In the matter of the petition of Judith Bartsch 907"",7c6.
Mrs. Bartsch addressed the Board and stated she is the
owner of a commercial building at 10 Lyons St. and desires
to receive a special permit to operate a dog grooming business.
The building is a warehouse/garage with an apartment on the
second floor. The building is now vacant but has recently
been used as a carpenter shop and previously used for machine
tool and dye making., It has also been used as a storage
area and work shop for an electrician.
Mrs. Bartsch stat~d that a typical day of operation
would begin at 8:30 - 9:00 A.M. and she would anticipate
receiving and grooming three dogs. Her daily operation
would probably end .at 3:00 P.M.

She would use no outside
kennel'and would have no boarding facilities. The premises
would not be occupied or used overnight.
The peti tL>ner st~.ted there is a demand for this service
on the island and she 'is confident that the demand can be
met by her operation on the premises and without injury or
damage t~ the area.
\ She stated thear~a now has commercial uses such as
the Twin St. yarn/theatre and Waine's Electric Shop on
Lyon St. There is OP the premises sufficient space to accomo-
date three cars.
Vernon.Thornton, DVM, spoke to the Board and stated
the need for such a service on Nantucket. He has personal
knowledge of three inquiries by off-island parties to establish
such a dog grooming faCility here. He stated that the MSPCA
facility is not equipPBd to perform this service and has
no personnel available. He stated that Mrs. Bartsch was
trained to do this wo~k and could be expected to conduct a

reliable shop.
Dr. Mary Brown stated she is the closest abutter and
believes the operation should be allowed. She stated that
she had reviewed Mrs. Bartsch's plans and could see nothing
determental to the area.
Mr. Fred Richrod stated he resides at 8 Lyon St.
He stated that the do~ grooming facility should be allowed
subject to certain conditions. These conditions are the
removal of a junk car now on the property, the improvement
of an area to accomodate parking and a trial time period
to see if the operation is offensive in any way. Mr.
Richrod stated the prior uses of the premises at 10 Lyons
St. were offensive in that the noise, car congestion and
late hours disturbeQ all area residents. He believed the
shop could be operated properly.
No other person spoke in favor of the petition.
In opposition appeared:
Mrs. Bancel LaParge who stated she resides on Pine
Street near Lyons St. ' Hi~torically, this area has been
low quality resident ial bl~t over the past few years the
area has improved substantially. This neighborhood
improvement would b~ set back if a commercial use such
as a dog gromming shop were allowed. She requested the
petition be denied.
Mrs. ~orothy Napper stated she lives at 4 Lyons St
and opposes the peti tion'. '. She stated there is now a prob-
lem with dogs in the area and this petition would make it
worse.
No other person spoke in opposition.
The Chairman read letters from Mrs. Martha Walters,
Mr. and Mrs. Sheldon Jen~ins, Mr. and Mrs.J. Evert Dymling,

and George Grimes in oppo:sition to the petition and from
William Tornovish, John F. McLaughlin, Mrs. Pheobe Swain,
Mrs. Herber~ Terry, .Barbara Hyde and Dr. V.R. Thornton
in favor of the petition.
After due deliberation, the Board found:
1. The area now is primarily residential and has
substantial commercial use. Lyon St. is a narrow one-way
street.
2. A dog grooming ~hop can be operated on the pre-
mises subject to certain conditions and restrictions. If
the restrictions are observed, no offensive noise
or oder will result and no traffic congestion will occur.
3. The operation can be conducted and be in har-
mony with the general neighborhood.
4. Tlle by-law allows the granting of a special per-
mit under these circumstances.
On motion by Mr. Taylor, seconded my Mrs. Backus,
it was unanimously voted that the special permit be granted
stibject to the following restrictions and conditions:
1. The hours of operation shall be not earlier than
8: 30 A. M. and not late:;:, than ~3: 00 P. M. on each Clay except
no operation shall occur on Sunday.
2. The premises shall not be used for the boarding
of animals and. no animals shall be kept on the premises
other than during the foregoin~ hours of operation and
exepts for household pet~ owned by the occupants of the
apartment premises.
3. No exterior sign shall be used or placed on the
premises advertising the premises or the business conducted.
4. The petitioner shall provide off-street parking

faiilities for at least two uutomobiles.
5. All operations. shall be conducted in-doors.
6. This permit shall be valid for the period ending
September 1, 1976, and~hall be reviewed at that time.
And therefore, the ~pecial permit is conditionally
granted.
