AND ELIZABETH N. WERDIGER, of PO Box 216,8 Cottage Avenue, Purchase, NY 10577, Board of Appeals File No. 029-03, the Board made the following Decision: 1. Applicants are seeking relief by SPECIAL PERMIT under Nantucket Zoning By- law Section 139-33A (alteration/expansion of a pre-existing nonconforming structure/use). Applicants propose to relocate the existing secondary dwelling further to the rear of the Locus without increasing the footprint or increasing the side yard setback intrusions. The Locus is nonconforming as to lot size, having a lot area of about 3,912 square feet in a district that requires a minimum lot size of 5,000 square feet; as to frontage with the Locus having about 44.97 feet of frontage along Main Street in a district that requires a minimum frontage of 50 feet; as to side yard setback, with the main mass ofthe dwelling being sited as close as about 4.1 feet from the easterly side yard lot line, and with the cottage being sited as close as about two feet from the easterly side yard lot line and as close as about 2.4 feet from the westerly side yard lot line, in a district that requires a minimum side yard setback of five feet; and as to parking with no space provided on site. See also BOA File Nos. 043-02, 088-92 and 006-84. The Premises is located at 154 and 154R MAIN STREET, Assessor's Map 41, Parcels 513 and 514, Land Court Plan No. 35205-A, and Plan Book 17, Page 82. The property is zoned Residential-Old-Historic. 2. The Decision is based upon the Application and the material submitted with it and the testimony and evidence presented at the Hearing. The Planning Board made no recommendation finding that the matter did not present any issues of planning concern. There were no letters on file. 3. The Applicants represented that as part of an overall renovation of an existing secondary cottage, they proposed moving it to a location further to the rear of the principal dwelling, in a southerly direction without expanding the existing ground cover. The structure would be conforming as to rear yard setback. However, the structure is currently sited as close as about 2.4 feet from the westerly side yard lot line and as close as about two feet from the easterly side yard lot line. When relocated it will be sited no closer to those lot lines than presently sited and have a maximum roof ridge height of 16 feet. The overall maximum ground cover ratio permitted for this Lot is about 39.<)0.10, allowed by Modification of a Special Permit granted in the Decision in BOA File No. 043-02, which modified the Decision in BOA File No. 088-92, and would be maintained. The Locus is also benefited by Special Permit relief granted in the Decision in BOA File No. 006-84, which allowed an enlargement of the primary structure. As part of the renovation of the structure, Applicants proposed to remove the northerly section ofthe structure and reapportion the square footage of said portion by constructing a conforming addition on the southerly side ofthe structure. Due to the reduction in lot width as the lot lines run in a southerly direction, there may be a realignment of an exterior wall to reduce the width ofthe structure in order to maintain the existing setbacks as the structure moves into its new location. Applicants stated that they would be replacing a fence and hedge to the rear ofthe property along Quaker Road that existed prior to the renovation of both structures. The Board noted that this was not a condition for relief. 4. Based upon the foregoing, the Board fmds that the relocation of the cottage structure to a point south of its existing location, reapportioning existing ground cover as proposed, with a maximum ridge height of 16 feet, and realignment of an exterior wall in order to not to encroach any further into the side yard setbacks, would not be substantially more detrimental to the neighborhood than the existing nonconformities. The Board finds that there would be little impact upon the neighborhood as the current use of the structure would not be altered and there would be no further encroachment into the setbacks. 5. Accordingly, by a UNANIMOUS vote, the Board GRANTS the requested relief by SPECIAL PERMIT under Nantucket Zoning By-law Section 139-33A to allow the project as proposed as it relates to the secondary structure, based upon the following conditions: a. The relocated structure shall be sited no closer to the westerly or easterly side yard lot lines than it is presently located; and b. AND ELIZABETH N. WERDIGER of Post Office Box 216, Purchase, NY 10577, File No. 043-02: 2. The Applicants are seeking a MODIFICATION of the Decision issued in BOA File No. 088-92, to the extent necessary, and/or Applicants are seeking relief by SPECIAL PERMIT under Nantucket Zoning By-law s139-33.A(4) and (5) and 139-33E (2) (a) (alteration or extension of a pre- existing, nonconforming structure/use). The Applicants propose to alter their pre-existing, nonconforming single- family dwelling, by constructing a one-story about 52 square-foot addition onto the rear of the structure that would conform to all setback requirements. Applicants are seeking relief to increase the ground cover ratio from about 39% to about 39.9%, in a district that allows a maximum ground cover ratio for undersized lots of 30% without further relief from this Board. Renovation will also include alteration of the existing rear main mass roof system, within the required five-foot easterly side yard setback area without coming any closer to that lot line than the existing structure. The roof ridge height will be raised slightly and dormers will be constructed on each side of the roof ridge. In addition, due to the increase in ground cover, the Applicants are seeking relief by SPECIAL PERMIT under Section 139-18 to waive the one required parking space, as parking calculations must be made as if newly constructed if there is an increase in ground cover. The Locus is nonconforming as to lot area, containing about 3,912 square feet of area in a zoning district in which minimum area is 5,000 square feet; as to frontage, with the Lot having about 44.97 feet of frontage on Main Street, in a district that requires a minimum frontage of 50 feet; as to side yard setback, with the main dwelling being sited about 4.9 feet from the easterly side lot line at its closest point, the rear ell being sited as close as about 4.1 feet from that lot line, and with the cottage being sited as close as about 2.0 feet from the easterly side lot line and as close as about 2.4 feet from the westerly side lot line, with the minimum side yard setback in this zoning district being five feet; and as to parking with no space having been historically provided on site. The Locus is situated at 154 and 154R MAIN STREET, Assessor's Map 41, Parcels 513 and 514, Land Court Plan 35205-A, and Plan Book 17, Page 82. There would be no other changes to the building footprint under this Application and the overall height of the main mass of the dwelling would remain unchanged. The new construction would not come any closer to the easterly side yard lot line than the existing structure. No on site parking space has been historically provided on site and none is planned due to the siting of the structures. 