DECISION:
At a regular rreeting of the Board of Appeals held r~arch 30,
1979, at the Tam Buildino., in the rratter of t.l1e Petition of
CIARA A. ML'RRAY (041-78), after due deliberation, the Board found:
1. This is an application for a Special Pem t to extend a
non-conforming use by construction of a guest house annex on pro-
perty of the Petitioner at Fair Street and Hillers Lane. '!he
Peti tioner acquired the prooerty at 27 Fair Street in 1977 and that'
building is licensed as a guest house, l.lhich is a valid non-conforTI:!-
ing use in this p.esidential Old ~listDric District. In the rear of
the property there exist two old garage huildings in poor condition
and containing a wall cottage or \<;orkshop. The Petitioner seeys
to construct a two-story building to replace t.ltese structures and
use the building for adcli. tional rental units, thereby expaning the
non-conforminq guest house 'Property.
2. This neighOOrhcx:x:1 is T?ri.rrarily residential in character.
The buildings are largely historic and t.l1e streets are narrav. Fair
Street does contain sorre roorring houses, hotels, and restaurants,
y.Jhich add to traffic and parking problems. 'Ihere have ree no car-
plaints about the Petitioner's guest house operation which are not
comron to any other establishment.s.
3. '!'he Peti tior~r sulTni tted a recorded plan shaving the ex-
isting garages on a separate LDt 2 having an area of 3,892 SQUare
feet, which lot is belav the minimup\ lot size, and the entire pro-
perty P1ust, t.l1erefore, be considered as one parcel for zoning pur-
poses. Such a parcel my have an accessory ctv:elling but the pro-
perties cannot be divided. The prcposed bui lding may, therefore,
te constnlctee as a one-farrily dwelling. '!he building may not,
hcwever, be utilizeO as another guest house nor as a guest house
annex as ~ relieve this \>,QuId be an irrproper extensioI!. of the oon-
conforTIling guest house into a residential area, and M)uld, due to
increased traffic, parkmg, and congestion generated, have a sub-
stantially detrirrental effect on the neighborhood.

NOTICE
A Public Hearing will be held on January 16, 1979,
at 8:00 P.M. at the TOWN AND COrNTY BUILDING, BROAD and
EEDEBAL STREET, Nantucket, Mass., on the petition of
CLARA H. MURRAY to be granted a Special Permit under
SEC. IV-B-2 of the Zoning By-Law to permit conversion
or replacement of existing garages with structure to
be used for a guest house annex. Premises are located
at 27 Fair Street in Nantucket and zoned RrSIDENTIAL-
OLD HISTORIC.
