Sullivan, et ux - Board of Appeals 0'~78 Dear Madelyn: On October 17, 1978, the Nantucket Zoning Board of Appeals held a hearing on the petition of Philip H. Sullivan, et ux (0~1/78), which was submitted to the Board of Appeals on August 25, 1978. MGL Ch. 40 -A, Sec. 15 provides that if the Board of Appeals fails to make a decision on a petition for a variance within 75 days of the date of the application, then the petition shall be deemed granted. I submit that the 75 day period expired on November 8, 1978, and that the Board of Appeals did not file a Decision by that date and, therefore, the petition is granted. I would also suggest that within the twenty day period following November 8, 1978, no appeal was received in your office relative to this petition and I would greatly appreciate it if you could write me a letter to that effect.
