DECISION:
1. At a Public Hearing of the Nantucket Zoning Board of
Appeals, held on Friday, February 14, 2003, at 1:00 P.M., in the
Conference Room, in the Town Annex Building, 37 Washington
Street, Nantucket, Massachusetts, the Board made the following
Decision on the Application of JAMES S. AND MARY G. BENNETT, of
2713 Olive Street, NW, Washington, DC 20007, File No. 009-03:
2. Applicants are seeking a MODIFICATION of the SPECIAL PERMIT
granted in the Decision in BOA File No. 079-02, which granted
relief under Nantucket Zoning By-law Section 139-33E(2) (a),
which allowed Applicants to remove an existing about 8' x 12'
deck and existing bulkhead entrance and replace it with a new
enclosed about 12' x 13' porch, with an attached open deck, that
would raise the existing ground cover ratio from about 33.65% to
about 38.66%, in a district that allows a maximum ground cover
ratio of 30%, without a Special Permit to exceed that amount up
to 50%. The porch and deck would meet all setback requirements.
Applicants are now seeking to enlarge the deck, approved at
about 12' x 13', to about 13' x 15', with a finished total
ground cover of about 40%. The Locus is nonconforming as to lot
size with the Lot containing about 3,112 square feet of area in
a district that requires a minimum lot size of 5,000 square
feet; as to frontage, with the Lot having about 33.44 feet along
York Street, in a district that requires a minimum frontage of
50 feet; as to setback with the dwelling being sited as close as
zero feet from the westerly side yard lot line, in a district
that requires a minimum side yard setback of five feet.
The Premises is located at 4 YORK STREET, Assessor's Map
55.1.4, Parcel 85, Plan Book 22, Page 114. The property is zoned
Residential-Old-Historic.
3. Our Decision is based upon the Application and accompanying
materials, and representations and testimony received at our
public hearing. The Planning Board made no recommendation as
the matter was not of planning concern. There was one letter in
favor on file from an abutter. No testimony in favor or in
opposition to the Application was presented at the public
hearing.
4. The Applicants were granted Special Permit relief in the
Decision in BOA File No. 079-02 in order to be allowed to
demolish an existing deck and bulkhead entrance and replace it
with an about 12' x 13' enclosed porch onto the rear of the
existing single-family dwelling. The existing deck and bulkhead
did not count towards ground cover as defined in Nantucket
Zoning By-law Section 139-2 in the definition of "ground cover
ratio". However, the new enclosed porch would be included in
such calculations by virtue of the screens. The ground cover was
to be increased from about 33.65% to about 38.66%. The existing
parking space would continue to be provided. The existing deck
encroached into the required five-foot westerly side yard
setback area and the new screened in porch would conform to all
setback requirements. No expansion, beyond what was proposed,
was planned for the single-family dwelling as part of that
Application. Applicants also represented that as a result of
their research, there had been an addition to the rear of the
pre-existing nonconforming structure as early as 1895, thus
establishing the pre-existing status of the structure.
Applicants are now before this Board seeking a modification
of said Decision in order to enlarge the proposed new screened
in porch from the previously approved about 12' x 13' to about
13' x 15' to provide more usable space for the family. The
ground cover would increase from the previously proposed about
38.66% to about 40.0% with the increase in the porch size.
5. Therefore, based upon these facts, the Board of Appeals
finds that the Locus is situated in a neighborhood where many
properties are nonconforming with respect to the requirements of
the Zoning By-law, such as lot area, setbacks, and ground cover,
and many have sought and obtained similar Special Permit relief
from this Board, including relief under By-law ~139-33.E. (2) (a)
from the 30% ground cover requirements. The Board further finds
that the modification of the previously approved Special Permit,
allowing the demolition of the deck and bulkhead entrance and
construction of the proposed single-story screened in porch to
the pre-existing, nonconforming dwelling, and total ground cover
being increased from the previously approved about 38.66% to
about 40.0%, conditioned as set forth below, would be an
increase in the nonconformities on the Lot. However, the Board
further finds that said further increase would not be
substantially more detrimental to the neighborhood than what
previously existed and would be in harmony with the general
purpose and intent of the Zoning By-law.
6. Accordingly, by UNANIMOUS vote, the Board GRANTS the
requested MODIFICATION of the previously granted relief by
SPECIAL PERMIT, under Nantucket Zoning By-law ~139-33.E. (2) (a)
in the Decision in BOA File No. 079-02, that allowed demolition
of the rear deck and bulkhead upon the Locus and construction of
an enclosed porch of about 12' x 13' onto the rear of the
single-family dwelling, having a maximum total ground cover
ratio on the Lot of about 38.66%, (not precluding construction of
a new conforming bulkhead entrance which would not count towards
ground cover requirements), and approves the new dimension of
about 13' x 15' with a total ground cover on the Lot of about
40%, upon the following express conditions:
a. The construction of the new screened in porch
shall be performed in substantial conformity with
the plan prepared by Josiah Barrett dated August
14, 1984, as marked by the Applicants, indicating
the location and new dimensions of the addition,
and showing compliance with all setback
requirements; a reduced copy of which is attached
hereto as new Exhibit AI.

