NOTICE
A Public Hearing ofthe NANTUCKET ZONING BOARD OF APPEALS will be held at 1:00
P.M., FRIDAY, OCTOBER 18, 2002, IN THE CONFERENCE ROOM, TOWN ANNEX
~. ~UILDING, 37 Washington Street, Nantucket, Massachusetts, on the Application of the
following:
CHARLES E. RYAN AND CAREN SUE LAMBERT
BOARD OF APPEALS FILE NO. 073-02
Applicants are APPEALING, under Nantucket Zoning By-law Section 139-31A,
a decision of the Zoning Enforcement Officer, ("ZEO"), as so stated in a letter dated
September 27, 2002, in which he denied a sign-off on a Building Permit request to build
a conforming addition onto a secondary dwelling. The evidence presented to the ZEO
was not sufficient in his opinion to support a claim of grandfathering for the secondary
dwelling unit, as it is sited within the northeasterly and northwesterly five-foot required
side and rear yard setback areas. Should the structure not be grandfathered as a secondary
dwelling unit, and ruled to be an ancillary structure, Applicants would need Special
Permit relief to construct even a conforming addition. Should the structure be ruled a pre-
existing nonconforming dwelling unit, relief from this Board is not necessary to construct
a conforming addition provided that parking and other dimensional requirements are met.
Applicants are asking the Board to overturn the decision of the ZEO and rule that the
secondary dwelling unit use pre-dates the 1972 enactment of the Zoning By-law and is
validly pre-existing and nonconforming based upon the evidence and that no relief is
necessary. In the alternative, Applicants are asking the Board to validate by SPECIAL
PERMIT under Nantucket Zoning By-law Section 139-33A the previous conversion to a
secondary dwelling and allow the addition, and construction of a new foundation as
proposed.
The Premises is located at 5 MILK STREET, Assessor's Map 42.3.3, Parcel 175,
Deed Ref 625/105. The property is zoned Residential-Old-Historic.

Applicants are APPEALING, under Nantucket Zoning By-law Section 139-31A, a
decision of the Zoning Enforcement Officer, ("ZEO"), as so stated in a letter dated
September 27, 2002, in which he denied a sign-off on a Building Permit request to build
a conforming addition onto a secondary dwelling. The evidence presented to the ZEO
was not sufficient in his opinion to support a claim of grandfathering for the secondary
dwelling unit, as it is sited within the northeasterly and northwesterly five-foot required
side and rear yard setback areas. Should the structure not be grandfathered as a secondary

Dear Mr. Ryan:
Your request for a Building Pennit to construct a basement and an addition to a pre-
existing, nonconforming structure at 5 Milk St. (Map# 42.3.3, Parcel# 175), has been
denied for the following reason(s):
Section 139-33A(5) of the Nantucket Zoning Code states that pre-existing,
nonconforming structures which violate front, rear or side-yard setback distances may be
extended or altered pending receipt of a special permit, as issued by the Zoning Board of
Appeals (ZBA). A provision in the Bylaw, ~139-33A(3)a, to allow the Zoning
Enforcement Officer discretion regarding alterations to pre-existing, nonconforming
single or two-family dwellings does not appear to apply to this maner, as there is a
question pertaining to the legal use of the back building as a dwelling unit. Therefore,
special permit relief from the ZBA will be required prior to the issuance of a Building
Permit.
Your application materials will be held in the Building Department, in the file for 5 Milk
St., and will be kept until this issue is resolved. If you have any questions regarding this
