Friday, October 18,2002, in the Conference Room, Town Annex Building, 37 Washington
Street, Nantucket, Massachusetts, on the Application of the WILLIAM A. WHITE, with an
address of28 Creek Road, Nantucket, Massachusetts 02554, Board of Appeals File No. 071-02,

1. Applicant is seeking relief by SPECIAL PERMIT under Nantucket Zoning By-law
Section 139-16C(2), or in the alternative, relief by V ARlANCE under Section 139-16A
(Intensity Regulations-setback) to validate the siting of an existing deck. In 1978 a predecessor-
in-title undertook relocation of two dwelling units and construction of new foundations under
duly issued Building Permits. Applicant purchased the property in 1991. A new survey done at
that time showed that the southerly lot line was about 20 feet from his nearest structure, in a
district that required a minimum side yard setback offive feet. In 1991, Applicant constructed
new additions to both structures under a duly issued Building Permit, with the siting dependant
on previous location plans and the 1991 survey. However, it was ascertained in 1993 that due to
an error on a 1928 recorded plan showing the layout of Coffin Street to the south, and subsequent
correction in 1993, the Applicant's southerly property bound was moved in a northerly direction
by eight feet, rendering the deck on the southernmost house non-complying as to setback
distance. The deck was then found to be sited as close as about four feet from that lot line.
Applicant is now asking the Board to validate the deck as presently sited whether by Special
Permit, as the structure was so sited prior to 1990 or by Variance should the Board deem it the
appropriate relief in this circumstance. Applicants are not planning any changes under the
Application. The Locus is conforming in all other dimensional respects under the Zoning By-
law.
The Premises is located at 24 LINCOLN STREET, SIASCONSET, Assessor's Map
73.4.2, Parcel 3, Plan Book 7, Page 20, Lot 16. The pr~perty is zoned Residential-I.
2. The Decision is based upon the Application and the material submitted with and the
testimony and evidence presented at the Hearing. The Planning Board made no recommendation
as the matter was not a planning concern. There were no letters on file in favor of or in
opposition to the Application.
3. The Applicant acquired the Locus in 1991. At the time of purchase, there were two
cottages on the property. According to the records at the Nantucket Building Department, in
1978 a Building Permit was issued to relocate two structures and build foundations on the
property. When the Applicant purchased the property, he had a survey done which showed that
the southerly bound of the lot was twenty (20) feet from the existing building, in a district that
requires a minimum side yard setback often feet. In 1991, the Nantucket Building Department
issued Building Permits, which allowed additions to both of the cottages. In 1993, an abutter to
the property informed Applicant that the actual lot line to his property was in fact eight feet more
to the north than he thought. It was determined that a plan dated October 15, 1928 and recorded
in Plan Book 9, Page 3, mis-located Coffin Street by 2.5 degrees. In addition, Land Court Plan
No. 13647A fixed rights of way and land south of Locus. As a result of both of these plans, the
southerly bound of Locus was shifted over approximately eight feet. In 2001, Applicant had a
new plot plan of the property done, which showed that, as a result of these miscalculations in the
lot line, the deck on the southerly cottage was approximately 3.51 feet from the southerly lot
line.
Applicant further represented that he sited and constructed the decks on the southerly
cottage based on both the 1978 building permits and the Plot Plan prepared in 1991. The deck is
approximately 8' x 16'. Said deck is an integral part of the dwelling and provides a means of
access to the structure. If required to remove that portion of the deck that is situated within the
required setback area, the deck would become too small for practical use and would have to be
tom down in its entirety.
4. Based upon the foregoing, the Board considered the request for a Special Permit pursuant
to Section 139-16C(2) of the By-law. After considering the equities involved, the Board finds
that as the deck is less than four (4) feet from the lot line, Special Permit relief was not available
under the provisions of that section. In addition, the Board specifically finds that the Applicant
acted in good faith in reliance upon data provided to him, and further relied upon by the Building
Department as well when it issued the Building Permits. The Board further finds and that there is
a uniqueness in the topography of the structures and shape of the Locus, and that owing to said
changes in the shape of the lot as a result ofthe surveying errors, and especially affecting the
Locus but not affecting generally the zoning district in which it is located, that a literal
enforcement of the provisions of the Zoning By-law would involve substantial financial hardship
to the Applicant, and further that the desirable relief may be granted without substantial
detriment to the public good and without nullifying or substantially derogating from the intent or
purpose of this By-law.
5. Accordingly, by UNANIMOUS vote, the Board GRANTS the requested relief by
V ARIANCE, from the restrictions of Nantucket Zoning By-law Section 139-16A based upon the
plan done by John J. Shugrue, dated October 19,2001, marked as Exhibit A, a reduced copy of
which is attached hereto.

Applicant, William A. White seeks a Special Permit pursuant to Section 139-
16(C)(2) of the Nantucket Zoning By-Law. In the alternative, the Applicant seeks
a Variance pursuant to Section 139-32 of the Nantucket Zoning By-Law from the
requirements of Section 139-16 of the By-Law with respect to side yard setback
requirements. Locus is presently improved by two dwellings. Locus is located in
the R-1 Zoning District. Locus is comprised of a lot having a lot area of 18,499 ::t
square feet.
The Applicant acquired Locus in 1991. At the time of purchase, there were two
cottages on the property. According to the records at the Nantucket Building
Department, in 1978 a building permit was issued to relocate two structures and
build foundations at the property. When Applicant purchased the property, he had
a survey done which showed that the southerly bound of the lot was twenty (20)
feet from the existing building. In 1991, the Nantucket Building Department

line.
Applicant sited and constructed the decks on the southerly cottage based on both
the 1978 building permits and the Plot Plan prepared in 1991. The deck is
approximately by . This is the minimum size which makes the deck
useable by Applicant. If required to remove the portion of the deck to take it out
of the setback, the deck would become useless and would have to be tom down.
The burden of correcting the intrusion substantially outweighs any benefit to an
abutter of eliminating the intrusion. The Applicant requests that the Zoning Board
of Appeals votes in favor of the Special Permit relief
In the alternative, the Applicant requests that the Board consider granting relief by
Variance pursuant to Section 139-32. The shape and size of the Locus effectively
changed after the Applicant became the owner. The house had been sited based
on plans that later were discovered to be wrong. To ask the Applicant to remove
the deck would be a substantial hardship.
The requested reliefis in harmony with the intents and purposes of the Nantucket
Zoning By-Law. Given circumstances relating to the soil conditio~ shape or
topography of the structure and the Locus and especially affecting this Locus and
not affecting generally the zoning district in which it is located, a literal
enforcement of the provisions of the By-Law would involve substantial hardship
to the Applicants. This desired relief may be granted without substantial detriment
to the public good, and without nullifying or substantially derogating from the
intents and purposes of the By-Law. The Applicant asks the Board to vote in
favor of the Variance as requested.
