Minutes of a meeting of the Board of Appeals, May 31, 1977.
Present were Members Holm~s, Backus, Hyde, and Alternate Member
Cahoon.
In the matter of the petition of Gardner MacDonald (012-77):
Mr. MacDonald stated he was the owner of six lots on West Chester
Street (reference Land Court Plan 13926A). He resides on Lot 5
and has a carpentry shop on the same lot. He desires to construct
a new carpentry shop behind his house on Lot 4. The zoning code
prohibits the use of Lot 4 for this purpose unless allowed by a
variance. Mr. MacDonald stated he owned other lots abutting Lot 4
except for a field to the rear.
Mr. MacDonald stat~d he has outgrown his existing shop and
must relocate.
No other person spoke in favor or in opposition.
The Chairman read a letter from the Planning Board >>ecommend-
ing the petition be granted.
After due deliberation the Board found that Mr. MacDonald has
outgrown his home-located business.
The area is such that his business and carpentry shop can be
relocated without any cn_nge to the neighborhood.
Upon motion of Mrs..Cahoon, seconded by Mr. Hyde, it .was un-
animously voted to grant the variance. Mr. Holmes abstained from
voting.

In the matter of the petition of Edward Burchell (013-77):
Mr. Richard Coffin appeared for the owner and stated that he repre
sented the contract purchaser. The land area is a 2.5 acre tract
I located on Surfside Road opposite The Derby Restaurant. The site
is zoned residentia1-commarcia1 which allows a contractors shop
by special permit.
The contract owner desires to use the premises

era1 construction. Commercial uses surround the area.
No other person spoke in favor or opposition.
The Chairman read a letter from the Planning Board recommend-
ing approval of the petition.
After due deliberation the Board found:
'The area is primaril~ commercial and light industrial in use.
The proposed use can be allowed without any damage to the sur
rounding area.
Upon motion of Mr. ~yde, seconded by Mrs. Cahoon, it was un-
animously voted to grant~he petition, and the special permit is
granted.

which is adequate for the development.

and will be available for year-round use. The entire complex will

points of the design and discussed the parking plan and plan for

Mr. Glidden stated that the Planning Board voted to approve
the plan and recommend approval of the petition.
No other person spoke in favor or in opposition to the peti-
tion.

1. The area is primarily commercial in use and is surrounded
by restaurants, stores, shops, and rooming houses.
2. The use can be a~lowed without detriment to the surround-
ing area and with adeqtlatesoreening will be beneticial to the
neighborhood '.
