HomeMy WebLinkAbout033-73 'I ........ ,.I II II ,.. ~ In the matter of the petition of Roy K. Barrett (033-73) requesting a variance to expand a commercial use structure on Fairgrounds Road. Appearing for the Petitioner was Attorney Robert Campbell. Mr. C~bell stated the Petitioner operated a restaurant (on Fairgrounds Road) known as "The Pines" . Prior to purchasing "The Pines", Mr. Barrett informed I the Plan-I ! i i ning Board that he intended to purchase the building and intended to expand the building. Mr. Barrett was advised by the Planning Board that his pro- posed expansion would not violate the zoning by-laws then proposed since he was demonstrating an intent to enlarge what would ultimately be a non-confDrm- ing use. Mr. Campbell stated that the planning for the expansion was started prior to the effective date of the zoning by-law and Mr. Barre.t is there- .! of zoning by-laws in areas where such non-conforming uses are historically I prevalent. Mr. Campbell stated the proposed addition is designed to reflect no Cbagg in the use characteristic and will have no effect on the surrounding neigh- borhood. Mr. Campbell also stated the current use has been in existence for thirty years. The primary uses for the added areas will be for kitchen re- modeling and for the storage of supplies. Mr. Campbell presented a set of plans and a brief to the Board to be included as a part of the petition. Also speaking on behalf of the petition was Michael Driscoll. He stated the expansion should be allowed as part of a liberal approach to such non- conforming uses. He reminded the Board that we should encourage all efforts to improve facilities designed for seasonal uses since our economy is so dependent on that industry. No person spoke in opposition. The Chairman read a letter from Mrs. Phyllis Visco opposing the petition. Mrs. Visco stated her primary concernsc were increased tr.affic, late evening " . ')0 ~ . .- ,- acti vi ty and noise. Tb,e Chairman read a 1.tter from the Planning Board recommending the petition to be granted. The hearing was closed.
