SCHAECHER an~ PAMELA H. SCHAECHER of 317 Madaket Road, Nantucket, MA 02554, Board of Appeals File No. 081-02, the Board made the following Decision: 1. Applicants are seeking relief by VARIANCE under Nantucket Zoning By-Law Section 139-16A (Intensity Regulations - ground cover ratio). Applicants are asking the Board to validate the existing ground cover ratio of about 12.63% of a single-family dwelling, in a district that allows a maximum ground cover ratio of 12.5%. An addition was constructed pursuant to a duly issued Building Permit in 2000-2001. The Locus conforms to setback requirements. However, the Locus is nonconforming as to lot size with the Lot containing about 16,000 square feet of area in a district that requires a minimum lot size of 20,000 square feet. The premises is located at 317 MADAKET ROAD, Assessor's Map 60.2.1, Parcel 38, Land Court Plan 3092-R, Lots 137 and 138. The property is zoned Residential-2. 2. The Decision is based upon the Application and the materials submitted with it, and the testimony and evidence presented at the Hearing. The Planning Board made no recommendation as it was not a matter of planning concern. There were three (3) letters submitted into the me from abutters in support of the Application. There was no opposition on record to the Application. 3. Applicants, through counsel, represented that they had constructed an addition in late 2000 under a duly issued Building Permit. During the construction it was found that there was a problem when an exterior door could not be placed in accordance with the original architectural plans due to the roof height in that particular part of the single-family dwelling. H constructed per the plans, the door would be in violation of the Building Code. Thus, the builder made the decision to relocate the door to the rear of the structure thus creating the ove)-age in ground cover due to reconfiguration of the wall dimensions where the door was placed. Counsel also otTered into the record a letter from Nantucket Surveyors, Inc. dated November 15, 2002, which stated in pertinent part that "the ground cover measured along the exterior building wall of the dwelling is 2,021 square feet. In addition, we have taken measurements to the concrete foundation, and find the ground cover to be 1,992 square feet." The allowable ground cover for this Lot is 2,000 square feet. The lot-of-record contains about 16,000 square feet and became pre-existing nonconforming as a result of action taken on a Zoning By-law at the 1974 Annual Town Meeting, which changed the minimum lot area from 5,000 square feet to 20,000 square feet. Testimony from a builder that was involved in this project after the ground cover problem was determined was given. He clarified how the overage in ground cover was caused by the placement of the door. The original builder was no longer involved with the project and was unavailable. There are no further alterations of the structures on the subject Lot proposed as part of this Application. '4. Therefore, based upon the foregoing, the Board finds that , VARIANCE relief to validate the existing ground cover would have little detrimental impact upon the neighborhood. The Board also finds that there is no immediate remedy to the problem and Applicants' ability to acquire more land to cure the ground cover problem is limited due to the fact that the Locus is bordered on three sides by streets and on the fourth side by land not held in common ownership with the Locus. In addition, the Board finds that a grant of relief due to the unique circumstances related to the topography of the structures on the lot and de minimus nature of the violation, especially affecting such land or structures but not affecting generally the zoning district in which it is located, a literal enforcement of the provisions of this Zoning By-law would involve substantial hardship, financial or otherwise, to the Applicants, and the desirable relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of the By-law. 5. Accordingly, by UNANIMOUS vote, the Board hereby GRANTS the requested VARIANCE relief under Nantucket Zoning By-Law Section 139-16A to validate the ground cover ratio on the Locus as a maximum of about 12.63%. Relief is hereby conditioned upon the following: (a) No additional expansion of the structures on the Lot shall be done without further relief from the Zoning Board of Appeals; and (b) Improvements on the Lot shall be in substantial conformance with the "As-Built Plot Plan", done by Richard K. Earle of Nantucket Surveyors, Inc., dated July 15,2002, a reduced copy of which is attached hereto as Exhibit A. An addition was constructed in 2000-2001 pursuant to a duly issued Building Permit. Said addition was constructed in excess of the proposed square feet of allowable ground cover which resulted in the non-complying ground cover ratio (0.13 over allowable ground cover). This lot was created on June 3, 1927 and the lot area (16,000 square feet) was rendered non-conforming as to area requirement by adoption of the 20,000 square foot area requirement, which replaced the 5,000 square foot requirement, at the 1974 Annual Town Meeting. The front and side yard setbacks are complying, and there are no changes proposed.
