DECISION:
At a regular meeting of the Board of Appeals held
DeceroLer 1<), 1978, at the To"m Building, in the matter
of the petition of BURNS THREF, INC., (027-78), the
Board revjewed the winutes of the hearing held October
17, 1978. ~~r. Mooney noted the res :igna tion of Mr. Hyde
from the Board of Appeals since the hearins, and
informed the other members t~at he had been advised by
Town Counsel that the Board may act on the petition in
his absence. Therefore, after due deliberation, with
Mr. Mooney abstaining from the voting, the Board found:

The petition seeks a Special Permit for the

premises owned by Sherbur.ne Associates and
Burns Three, Inc.
2. The granting of a Special Per~it requires a
specific findinq that the use will not be in violation
of Section vI-E, which reads in part, "...any use of
any building, structure, or premises which is injurious,
obnoxious, offensive, dangerous, or a nuisance to the
community or to the neighborhood..." is prohibited.
3. The proPo3ed moped rental operation in this
neighborhood would be a violation of this section of the
Nantucket Zoning By-Law.
The Board voted to deny the Special Permit., 2-0.