DECISION:
1. At a Public Hearing of the Nantucket Zoning Board of
Appeals, held on Friday, November 15, 2002, at 1:00 P.M., in the
Conference Room, in the Town Annex Building, 37 Washington
street, Nantucket, Massachusetts, the Board made the following
Decision on the Application of JAMES S. AND MARY G. BENNETT, of
2713 Olive Street, NW, Washington, DC 20007, File No. U1Q-02:
2. Applicants are seeking a SPECIAL PERMIT under Nantucket
Zoning By-law Section 139-33E(2) (a). Applicants propose to
remove an existing about 8' x 12' deck and existing bulkhead
entrance and replace it with a new enclosed about 12' x 13'
porch, with an attached open deck, that would raise the existing
ground cover ratio from about 33.65% to about 38.66%, in a
district that allows a maximum ground cover ratio of 30%,
without a Special Permit to exceed that amount up to 50%. The
porch and deck would meet all setback requirements. The existing
parking space would continue to be provided on site. The Locus
is nonconforming as to lot size with the Lot containing about
3,112 square feet of area in a district that requires a minimum
lot size of 5,000 square feet; as to frontage, with the Lot
having about 33.44 feet along York street, in a district that
requires a minimum frontage of 50 feet; as to setback with the
dwelling being sited as close as zero feet from the westerly
side yard lot line, in a district that requires a minimum side
yard setback of five feet.
The Premises is located at 4 YORK STREET, Assessor's Map
55.1.4, Parcel 85, Plan Book 22, Page 114. The property is zoned
Residential-Old-Historic.
3. . Our Decision is based upon the Application and accompanying
materials, and representations and testimony received at our
public hearing. The Planning Board made no recommendation. No
testimony in opposition to the Application was presented at the
public hearing.
4. The
bulkhead
enclosed
existing
Applicants propose to demolish an existing deck and
entrance and replace it with an about 12' x 13'
porch onto the rear of the single-family dwelling. The
deck and bulkhead do not count towards ground cover as
defined in Nantucket Zoning By-law Section 139-2 in the
definition of "ground cover ratio". However, the enclosed porch
would be included in such calculations by virtue of the
screens. The ground cover would be increased from about 33.65,%
to about 38.66%. The existing parking space would continue to be
provided. The existing deck encroaches into the required five-
foot westerly side yard setback area and the new screened in
porch would conform to all setback requirements. No expansion,
beyond what is proposed, is planned for the single-family
dwelling as part of this Application. Applicants also
represented that as a result of their research, there had been
an addition to the rear of the pre-existing nonconforming
struct~re as early as 1895.
5.' 'Therefore, based upon these facts, the Board of Appeals
finds that the Locus is situated in a neighborhood where many
properties are nonconforming with respect to the requirements of
the Zoning By-law, such as lot area, setbacks, and ground cover,
and many have sought and obtained similar Special Permit relief
from this Board, including relief under By-law ~139-33.E. (2) (a)
from the 30% ground cover requirements. The Board further finds
that the proposed project, allowing the demolition of the deck
and bulkhead entrance and construction of the proposed single-
story screened in porch to the pre-existing, nonconforming
dwelling, and total ground cover being increased from about
33.65% to about 38.66%, conditioned as set forth herein, would
be an increase in the nonconformities on the Lot. However, the
Board further finds that said increase would not be
substantially more detrimental to the neighborhood than what
previously existed and would be in harmony with the general
purpose and intent of the Zoning By-law.
6. Accordingly, by UNANIMOUS, vote, ,the Board GRANTS the
requested relief by SPECIAL PERMIT, under Nantucket Zoning By-
law ~139-33.E. (2) (a), to allow demolition of the rear deck and
bulkhead upon the Locus and construction of an enclosed porch of
about 12' x 13' onto the rear of the single-family dwelling,
having a maximum total ground cover ratio on the Lot of about
38.66%, (not precluding construction of a new conforming bulkhead
entrance which would not count towards ground 'cover requiremets)
upon the following express condition:
a. The construction hereby permitted shall be
performed in substantial conformity with the plan
prepared by Josiah Barrett in August 14, 1984, as
marked by the Applicants, indicating the location
of said addition, and showing compliance with all
setback requirements; a reduced copy of which is
attached hereto as Exhibit A.
