NOTICE
A Public Hearing of the NANTUCKET ZONING BOARD OF APPEALS will
be held at 1:00 P.M., FRIDAY, APRIL 11, 2003, IN THE CONFERENCE ROOM,
TOWN ANNEX BUILDING, 37 Washington Street, Nantucket, Massachusetts, on the
Application of the following:
JESSE HANLEY AND SUSAN O'MEARA
BOARD OF APPEALS FILE NO. 027-03
Applicants are seeking relief by SPECIAL PERMIT under Nantucket Zoning By-
law Section 139-16C(I) to reduce the rear yard setback from ten feet to five feet to allow
placement of a rear second floor deck on a secondary dwelling, that is being added as part
of an overall renovation of the structure. The secondary dwelling is nonconforming as to
rear yard setback as it is sited as close as about 9.1 feet from that lot line in a district that
now requires a minimum rear yard setback of ten feet. Applicants also seek the above
relief to validate, what had been grandfathered until the Zoning By-law changed in 1992
allowing the reduction of side and rear yard setbacks from ten to five feet in the
Residential-l0 and Residential-2 zoning districts. The structure had been constructed in
1980 - 1981 during a time when there was a freeze period on dimensional zoning
requirements when the zoning district was changed from Residential-Commercial to
Residential-2. The Locus is conforming in all other respects. The Locus also contains a
conforming primary dwelling.
The Premises is located at 5 THURSTONS WAY, Assessor's Map 66, Parcel 33,
Plan File 8-B. The property is zoned Residential-2.
