DECISION:
At a regular meeting of the Board of Appeals held
December 19, 1978, in the Town Building, in the matter
of the petition of ESTER SWAYZE (037-78), after due
deliberation, the Board found:
1. The petitioner seeks a variance from Section
V to construct a residence on Lot 14, Land Court Plan
No. 13926-A, having 10,366 square feet of area in a zone
requiring 20,000 SQuare feet. She has owned Lot 15 and
Lot 14 since 1968. She is a widower who plans to sell
the family home on Lot 15 to pay debts and taxes, and
build a smaller homeon Lot 14. The adjacent lots in
several instances were sub-divided prior to 1972 into
lots as small as 5,500 square feet or less. Her pro-
perty has existed as two registered lots since 1929.
2. The petitioner has a hardship, financial and
otherwise, due to the necessity of selling her home, and
a literal enforcement of the by-law would involve
substantial hardship to her in that her Lot 14 would
have no viable use.
3. Relief may be granted without substantive
detriment to the public good and without nullifying or
substantially derogating from the intent or purpose of
the by-law.
4. The variance for Lot 14 is granted. unanimous
vote.
