ZONING BOARD OF APPEALS 37 Washington Street Nantucket, MA 02554 Assessor's Map 26 Parcel 31 LUG-3 211 Polpis Road Certificate of Title No. 16110 Land Court Plan 39337-A At a Public Hearing of the ZONING BOARD OF APPEALS held at 1:00 P.M., Friday, December 13, 2002, in the Conference Room at the Town Building Annex, 37 Washington Street, Nantucket, Massachusetts, on the Application of MAURICE E. and MILLICENT GIBBS, TRUSTEES, Board of Appeals File No. 086-02, the Board made ttie following Decision: 1. Applicants are seeking relief by SPECIAL PERMIT under Nantucket Zoning By- law Section139-33A(8). Applicants own a parcel of land with a single-family dwelling thereon, situated at 211 Pol pis Road. The Lot contains about 107,556 square feet of area in an LUG-3 zoning district, which requires a minimum lot size of 120,000 square feet. Applicants propose to change the configuration of their Lot by conveying an about 11,034 square-foot easterly portion of said Lot to the direct abutter to the east and south, in exchange for an about 11,034 square foot portion that would be annexed to the southerly side of the subject Lot. Said transfer would eliminate the rear yard setback violation of the dwelling as it is sited within the required 20-foot rear yard setback area. The Locus would continue to contain about 107,556 square feet of area after the transfer and no new non-conformities would be created. The abutting Lot is comprised of at least eight acres and is shown on Map 26 as combined Parcels 29 and 30, with addresses of 215 and 219R Polpis Road. The Lot is conforming in all respects to the dimensional requirements of the Zoning By-law. 2. The Decision is based upon the Application and materials submitted therewith, and the testimony and evidence presented at the hearing. There was no recommendation from the Planning Board as the Board determined that the matter was not a planning concern. There were no letters on file. 3. Applicants, through their attorney, explained that this was simply a lot line reconfiguration which would result in Applicants' lot having the same total area but that the rear of Applicants' single-family dwelling would have a larger back yard and the rear yard setback intrusion, which is pre-existing and non-conformity, would be cured. The resultant Lot would still have in excess of 200 feet of frontage on Polpis Road and no new con-conformities would be created. 4. After consideration of all the information presented to the Board, the Board found that the proposed Lot re-configuration with an exchange of properties of equal square footage is the type of situation contemplated by Section 139-33A(8). The proposed re- configuration will cure a nonconformity and not create any new nonconformities, is in keeping with the residential character of the neighborhood, and would not derogate from the spirit or intent of the Zoning By-law nor be substantially more detrimental to the neighborhood that the existing nonconformities. 5. Accordingly, by UNANIMOUS vote the Board GRANTS the requested relief by SPECIAL PERMIT under Nantucket Zoning By-law Section139-33A(8) to allow the re- configuration of the lot lines as described above with the resulting Lot area to be no less than about 107,556 square feet and as shown on the "Plan of Land", done by Charles W.
