BOARD OF APPEALS Nantucket, Massachusetts DECISION: At a regular meeting of the Board of Appeals held January 16, 1979, at the Town Buildinq, in the matter of the Petition of WILLARD J. GRFINER and BETTY r-L (~REINER (032-78), after due deliberation, the Boaro found: 1. ~he Petitioners own Lot 574 on Land Court Plan No. 5004-18 on Chuck Hollow Road in the Tom Nevers District of Nantucket, in an area zoned LPr;-3 reauir- ing 120,000 s~uare feet of land. Their lot contains 5.00 acres, or 217,~9P sauare feet. They seek to divide the Jot into two buildable lots of approximately 3.02 acres ana ].98 acres. 2. The Petitioners have o\'rned this lot since 1970, prior to the enactment of the zoninq bv-law. They wish to divide the lot in order to convey one lot to their children for residential use, but cannot do so under the oresent lot size reauirements. Some of the nearby lots are as small as 1.5] acres, and some are as larqe as 6.08 acres. 3. ~~e Petitioners' property is not subject to any circunstances relatinq to their land hut not affect- inq generally the zoning ~istrict in which it is located, and a literal enforcement of the by-law would not involve substantial hardshjp as required for a variance under General Laws, Chapter 40A, Sec. 10. 4.
