Applicant is seeking to validate an existing kennel that has arguably been operating on her lot for the past ten years, which lot also contains Applicant's single-family dwelling. Applicant also operates a dog grooming business from her house, as a customary home occupation, which use does not need any relief from this Board. The Locus is nonconforming as to lot size, with the Lot containing about 8,000 square feet in a district that requires a minimum lot size of 120,000 square feet; and, as to frontage with the Locus containing about 80 feet of frontage along Ipswich Street in a district that requires a minimum frontage of200 feet. C I fO', :;::r::: '"'1:" .", 8 z; .." rT"1 CD N o :g N W CD To: The Zoning Board of Appea:s Date: ,1/h/o3 Re Request for Special Permit This is to request you consider me for a special permit for boarding dogs, I have had a long- term dog care business at my home site on Ipswich Street in Tom Nevers and believe my careful, considerate and professional way of running this small business qualifies me for the special permit Briefly, the relevant points for your consideration are I purchased my property tifteen years ago. a time when Tom Nevers was far less developed. I was determined to run a small-scale dog boarding busmess so that 1 would not encroach upon the sensitivity ofwl1at I knew would evc:1tually be a growing neighborhood. 1 have scrupulously maintained that principle. taking in a limited number of dogs at a time, screening owners and dogs to eliminate barkers, and always keeping the dogs leashed or behind their fence. [ have had the business for eleven years and have only recei ved two complaints in that time. My neighborhood indeed does have a number of dog.s (18) belonging to local residents. The vast majority of those dogs run free, and in fact are attracted to my boarding dogs and bark at my dogs from the street Enforcement of the local leash law would greatly reduce what might appear to be an excess of barking noise (see enclosed map) Virtually my entire adult working life has been devotee to animals. particularly do~s I have worked at the MSPC A; am a professional dog groomer; am completing my certification for Canine Physical Therapy; do volunteer work with the elderly with my canine friends, etc, In summary, I am a long-term Tom Nevers resident v.rith a long history of working with dogs Since 1 started my business I have taken care to be extremely considerate of those around me. While a permit was not required eleven years ago I have always run this modest business as if it were required, The occasional complaint which might ar~se now is almost wholly due. in m~' view, to the fact that there are e,ighteen dogs who live in my immediate area, many of which are allowed to run free and come over to bother my enclosed dogs. I'm sure to many people it is difficult to distir:guish between my dogs (the enclosed, passive ones) and loose neighborhood dogs (the instigators) I ask for formal approval of the now-required special permit for a business which 1 have run discreetly and professionally for the past eleven years. I have owned dogs all my life. When I was looking to purchase land on Nantucket I inquired about the zoning of dog boarding. I was told that I was zoned for boarding. No official said anything about a special permit. In the 1980's I purchased a piece ofland on Ipswich St. in Tom Nevers. At that time Tom Nevers was not appealing to many people. It was appealing to me because because of dog boarding. I was one of two homes for miles around. Homes starting rising slowly and then rapidly. I was the only house on lp~wich and Huntington Streets and there was one home on Devon Street. My dog kennel was erected in 1991. Now new homes have been built side by side and I have neighbors that I like and get along with all around me. In fact I have groomed, boarded, and made home visits for many of my neighbors for free, I board dogs on a small scale excluding vacations and holidays when the need is greater. This is my home; all dogs sleep where they please (inside only), all dogs are exercised daily, and all dogs are leashed and never free. Since I work out of my home the dogs are highly supervised. When an owner chooses to have their dog board here, I interview them first. The dog has to meet my dogs first. Chronic barkers are not asked back and/or they have to wear barking collars. The barking in the neighborhood comes from free roaming dogs who tend to bother my leashed and kenneled dogs. There seem to be many barking dogs in my neighborhood that are not part of my business. My education and work experience includes the following: . Certified Physical Therapist Assistant (Springfield Technology Institute) . Employed at the MSPCA from July, 1999 to March, 2000 as a kennel attendant and vet tech assistant . Completed the "Telling Touch for Animals" course at the Kirpalu Yoga Center · Presently working on certification as a Canine Physical Therapist . Presently working on certification in Canine Accupressure . CPR pet certified; bonded and insured · Presently volunteer on Sunday afternoons walking dogs at the MSPCA · Volunteered at Our Island Home and the Adult CarelDay CAre with my canine friends (The elderly and disable really enjoy the animals; it is very therapeutic for them.) · Presently a professional dog groomer . Volunteered with Sheri Holt, DVM on her surgery days (I feel well informed about the animal health and can handle many kinds of canine emergencies.) I have had my home boarding business for eleven years. There have been two complaints during this time; from a woman who lives on Devon Street. She called and was rude with her complaint and then called back and appologized. She said that she worked out of her home and the barking bothered her. I asked her what hours she was working so that I could re arrange my dog schedule. She never responded back to me. Dogs in the neighborhood often bark at the walkers. The only other complaint I have received came about a year later from IneighbOr who lives the furthest away. I changed my schedule but no adjustment seems to meet his needs. Most of the problems have risen from the eighteen dogs that live in the neighborhood. 85% o(the dogs are not leashed; they roam free. Enclosed are photographs of these free dogs in my yard. This happens on a daily basis. My dogs are always restrained or fenced in. The roaming dogs come into my yard and often torture my dogs. In additon, some of my neighbors cut directly through my yard passing a few feet away from my kennel with their children. This makes my dogs bark. The UPS truck truck that stops at 12 Ipswich Street, sometimes 2-3 times per day, makes my dogs bark. There must be a business run out of that home for a UPS truck to be delivering that often. People from three to five streets away walk their dogs down Ipswich Street. This also makes all the dogs inthe neighborhood bark. Enclosed is a map of Huntington Street, Ipswich Street and Devon Street. This map illustrates the amount of dogs living in this neighborhood. The complaint alleges that you are operating a kennel and a dog grooming business at 10 Ipswich Street. Review by this office has confirmed the complaint. Your property is located in the Limited Use General-3 (LUG-3) zone. Within the LUG- 3, both uses- kennels and dog grooming- are allowed uses under certain constraints. A kennel, defined under ~ 139-2 of the Zoning Code as "[a] building for the boarding for payor hire of four or more dogs," is allowed only under a special permit, as issued by the Zoning Board of Appeals (ZBA). A dog grooming business would be classified as a "home occupation," and requires either a use permit, as issued by the Building Commissioner, or a use permit and a ZBA special permit, dependent on square footage. A review of the Building Department file for 10 Ipswich St. shows that no such permits have been issued.
