. The Engineer was now deceased and thus an explanation of his calculations was no longer available. The five lots did not in fact contain 80,000 square feet of lot area as certified by the engineer. They actually contained about 77,413 square feet of lot area, less than the minimum required in this zoning district. After the plan was recorded, the lots were sold into separate ownership from any abutting land. Most of the lots, including the Applicants' lot, have been improved with dwellings and other ancillary structures as a result of Building Permits, and in some cases Certificate of Occupancy Permits, having been issued based upon said erroneous survey. Applicants represented that there were no options to cure the defect, as there was no possibility of acquiring any additional land area from abutters to make the Lot conforming. Similar Variance relief benefiting the other four substandard lots within the same subdivision has already been granted by this Board to validate their respective subminimum lot sizes and structures contained thereon. The Applicants built their dwelling in 1979 and obtained a Certificate of Occupancy in 1990. The "as-built" surveyed plot plan indicated that the lot area was 80,000 square feet. In 1991 the Applicants obtained another Building Permit for a garage and obtained a Certificate of Occupancy for that structure in the same year. The "as-built" plot plan done for the latter structure did not set forth the lot area. The deficiency in lot area for the Premises was not confirmed until after the Applicants constructed the garage. The existing structures on the Lot did not exceed the maximum allowable ground cover and the Locus met all other dimensional requirements. 4. Therefore, the Board finds that due to the unique circumstances relating to this subdivision and in particular the Locus, (the erroneous certification of lot area by a now-deceased Registered Engineer against whom no recourse is available by the Applicant, and there being no adjacent undeveloped land available to make up for the area deficiency), a literal enforcement of the provisions of the Zoning By-law relating to the minimum lot area would involve substantial hardship to the Applicants, and the desirable relief by Variance to validate the Lot as separately marketable and buildable as well as validating the structures on the Lot as presently configured, may be granted without nullifying or substantially derogating from the intent or purpose of the By-law, and would not constitute a substantial detriment to the neighborhood. The Board notes that the Applicants relied upon a survey done by a licensed engineer and then built their structures in compliance with duly issued Building Permit Nos. 1081-79 and 7394-90, and further finds that demolition of said structures would be of no public benefit. 5. The lot contains 77,413 +/- square feet in the LUG -2 Zone which requires a minimum lot area of 80,000 square feet. The premises are located at 12 Greenleaf Road, Assessor's Map 39, Parcel 46, as shown on Land Court Plan 15209-F, Lot 63. The property is zoned LUG-2. Due to the unique circumstance relating to this subdivision and the unavailability of other options to cure the defect, a literal enforcement of the provisions of the zoning by-law relating to minimum lot area would involve substantial hardship to the Applicants, and the desirable relief may be granted without nullifying or substantially derogating from the intent or purpose of the Bylaw and the Board may grant the relief requested by Variance. ',1 ADDENDUM Applicants are seeking relief by Variance under Section 139-32A from the requirements of Section 139-16A (Intensity Regulations - minimum lot area) to validate an existing lot as separately marketable and buildable. The lot contains 77,413 +/- square feet in the LUG -2 Zone which requires a minimum lot area of 80,000 square feet. The premises are located at 12 Greenleaf Road, Assessor's Map 39, Parcel 46, as shown on Land Court Plan 15209-F, Lot 63. The property is zoned LUG-2. The lot in question was part of a single parcel which was subdivided into a six (6) lot subdivision in 1978, when the area was zoned LUG -2 for a required minimum lot area of 80,000 square feet. Of the six (6) lots, the plan showed one (1) lot containing approximately 89,000 square feet and the remaining five (5) lots each containing 80,000 square feet. The plan was stamped by a Registered Engineer and recorded in the Nantucket Registry District of the Land Court as Land Court Plan 15209-F. The lots do not contain 80,000 square feet as certified by the Engineer. They actually contain 77,413 +/- square feet, less than the minimum lot size required under zoning. After the plan was recorded, the lots were sold and developed. The Applicants built a dwelling in 1979 and obtained a Certificate of Occupancy in 1990. The 1990 "as-built" indicated that the lot area was 80,000 square feet. The Applicants obtained a Building Permit for a garage in 1991 and obtained a Certificate of Occupancy in 1991. The as-built plan for the garage did not set forth the lot area. At this time the Applicants learned of the lot area discrepancy. The existing structures do not exceed the allowable ground cover and all other dimensional requirements are met. This Board has granted Variances for the other lots in this subdivision with the same problem: File No. 020-93 for 18 Greenleaf Road (Lot 66); File No. 063-93 for 16 Greenleaf Road (Lot 65); File No. 064-93 for 14 Greenleaf Road (Lot 64); and File No. 039-99 for 20 Greenleaf Road (Lot 67). Due to the unique circumstance relating to this subdivision and the unavailability of other options to cure the defect, a literal enforcement of the provisions of the zoning by-law relating to minimum lot area would involve substantial hardship to the Applicants, and the desirable relief may be granted without nullifying or substantially derogating from the intent or purpose of the Bylaw and the Board may grant the relief requested by Variance.
