A Public Hearing of the NANTUCKET ZONING BOARD OF APPEALS will be held at 1:00
P:M:, FRIDAY, OCTOBER 18, 2002, IN THE CONFERENCE ROOM, TOWN ANNEX
~. - BUILDING, 37 Washington Street, Nantucket, Massachusetts, on the Application of the
following:
DIETER F. SCHWARZER AND SABINE V. SCHWARZER
BOARD OF APPEALS FILE NO. 070-02
Applicants are seeking a MODIFICATION of the VARIANCE granted in the
Decision in BOA File No. 095-87. Applicants propose to construct an addition onto the
existing garage which is sited as close as about 9.5 feet from the southwesterly side yard
lot line in a district that requires a minimum of ten feet for undersized lots. The garage
use would remain on the first floor of the original structure with no change in that
footprint. However, Applicants now propose to add a dormer over the existing footprint
and construct a conforming addition onto the structure, adding secondary dwelling space
over the garage and in the new addition. The Locus is conforming and will continue to
conform after construction of the addition, to all other setback, ground cover and parking
requirements. The Locus is nonconforming as to lot size with the Lot containing about
80,000 square feet in a district that requires a minimum lot size of 120,000 square feet.
The Premises is located at 10 PARSONS LANE, Assessor's Map 75, Parcel 98,
Land Court Plan 5004-18, Lot 553. The property is zoned Limited-Use-General-3.

DECISION:
The BOARD OF APPEALS, at a Public Hearing held on FRIDAY, AUGUST 21.
1987 at 1:30 p.m. in the Town and 'County BUilding, Nantucket, made the
following Decision upon the Application of DIETER AND SABINE SCHWARZER (095-8~
address46 Salmi Road, Framingham, MA 01701.
1. Applicants seek a VARIANCE from the side lot line setback require
ments of Zoning By-Law SECTION 139-16C. If granted, Applicants could validly
maintain their garage structure/completing it and continue its use as a garagE
despite its siting as close as 9.5 feet from the south side lot line. The
premises are located at 10 PARSONS LANE, Assessor's Parcel 75-098, Land Court
Plan 5004-18, Lot 553, zoned LIMITED USE GENERAL-3.
2. Our findings are based upon the Application papers and correspondem~.
plans, representations and testimony received at our hearing. Based specifical
ly upon Applicants' representations and without evidentiary proof pro or con,
Ne find for purposes of this proceeding that Applicants' parcel is a "lot of
record" in the context of Section 139-16C. That is, the 2 acre lot was of
record in the Registry of Deeds prior to mid-1972 zoning enactment and is
Jndersized and non-conforming as to the 120,000 SF minimum lot size required
In LUG-3. Accordingly the side lot line setback required is only 10 feet, not
~O feet as for post-zoning or conforming lots.
3. According to Agplicants, awareness of' possible south side yard
~ncroachment came from their southerly abutters who undertook with permission
:0 have a surveyor determine the actual setback. A copy of the resulting 6/9/87
;urvey accompanying the Application papers shows the zoning violation with
lnly 9.5 -foot setback. The wrongful siting, far removed from that shown on
:he HOC-approved site plan upon which the Building Permit was based, is
lscribed to a miscreant surveyor. The latter, appearing to function under super.
lision of a licensed surveyor, using truck and equipment of the firm,:was
lctually moonlighting. Said surveyor, we are told, was subsequently fired
)y the firm. While Applicants apparently proceeded toward completion of the
~arage after awareness of the zoning question, the record before us does not

'support any finding of culpability or improper benefit on their part. They
not going to convert the garage to another use, e.g., sleeping space or dW0
ling unit. They did obtain a survey before batter boards were set.
4. Applicants face a financial and practical hardship if they must
cease and desist from completion' and use of the garage. Based upon the 6/9/
survey (revised 7/30/87), they cannot proceed without a Variance. Most sign
ficantly, their Variance request has the written support of thier southerly
abutter and another slightly more distant. The Planning Board's recommenda-
tion was favorable. One abutter saw'no reason for granting the Variance as
Applicants were advised of the siting violation when the foundation was
placed. However, we were unable to determine that knowledge of the violatio~
pre-existed construction of the foundation.
5. Given the topography of the lot associated with the 6-inch intrusi
into the required side yard and the noted hardship, we are able to make the
findings necessary for grant of the requested Variance. Specifically, such
relief may be granted without substantial detriment to the public good and
without nullifying or substantually derogating from the intent or purpose of
the zoning chapter.
6. Accordingly, by UNANIMOUS vote, this Board GRANTS to Applicants
the requested .VARIANCE from the 10-foot south side yard setback required
by SECTION 139-16C to validate the building's existing siting and to allow
its completion and use as a garage.
