At a public hearing of the Nantucket zoning Board of Appeals, on Friday, February 14, 2003, at 1:00 P.M., in the Conference Room, in the Town Annex Building, 37 Washington Street, Nantucket, Massachusetts, the Board made the following decision on the application of SOWER PROPERTY, LLC, c/o Reade, Gullicksen, Hanley & Gifford, LLP, Post Office Box 2669, Nantucket, Massachusetts 02584, File No. 014-03: 2. The applicant is seeking a MODIFICATION of the SPECIAL PERMIT relief granted under Nantucket zoning By-law ~~139-18.A (parking) and 139-20 (loading area) by the Decision in Board of Appeals File No. 042-02, which enabled the applicant to construct a commercial building with one retail entity on the first floor and an apartment on the second floor. The applicant asks that the Board of Appeals modify the original decision to reflect the fact that the footprint of the building as now constructed is as shown upon a new site plan, which differs in certain respects from the site plan attached to the Decision in File No. 042-02. To the extent necessary, the applicant is also seeking relief by VARIANCE from By-law ~139-16.A (Intensity Regulations - Setback), in order to enable placement of steps to the main entrance of the structure partially within the required five-foot easterly side yard setback area as measured from Washington Street. See also Board of Appeals files 102-98 and 124-98. The subject property (the IILocusll) is conforming in all other respects. The Locus is situated at 6 COFFIN STREET, Assessor1s Map 42.3.2, Parcel 21.1, is shown upon Land Court Plan 10710-L as Lot 6, and is situated in a Residential-Commercial zoning district. 3. Our decision is based upon the application and accompanying materials, and representations and testimony received at our public hearing. The Planning Board made no recommendation, on the basis that no matter of planning concern was presented. There was one letter of support on file; otherwise, there was no support nor opposition presented at the public hearing. 4. As presented by the applicant, the location of the steps serving the main entrance to the building constructed pursuant to the Special Permit relief granted in File 042-02 has been shown in the same way on the site plan presented to the Board of Appeals and attached to the Decision in that case, on the site plan presented to the Nantucket Historic District Commission 1 (IIHDCII) in connection with the approval of the building, and upon the site plan presented to the Nantucket Conservation Commission (IINCC") in connection with the issuance of an Order of Conditions for the project. These steps lie within the five-foot side yard setback area as measured from Washington Street (the applicant having elected to establish frontage on Coffin Street to allow zero front yard setback from that street). In the planning stage, it was assumed by the applicant's representatives that these steps, being of stone construction, would be deemed to be landscaping materials and thus not subject to setback requirements, and in fact a building permit was issued on the basis of the plans showing the steps as approved by the Board of Appeals. However, the applicant's surveyor conferred with the zoning Enforcement Officer, who ruled that the steps were not exempt and must conform to the five-foot setback. Accordingly, the applicant is applying for relief to enable construction of the steps as shown upon the plans approved by the HDC, the NCC, and by this Board. The only change from the site plan approved by the Board of Appeals is that a porch which was to be in the northerly corner of the building, adjacent to the entrance, has been replaced with an enclosed portion of the structure, and there is now an indentation in the southeasterly portion of the structure, containing a planter. The structure has been constructed in accordance with the plans approved by the HDC under Certificate of Appropriateness No. 40811. 5. The applicant's representatives explained that the reason for the steps to be sited within the five-foot setback from Washington Street was that, as a result of the fact that the building lies within the flood hazard zone with grade elevation below eight feet above sea level, the structure had to be elevated, resulting in more steps needed to obtain access from the adjacent sidewalk, and with a sloping walkway (the "Proposed Sidewalkll shown upon the Site Plan by Nantucket Surveyors Inc. dated February 14, 2003, a reduced copy of which is attached hereto as Exhibit A-1) providing handicapped access. Moving the structure away from Washington Street would bring the building closer to Coffin Street because of the tapering shape of the lot, and would reduce the area available for parking. The applicant expressed the opinion that the option of reconfiguring the steps to run parallel to Washington Street and not intrude upon the setback area, which would require modification to the HDC approval, would be unsightly and, because of a steep drop on the side, unsafe. 6. Based upon the factors presented, including the shape and soil conditions of the Locus, the evident uncertainty as to the status of stone steps with regard to setback requirements, and the good faith of the applicant in calling the question to the attention of the zoning Enforcement Officer, together with the absence of any opposition, the Board of Appeals, by a UNANIMOUS vote, made the finding that, owing to circumstances relating to the shape and soil conditions of the Locus and not affecting generally the zoning district in which the Locus is 2 situated, a literal enforcement of the provisions of the Zoning By-law would involve substantial hardship to the applicant, and that desirable relief may be granted as requested without nullifying or substantially derogating from the intent or purpose of the Zoning By-law, and by UNANIMOUS vote, GRANTED the requested relief by VARIANCE from the side yard setback requirement of five feet under By-law ~139-16.A from the easterly side yard lot line along Washington Street, upon the condition that the work shall be done in substantial conformity with the Site Plan attached hereto as Exhibit A-1. The Board of Appeals also, by UNANIMOUS vote, approved the Site plan presented by the applicant pursuant to By-law ~139-23, with the same content as Exhibit A-1. Dated: March~, 2003 ard S.
