In the matter of the petition of Hector and Penelope MacDon-
aId (020-78): Mrs. MacDonald appeared and stated the petitioners
were the owners of a house at Five Coon Street. Some time ago th
petitioners removed a shed from the rear of the house because the
shed was in a state of disrepair and constituted a danger. The
petitioners now desire to reconstruct the shed and find their ad-
dition to exceed allowed ground cover. The area is zoned R-l al-
lowing 20% ground cover. The present improvements equal 560 sq.
ft., and the proposed improvement is 17.5' x 20' (350 sq. ft.).
The allowed ground cover for the petitioners' lot is 550 sq. ft.
The area is closely developed residential uses with signifi-
cant density. Most lots are small and now have improvements ex-
ceeding allowed ground cover.
The proposed use will not include additional bathroom facili
ties and will not contribute to existing sewer facility use.
The petitioner stated that it was her intent to rebuild the
removed structure but that the lack of funds delayed the project
and her non-conforming status was lost.
Mrs. Elsie Niles appeared in opposition saying that if the
structure had remained, even in a dilapidated condition, she woul
not object to a rebuilding. However, now that the shed had been
removed, the petitioner was bound by applicable zoning.
The chairman read two letters from immediate abuttors approv-
ing the request of the petitioners.
After due deliberation the Board found:
1. The proposed addition can be allowed under the terms of
the zoning by-law;
2. The petitioners do have a hardship in that they would no
have demolished the structure if they knew of the prohibition
against rebuilding and are thus effectively denied the use and en-
joyment of their property; and,

3. The variance if granted will not adversely affect the
surrounding area.
On motion of Mr. Hyde, seconded by Mrs. Bartsch, it was unan _
mously voted to grant the variance subject to the following condi
tion:
1. The addition will not exceed 17.5' x 20', and no further
improvements will be allowed on the property.
