th is heari ng. Mr'. Gi r ford presented a map 01' the area and ou t-
lined the area known iu-:. "Lot 4" as showed a proposed eight housing
units. lIe stated Lot 1 was a resubdivision without approval of
the Planning Board s i.nce it was a consolidation of prior lots
503-508. Mr. Gifford stated that jf Lot 4, if a consolidation
is entitl(::ct to be used for one single family dwelling unit and one
secondary unit.
It it. is eontended that Lots 503-508 are build-
able then to he so t11py'must have 50' frontage at the time of
building. Mr. Giffor~ also noted that some proposed buildings
sit astride lot lines.
Mr. Gifford stated that no adequate access exists'for emer-
gancy vehicles to gain ~ntrance to the proposed houses Rnd that
the only proposed roadway is on Lots 2 & 3.

Tillotson stated he also desired tt) incorporate, by reference,
all remarl<s and information provi.ded to the Board in hearing
#019-74. lie stated tbe fuets of the matter are similar to the
issue involving Lot 2 & 3. He stated that Chapter 40A, Sec. 7A
of MGLA provides an exemption as to use for 3 years from December
22, 1971. The permiLs issued are done so on the basis of a
condominiu~ use. The area shown as Lot 4 is not a resubdivision

7A MGLA is Jppl:ieabl(~ p~ovided the use is subject to density rules
'and regulations' in effect at the time of building. Density rules

are applicable to Lot 1.
2.I'Residenti.al use" as set out in the ~fGLA Chap. 40A refers to
single famUy use only and the term, as used in the Nantucket
Zoning ny-law refers to single family use only.
3. The lots, as shown on the plan, should have been consolidated
as provided in the Nantucket Zoning ny-law.
4. All ,matters of decision except the matter of sufficient ,notice,
which is not an issue here, are incorporated by reference as the
same are set out in the Petition oJ' Henry Kehlenbeek, Board of
Appeals 019,-74, previously decided.
Whereupon, we rind the the buildin~ permits issued by the
Building Inspector to be issued in violation of the Zoning By-'
law of the Town of Nantu6ket, and
upon motion Of II. Backus, seconded b~ R. Taylor, it was unan-