5. Based upon the foregoing, by a UNANIMOUS vote, the Board of Appeals made the findings that the dwelling upon the Locus pre-existed the 1972 enactment of the Nantucket Zoning By-law in its present configuration; that the proposed alterations, though increasing the massing within the easterly setback area as to height with the addition of dormers, and increasing the ground cover ratio, would not be substantially more detrimental to the neighborhood than the existing nonconformities, and that the proposed changes would not create any new nonconformity nor increase the intensity of use on the Locus. In addition, the Board finds that a waiver of the one previously grandfathered parking space would be in harmony with the general purposes and intent of the Zoning By-law. Such relief is consistent wi th relief granted on several occasions wi thin the same neighborhood for similar projects. 6. Applicants are seeking relief by Special Permit under ~139-33A to allow the construction of a 24+ S.F. addition to the existing structure. The structure is said to be nonconforming as to side yard setback, separation between principal and secondary dwellings, ground cover ratio, and is on a lot which has less than the required area and frontage. The structure is sited 4.1+ feet from the side lot 1 ine, is 9+ feet from the secondary dwellling, and has a ground cover ratio of 38%. The lot contains 3,912+ S.F. and has 44.97+ feet of frontage on Main Street. The requirements for the district ace minimum side yard setback of 5 feet, minimum 12 foot separation between dwellings on a lot, maximum ground cover ratio of 30%, minimum lot size of 5,000 S.F. with 50 feet of frontage. In addition and in the alternative, relief is sought by Variance under ~139-32A from the requirements of ~139-16A (Intensity regulations - ground cover ratio) to allow the addition as described. 2. The Locus consists of two adjacent parcels, one registered and the other unregistered, which have been in common ownership, and not in common ownership wi th any other adjacent land at all times material hereto. The total area of the parcels comprising the Locus is about 3,912 square feet, as shown upon the site plan by Hart-Blackwell & Associates, Inc., dated October 31, 1991, a reduced copy of which is attached as Exhibi t A hereto. Minimum lot area in this zoning district is 5,000 square feet. Accordingly, the applicants treat these two parcels as merged together as one lot for all relevant zoning purposes, and we find that they are indeed so merged. 2. As shown upon the plan attached hereto as Exhibi t A, the buildings upon the Locus consist of a principal dwelling and a cottage, with total ground cover ratio of abut 38%. Maximum ground cover ratio for this undersized lot is 30%; accordingly, the existing buildings are nonconforming. Other zoning nonconformities of the structures shown upon the plan, not material to the relief sought by the applicants herein, include -1- side yard setback of the easterly side of the easterly and westerly sides of the of the two dwellings is, at the feet, rather than twelve feet principal dwelling, cottage; and scalar closest point, only as required by the and of the separation abut nine by-law. 3. The major portion of the principal dwelling, and all of the cottage, were in existence prior to the advent of zoning requirements in Nantucket in 1972. However, an addition to the principal dwelling was constructed pursuant to a special permit granted by this Board, dated March 18, 1984, in our Case No. 006-84. A building permit for this work was issued on April 24, 1984 (No. 3430-84), and a Certificate of Occupancy was subsequently issued by the Building Department. 4. The appl icants now come before us with a request for special permit relief, needed in order to construct an addition to the main dwelling which would increase ground cover by twenty-four square feet, but would not increase or affect any other nonconforming aspect of the Locus and the structures thereon. In the course of construction, a portion of the existing structure would be removed and replaced. A sketch showing this addition, superimposed upon the Exhibit A survey plan, is attached hereto as Exhibit B. 5. At our public hearing, the applicants, who purchased the Locus on November 19, 1991, persuaded us that their practical needs for utilization of the principal dwelling dictate a modest addition, as requested here, to enable reconfiguration of a difficult space. No opposition was received by us, and the applicants informed us that they had received verbal expressions of support from neighbors. The location of the proposed addition, and its small size, will have minimal impact upon the neighborhood and upon any other interest protected by the zoning By-law. The Planning Board made no recommendation upon this application, leaving it to us to receive information at the public hearing. The applicants' plans have been approved by the Historic District Commission. 6. Accordingly, pursuant to By-law Section 139-33.A, we find that the proposed extension and alteration of the Locus will intensify the existing ground cover nonconformity but the al teration will not be substantially more detrimental to the neighborhood than the existing nonconforming structure upon the Locus. Therefore, by unanimous vote, we grant a special permit to the applicants, as requested, to enable them to construct the proposed addition, upon the condition that the addition be constructed substantially in accordance with the sketch plan attached as Exhibit B, and the plans submitted to and approved by the Historic District Commission in their Certificate of Appropriateness No. 23277. 7.
